实案测试中被测试对象心理状态探析

心理学的研究离不开各种实验,心理测试技术(俗称"测谎"技术)实际上就是心理学实验方法的一种。此项技术在我国的研究应用已经30多年,辅助司法领域进行了大量的实案心理测试①。不仅对陷入侦破困境的案件起到很大作用,也对心理学在实战领域的应用研究提供了一种实验范式。对进行心理测试案件的研究发现,很多的变量都会影响到测试的结果,进而影响测试效度。被测人②的心理状态是其中很重要但是很容易被忽视的因素之一,这是一个非常值得关注研究的领域,不仅关系到心理测试技术的发展,也关系到司法领域人权和司法公正问题。     

大学城的治安问题及其校园案件的对策思考

大学城的治安问题比较严重,有具有敌意的欺凌、体罚、伤害等暴力行为;有寻衅滋事、绑架、恐怖等安全问题;有盗窃、抢劫等刑事案件。这种情况反映了高校在安全防范方面还存在诸多隐患和漏洞:一是大学生防范意识薄弱,给犯罪分子以可乘之机;二是校园人员结构复杂,不法分子混迹其中;三是学校保卫力量薄弱,物防、技防科技含量低;四是学校领导重视不够,缺少快速反应机制。大学城里校园案件的高发已经影响到正常的教学秩序、科研秩序和师生员工的生活秩序,为了维护高校稳定,应当采取有效措施,分析、研究案件的多发原因和规律特点,制定切实可行的预防措施,降低发案率,营造安全、文明的校园环境。     

Finding the missing and unknown: Novel educational approaches to warming up cold cases

In recent years, students in police academies and higher education institutions around the world have worked together to analyse cold cases including long-term missing persons cases in collaboration with investigators and prosecutors. In 2020, three European organisations, the Police Expert Network on Missing Persons (PEN-MP), AMBER Alert Europe and Locate International, succeeded in connecting these educational organisations enabling them to work collectively on cases and conduct cold case analyses (CCA) across international borders. The International Cold Case Analysis Project (ICCAP) learning objectives were to 1) collect the necessary information about the victim, 2) reconstruct the crime, and 3) investigate trace control.In a learning objective-based evaluation using Computer-Assisted Web Interviewing, 76 participating students from the German and International ICCAP teams were asked to complete a pre- and post-review questionnaire to self-assess their personal competence development. Participants reported significant increases in competence in all evaluated areas, thus demonstrating that authentic and relevant collaborations can enrich the learning environment, promote the use of professional skills, and provide significant knowledge exchange opportunities between academia and industry.Drawing on case studies of cold case missing persons' investigations and unidentified found remains, this article shares how university academics, students and community volunteers can work together nationally and internationally to find out what has happened to missing people and how we can more effectively identify the previously unidentified. In so doing, we share the expertise required to progress these cold cases and provide recommendations to support other institutions and organisations in adopting this innovative approach.     

改革开放 40 年来中国企业员工集体离职机制的 典型案例研究

企业员工集体离职对相关组织和员工群体影响深远。本研究从 1978—2021 年中国知网（CNKI） 4 类论文数据库及报纸 1 类新闻数据库中，甄选出我国 102 个企业员工集体离职典型案例。研究发现：集体离 职集中发生在时代的热门行业、朝阳产业，其中制造业、IT 业的集体离职始终处于焦点；集体离职的主要原 因是个体自身因素、企业内部因素以及二者互动因素；集体离职的直接原因同样主要在内因，成为集体离职的 “导火索”或“催化剂”。研究提炼出企业员工集体离职影响因素和作用机制模型、企业员工集体离职主要原 因和直接原因作用模型。基于此，研究建议：预防集体离职需整体上更加关注企业的内部管理，化解集体离职 需避免主要原因的积累，缓解集体离职还需注意直接原因的作用。     

参与式发展的迷思——云南省三个少数民族社区项目的个案研究

参与式是发展理论中新近被承认的正统理论,通过对云南三个少数民族社区项目的个案研究,揭示参与式概念泛化所导致的参与式发展的重重迷思,文章认为不应把参与式发展与国家干预对立起来,外部环境的改善为社区参与式发展提供有力保证。     

An Investigation into Whether or Not the Class and Individual Characteristics of Five Turkish Manufactured Pistols Change During Extensive Firing

Abstract:  In order to assess whether or not the class and individual characteristics of a firearm change over time, five different makes of Turkish self-loading pistol were tested and were each fired a large number of times. The class and individual characteristics were identified for each pistol and the first fired cartridge case was compared with the subsequent consecutive 250th fired cases for each pistol. It was found that there were slight changes in some of the individual and class characteristics; however, this was not statistically significant and did not affect the ability of the firearms examiner to match the first fired case to the last fired case for each firearm tested.     

国家法难行之源：国家主义抑或人本主义——从“依法收贷案”切入

以前有关“依法收贷案”的研究文章都认为这里的“法”就是“现行国家法”,但对此案细致分析发现并非如此,而是“王法”即中国传统法。中国国家法自古至今有一种严重的国家主义倾向（而今表现为一种现代化倾向）,缺乏一种现代法律所需要的人本主义精神因素,因此,国家法只得到了国家外部力量的推动,缺乏内部力量的驱动,其社会化动力不足。其社会化程度远低于中国传统的“法”与“德”,最终被“王法”置换,为中国传统的“德”所打败。     

石油公司应该对船舶油污损害负责吗?——评欧盟法院对Erika轮油污案的裁决

从2008年6月欧盟法院就法国最高法院向其"请示"的Erika轮油污案之裁决入手,分析油污民事责任公约的立法背景,指出在民事责任公约的体系之下承担污染损害责任的应该是船东,而不应向作为货方的石油公司进行索赔。欧盟法院所认定的石油公司可被视为欧盟废弃物相关法律之下的废弃物制造者,以及石油公司可能需要就因船舶溢油事故导致的海域石油污染损害负责之观点与现行的油污民事责任公约相悖。     

刑事诉讼事实研究

“以事实为根据,以法律为准绳”是我国刑事诉讼法的基本原则,也是我国的一项法制原则。什么叫事实？传统理论和司法实践一般将其理解为案件本身的客观事实,随着程序正义观念的加强,在现实的刑事诉讼中,不仅案件事实,而且程序事实、证据本身真伪性的事实,也纳入了证明范围。因此,刑事诉讼中的事实,应当包括在诉讼中具体体现的案件事实、程序事实和证据事实,并在事实推理的基础上,达到作为审判结果的法律事实。
