Reform process in Bulgaria： Challenges and perspectives after joining EU

The paper＇s objective is to analyze and outline the key challenges and perspectives in achieving a modern type of governance and a well functioning and transparent administrative system, capable to apply the best European practices and policies. The study summarizes the main results, achievements and shortcomings of the reform process and reveals that the progress has been slower and more limited than expected despite all efforts of the government. The conclusion made is that Bulgaria needs to not only substantially enhance its administrative and judicial capacity, but also drastically intensify its reforms to improve the management of EU funds and achieve concrete results in the fight against corruption. All this requires strong political will and determination.     

论私人在行政许可法律关系中的地位及权利保障

受到行政许可行为影响的私人主要包括两类 :行政许可相对人与行政许可相关人。行政许可相对人与相关人都是行政许可法律关系的参与主体 ,都既享有权利又承担义务。行政许可相对人享有的权利主要有 :申请权、知情权、无瑕疵许可裁量请求权、程序抗辩权、受平等对待的权利、许可信赖权、申请救济权等 ;行政许可相关人享有的权利主要有 :程序抗辩权、排除违法行政请求权、行政介入请求权、申请救济权等。对行政许可相对人与相关人享有权利的保障是行政许可法律制度的重要内容。     

“登记手册”与加工贸易活动中的走私犯罪案件侦查

登记手册一直是海关监管加工贸易的重要工具,但在实物流和资金流的流转过程中会引起经济行为的变化,甚至会引发经济犯罪。为遏止经济犯罪的发生和发展,行政部门必须强化行政监管,公安机关应加强业务培训,提高经侦民警发现和甄别经济犯罪的能力,并且要充分调动社会各界大胆检举揭发经济犯罪的积极性,从而为经济建设保驾护航,维护良好的市场经济秩序。     

英法大部门政府体制的实践与启示

本文对英法大部门政府体制的理论起源、部门构成与演变、部门内外协调机制进行了分析,总结了其成功的经验和实施的制度基础,指出完善的市场经济、成熟的社会自治、政府职能的及时更新、配套改革措施到位是英法大部制成功运作的基础。与此相应,在我国推动相应的改革必须着力强化部门首长的协调与控制能力、围绕职能行使效率设计部门结构、推进相应的综合配套改革。     

外国能源管理机构设置及运行机制研究

能源是人类社会赖以生存和发展的重要物质基础,各国政府对能源管理都高度重视,采取了许多积极有效的措施建立和完善能源管理体制。然而,我国现行的能源管理体制还存在着诸多问题和不足,远远不能适应我国经济社会发展和国际竞争的需要,改革迫在眉睫。因此,应该从我国能源管理的现实出发,积极借鉴国外能源管理的成功做法和经验,建立集中管理、监管分立、法律完备、协调高效的能源管理体制。     

Administrative Justice in the Wake of I,Daniel Blake

This article argues that Ken Loach's film, I, Daniel Blake, invites deep reflection on the relationship between the individual and the state, and, more particularly, on the role of administrative justice in restoring a re‐imagined sense of citizenship. Drawing on earlier debates from the 1950s, as well as on more recent advocacy of the ‘connected society’, the article proposes that to meet such an ambition, administrative justice must be recognised as an overarching set of principles and values, rooted in a framework of human rights and with a reinvigorated public‐sector ombud‐institution at its centre. In this way, administrative justice might serve as an effective and restorative counterweight to more legalistic options for responding to public grievance, whether the result of routine encounters with the state or of a major breakdown in trust, such as that occasioned by ‘Grenfell Tower’.     

Low‐trust bureaucracy: Understanding the Mexican bureaucratic experience

Latin American bureaucracies are notorious for their inefficiency and opacity, yet there is very little empirical research done on what exactly constitutes the “bureaucratic experience” for citizens and what the costs of bureaucratic dysfunction are. To improve our understanding of this topic, 5 cases of Mexican citizens' encounters with public bureaucracies are used to develop the notion of “low‐trust bureaucracy”: public organisations in which access to services is unreliable and the levels of control towards both citizens and bureaucrats are excessive. This bottom‐up analysis of administrative practices contributes to our understanding of the ineffectiveness of government programmes and services, but also of how bureaucracies in developing countries amplify social inequality rather than function as a social equaliser. Furthermore, this article adds new insights to the existing understanding of administrative burdens as a result of either political tactics or mere benign neglect. The data presented here suggest that structural and intractable characteristics of the broader administrative context, such as authoritarian legacies, can produce behavioural patterns that shift bureaucratic attention away from a fair and efficient service provision.     

Biopolitics,borders, and refugee camps: exercising sovereign power over nonmembers of the state†

This article addresses the relationship between the concepts of national identity and biopolitics by examining a border-transit camp for repatriates, refugees, and asylum seekers in Germany. Current studies of detention spaces for migrants have drawn heavily on Agamben’s reflection on the “camp” and “homo sacer,” where the camp is analyzed as a space in a permanent state of exception, in which the government exercises sovereign power over the refugee as the ultimate biopolitical subject. But what groups of people can end up at a camp, and does the government treat all groups in the same way? This article examines the German camp for repatriates, refugees, and asylum seekers as a space where the state’s borders are demarcated and controlled through practices of bureaucratic and narrative differentiation among various groups of people. The author uses the concept of detention space to draw a theoretical link between national identity and biopolitics, and demonstrates how the sovereign’s practices of control and differentiation at the camp construct German national identity through defining “nonmembers” of the state. The study draws on ethnographic fieldwork at the Friedland border transit camp and on a discourse analysis of texts produced at the camp or for the camp.     

论可诉性是行政行为的本质属性

可诉性是指法律行为的可诉性,行政行为的可诉性是指行政主体作出的行政行为在一定条件下可诉诸法院司法审查的一种本质属性,这是判断行政行为的一个根本标准;过去,我国学界对行政行为特性的认识却忽视了这一点。可诉性是贯穿于行政行为与行政诉讼的一条红线,它使公民行政诉权的行使与法院对行政权的司法审查成为可能,具有普遍适用性。

教学管理人员素质的高低直接影响到教学管理水平和管理效果。高等教育大众化及本科教学工作水平评估对教学管理和教学管理人员的素质、能力提出了更严格的要求。教学管理人员不仅必须具备一定的理论和知识水平,更要掌握一定的管理技能,主要包括技术技能、人际技能和概念技能,还应具备处理突发事件的技能。
