登记手册一直是海关监管加工贸易的重要工具,但在实物流和资金流的流转过程中会引起经济行为的变化,甚至会引发经济犯罪。为遏止经济犯罪的发生和发展,行政部门必须强化行政监管,公安机关应加强业务培训,提高经侦民警发现和甄别经济犯罪的能力,并且要充分调动社会各界大胆检举揭发经济犯罪的积极性,从而为经济建设保驾护航,维护良好的市场经济秩序。     

Empirical examination of public debt sustainability in African economies: A panel data analysis

This study intends to investigate public debt sustainability across 29 Sub-Sahara African (SSA) economies, employing various econometric specifications, for the sampled years 1996–2020. The study employs Bohn's (Are stationarity and cointegration restrictions really necessary for the intertemporal budget constraint? Journal of monetary Economics, 54(7), pp.1837–1847.) framework of sustainability as the baseline model to assess public debt sustainability across the sampled Sub-Sahara African economies. As additional tests of public debt sustainability in order to support the baseline findings, the study also employs panel unit root and timeseries unit tests. The baseline findings from the OLS, panel quantile and instrumental panel quantile regressions show that public debt is sustainable across the panel of SSA economies. The positive and statistically significant response of primary balance under the Bohn's framework of sustainability manifest that the intertemporal budget constraint is not violated in the sampled economies. The consistency in the estimates under the OLS, panel quantile and instrumental panel quantile regressions also show that the estimates are robust throughout the estimation process. Also, utilizing the panel unit root test for public debt sustainability, the findings show that public debt is stationary over the sampled years which implies that intertemporal budget constraint holds and that public debt is sustainable across the sampled SSA economies. However, the timeseries analysis indicate that although majority of the SSA economies have sustainable public debt ratios, four countries namely Uganda, Sudan, Togo and Cote d'Ivoire have unsustainable public debt ratios. The study has important policy implications in terms of prudent public debt management and fiscal management for the sampled SSA economies.

本文对英法大部门政府体制的理论起源、部门构成与演变、部门内外协调机制进行了分析,总结了其成功的经验和实施的制度基础,指出完善的市场经济、成熟的社会自治、政府职能的及时更新、配套改革措施到位是英法大部制成功运作的基础。与此相应,在我国推动相应的改革必须着力强化部门首长的协调与控制能力、围绕职能行使效率设计部门结构、推进相应的综合配套改革。     

外国能源管理机构设置及运行机制研究

能源是人类社会赖以生存和发展的重要物质基础,各国政府对能源管理都高度重视,采取了许多积极有效的措施建立和完善能源管理体制。然而,我国现行的能源管理体制还存在着诸多问题和不足,远远不能适应我国经济社会发展和国际竞争的需要,改革迫在眉睫。因此,应该从我国能源管理的现实出发,积极借鉴国外能源管理的成功做法和经验,建立集中管理、监管分立、法律完备、协调高效的能源管理体制。     

Administrative Justice in the Wake of I,Daniel Blake

This article argues that Ken Loach's film, I, Daniel Blake, invites deep reflection on the relationship between the individual and the state, and, more particularly, on the role of administrative justice in restoring a re‐imagined sense of citizenship. Drawing on earlier debates from the 1950s, as well as on more recent advocacy of the ‘connected society’, the article proposes that to meet such an ambition, administrative justice must be recognised as an overarching set of principles and values, rooted in a framework of human rights and with a reinvigorated public‐sector ombud‐institution at its centre. In this way, administrative justice might serve as an effective and restorative counterweight to more legalistic options for responding to public grievance, whether the result of routine encounters with the state or of a major breakdown in trust, such as that occasioned by ‘Grenfell Tower’.     

Low‐trust bureaucracy: Understanding the Mexican bureaucratic experience

Latin American bureaucracies are notorious for their inefficiency and opacity, yet there is very little empirical research done on what exactly constitutes the “bureaucratic experience” for citizens and what the costs of bureaucratic dysfunction are. To improve our understanding of this topic, 5 cases of Mexican citizens' encounters with public bureaucracies are used to develop the notion of “low‐trust bureaucracy”: public organisations in which access to services is unreliable and the levels of control towards both citizens and bureaucrats are excessive. This bottom‐up analysis of administrative practices contributes to our understanding of the ineffectiveness of government programmes and services, but also of how bureaucracies in developing countries amplify social inequality rather than function as a social equaliser. Furthermore, this article adds new insights to the existing understanding of administrative burdens as a result of either political tactics or mere benign neglect. The data presented here suggest that structural and intractable characteristics of the broader administrative context, such as authoritarian legacies, can produce behavioural patterns that shift bureaucratic attention away from a fair and efficient service provision.

可诉性是指法律行为的可诉性,行政行为的可诉性是指行政主体作出的行政行为在一定条件下可诉诸法院司法审查的一种本质属性,这是判断行政行为的一个根本标准;过去,我国学界对行政行为特性的认识却忽视了这一点。可诉性是贯穿于行政行为与行政诉讼的一条红线,它使公民行政诉权的行使与法院对行政权的司法审查成为可能,具有普遍适用性。
