我国MBA教育存在很多不足。我国MBA教育的改革和发展需要借鉴创新教育的思想,特别在培养方式、教学方法、课程设置和师资与教学评价四个方面需要进行创新设计。     

我国行政行为非强制化走向之述评与前瞻

非强制行政行为是我国行政法学的一个新范畴,由于对其研究处于初始阶段,许多实践误解依然存在,一些重大理论分歧尚未得到充分解决。本文通过对非强制行政行为的内涵、实际运用状况以及理论研究现状的描述与总结,肯定了其在我国存在的历史必然性与合理性,同时针对其尚需完善的问题提出了初步构想。     

中国资本市场的发展趋势及其法律规制

中国的资本市场经过十几年的发展,已经成为中国经济生活中的重要组成部分和中国经济发展的重要推动者。本文在分析了中国资本市场的发展历程、现状及发展趋势后,提出应建立完善的资本市场法律体系;建立合理的监管体制;加强资本市场制度建设与创新等法律规制的措施,以期推动中国资本市场的健康发展。     

寻求“自我”——中国法律思想史的传承与趋向

从中国法律思想史教材的变化来看,自法学在祖国大陆复兴以来,这一学科的成长过程可以划分为创建、探索、发展三期,虽然各期各有不同的特点,但“寻求‘自我’”是其总特征。这一总特征体现在四个方面:明确研究对象;摆脱机械地以“五种社会形态”来设置篇章体例;摆脱以西方法学概念诠释中国古代法的模式;揭示中国法律思想史的发展规律。破译法的文化遗传密码、注重实证研究、重视礼和礼制研究,是中国法律史和中国法律思想史研究中值得关注的趋向。     

Death from Barotrauma Due to Compressed Air: A Medico‐legal Analysis

Lesions of the digestive tract due to barotrauma resulting from compressed air application are not common, are rarely lethal, and largely affect the sigmoid and descending colon. Moreover, their pathogenic mechanism is a topic of discussion because these lesions have multiple characteristics. Here, the authors describe an autoptic case of death from lesions of the ascending and transverse segments, with perforations and bleeding suffusions as well as ischemic areas covered the colonic wall that was extremely thinned, congested, and hemorrhagic, with considerable flattening leading to disappearance of the mucosal folds and with numerous petechial hemorrhages. The pathological framework of lung congestion made it possible to identify the mechanism responsible for this death as depletion of the heart's pumping function, which contributed significantly to the acute respiratory failure due to respiratory distress as well as to reduced mobility of the diaphragm due to intestinal distension. Acute heart failure played an important role in this death.

中国循环农业:特征与发展趋势

与一般农业发展模式相比,循环农业具有资源投入少、能量效率高、物质产出多、环境污染少、系统功能强等诸多优点。我国政府十分重视发展循环农业,2014年中央一号文件明确提出了"建立农业可持续发展长效机制"、"促进生态友好型农业发展"等循环农业的相关内容。作者在对我国循环农业进行考察的基础上,分析了我国循环农业的若干特征,提出了未来我国循环农业的发展趋势,对当前及今后我国循环农业的发展具有参考价值。     

认清历史方位 把握发展趋势 努力完善干部教育培训体系

面对国际国内形势复杂多变,全面深化改革任务艰巨繁重,迫切需要加强和改进干部教育培训。干部教育培训迎来了历史上最好的发展机遇,历史责任更加重大、战略地位更加重要、基础作用更加突出。当前干部教育培训呈现出教育培训需求差异化、教育培训方式多样化、教育培训渠道多元化、教育培训资源社会化、教育培训载体信息化和教育培训管理法制化等趋势和特点。要努力完善干部教育培训体系,就必须更新干部教育培训工作理念,理顺干部教育培训管理体制,优化干部教育培训办学体制,完善干部教育培训运行机制,创新干部教育培训内容和方式,健全干部教育培训法规制度和加强干部教育培训基础建设。     

Quiet Casualties: An Analysis of U Non-Immigrant Status of Undocumented Immigrant Victims of Intimate Partner Violence

Although immigration policy is a key component of public administration scholarship in the United States, research into Intimate Partner Violence (IPV) for both documented and particularly undocumented immigrants has been tangential in focus. This exploratory study questions 1. the effect of immigration reform on U.S. undocumented immigrant women of IPV and

2. how changes in the number of undocumented immigrants affect IPV victimization rates and the regulations concerning U non-immigrant status.

A least-square trend line suggests that the 10,000 U visa applications permitted annually will not cover the undocumented female population of IPV let alone the victims qualified under the U non-immigrant status. Based on a review of the laws and policies regarding the U-Visa we provide several recommendations to reform immigration laws directed toward immigrant victims of IPV. This study adds to the growing, but still weak body of knowledge on abused immigrant female populations in the United States and how federal legislation toward immigration reform and policy will help these women become valuable contributors to our society.
