中国经济学向何处去是本文的中心议题。文章认为,中国经济学是反映中国经济建设和经济改革实践并为之服务的知识体系,既要开展“国民财富的性质和原因的研究”,又要开展“国民财富的增长和办法的研究”;所以,历史上的这两项研究成果,中国经济学都必须批判地继承和发展;任务的特殊性,决定中国经济学的研究对象既不能定位于生产关系,又不能定位于生产力,应当定位于市场的活动主体:研究对象是家庭、企业的生产和交换活动过程及其条件;研究对象的综合性,又要求研究方法的多样性。中国经济学要想不辱使命,必须从市场竞争中的弱势群体的立场上出发,因为这既是经济科学的优良传统,又是中国全面建设小康社会的着力点。  相似文献

The sociology of law appears to be a weak field in the United States, in comparison to other indisciplinary fields of legal study, notably economic analysis of law. Although American legal sociologists have done important empirical work, particularly on the litigation process and on the legal profession, the focus of American sociology of law has been narrow, theoretically limited, and, empirically, limited in both scope and method. These deficiencies may reflect the methodological limitations of Max Weber, the most influential figure in the history of sociology in general and sociology of law in particular. The failure of legal sociologists to borrow theoretical and empirical tools from sociologically minded economists such as Gary Becker is especially regrettable, and may be due to inaccurate perceptions of the political valence of economic analysis of law, sociology's traditional skepticism about the knowledge claims of other disciplines, professional envy, and misunderstanding of the economists' conception of rational choice.  相似文献

法律的经济分析方法的新颖之处就在于经济方法对传统法律方法的替代。法律的经济分析方法与马克思主义的经济分析法虽然研究风格迥异,但在价值观上存在一致性。作为一种强有力的分析工具,经济方法已经对法学、政治学等诸多领域产生了划时代的革命性的影响,具有不可替代的优势。但法律的经济分析方法存在着不足,它不会也不可能完全代替传统的法律方法。法律的经济分析具有广大的包容力和发展潜力。法律的经济分析的发展将可能更注重价值多样化、更关注动态的法律发展过程。  相似文献

This comment deals with criticisms of law and economics analysis as they can be formulated from the point of view of an anthropologist. These criticisms are taken seriously. The author first addresses so-called defects of law and economics analysis which should be considered underdeveloped areas of the approach. Secondly, and more specifically, weaknesses of the property rights approach are taken up. In the author's view, they should be dealt with in future law and economics work. Finally, methodological issues are being addressed which, if not considered with circumspection, could impair the scientific integrity of the law and economics approach.  相似文献

中国金融监管存在显著的制度供给过剩。金融监管制度供给过剩会增加交易成本,不符合效率原则。从法经济学的角度分析,中国金融监管制度供给过剩的原因在于金融监管供给与需求不匹配、权力监管模式下监管机关的粗放型制度供给以及金融监管的行政化。改变金融监管制度供给过剩的状况,应当引入金融监管的成本收益理念和问责机制,将金融监管由权力监管向市场化监管转变,并合理处理金融创新与金融监管的关系。  相似文献

The European Union (EU) has firmly set its stall out to protect individuals' data and privacy and has demonstrated this through the rejection of the old opt-out regime and the introduction of the new opt-in rules. These require businesses to obtain individual's prior and informed consent before their data are collected, stored and used for the purposes of online behavioural advertising (OBA). Individuals in the EU are afforded protection from the apparent dangers relating to data privacy and misuse that is associated with OBA, which is beyond the expectation of most Internet users. However, there are some criticisms levelled at the law that the EU has produced. Is simply gaining informed consent sufficient for protecting all types of information? Do certain types of information require a higher level of consent than others? Does the law fulfil its aim of protecting data subject's privacy and data? Is the current law restrictive to business? Do individuals know or care that their information is being collected for the purposes of targeted advertising and is there a better way to ensure that they do? Finally, will proposed new law to be found in the EU Data Protection Regulation solve any of these problems? This article will assess whether, as a policy decision, the EU's current approach has been too cautious in its attempts to protect individuals or restrict business.  相似文献

大数据时代的到来使得企业、团体、个人都可能获取他人信息,而当代互联网的特性——海量的数据信息、快捷的计算速度以及巨大的储存空间使大数据时代的个人信息保护问题尤为重要。国内外关于删除权的相关法律文本和司法实践已经有较多讨论展开,而从大国博弈、消费者选择和厂商行为三个视角对2019年电子商务法中有关删除权的合理性和前沿性做进一步探讨后,可开启另一认知路径。以法经济学理论和经济学原理进行论证分析后发现,我国需要专门的“个人信息保护法”以确立删除权,而鉴于立法成本和紧迫性,可暂通过完善司法的方式,实现保护公民个人信息的目的。  相似文献

Police officers are afforded a high degree of discretion in the exercise of their authority, and the control of this discretion is an important issue. While it is assumed that individual officer attitudes and preferences shape their discretionary activity, these officers are also members of a paramilitary organization with leaders over them. The present study explored the influence of both officer attitudes and management influences to explain variation in officer domestic violence arrest rates. Hierarchical linear modeling was used with a sample of 311 patrol officers and 61 supervisors from 23 municipal police agencies across multiple states. Unlike much of the previous literature, the results revealed that officer occupational attitudes had no effect on this particular officer work behavior. Management influences (such as rewards and written policies) significantly influenced officers’ domestic violence arrest behavior. The findings emphasize the complexity involved in the control of officer discretion.  相似文献
