《新时代公民道德建设实施纲要》的新义解读－－基于两个《纲要》比较的研究

《新时代公民道德建设实施纲要》立足于中国特色社会主义新时代的历史背景,阐释了公民道德建设的诸多新义：结合中国特色社会主义新时代的社会转型背景阐释了当代中国公民道德建设的新形势下,实现中华优秀传统道德文化的创新性现代转化开掘其世界意义的文化使命;在公民道德建设的内容方面,阐明了个人品德作为公民道德建设第四个着力点的必要性及个人品德建设中的实践问题;在实践举措方面,提出了全学科、全过程、全阵地的道德教育理念;阐明了社会新媒介化态势下公民道德建设的新任务;加强网络空间道德建设与道德领域热点问题的引导。在公共政策的设计、制定和实施执行方面,明确了公共政策的道德要求,提出了加强对公共政策道德风险与道德效果评估的新要求。     

Interpretation of New Meaning in the Guidelines for Citizen Morality Construction in the New Era——A Comparative Study Based on Two Guidelines

In the new era of socialism with Chinese characteristics, the Guidelines for citizen’s Morality Construction in the new era embodies many new meanings of the construction of citizen's morality: Combined with the background of social transformation in the New Era of Socialism with Chinese Characteristics, this new guidelines expounds expounds the cultural mission of the innovative modern transformation of Chinese excellent traditional moral culture and excavating its world significance under the new situation of contemporary Chinese citizens' morality construction; In terms of the content of citizens' morality construction, the new guidelines establishes the necessity of personal character as the fourth focus of the construction of citizen's morality. In terms of practical measures, the new guidelines put forward the idea of moral education of the whole subject, the whole process and the whole position. The new guidelines also expounds the new task of citizen's morality construction in a new medianization society: strengthening the guidance of the moral construction in cyberspace and the hot issues in the moral field.In the design, formulation and implementation of public policies, the moral requirements are clarified, and the evaluation of moral risks and moral effects is proposed.     

Writing women on the verge of individuality … Citizen subject,consumption and power in the nineteenth-century Swedish novel

ABSTRACT

Three letter-writing nineteenth-century heroines lay out domestic worlds to their fictional readers in which moral sentiment and norms of citizenship versus individual desire are at stake. In an era of nascent capitalism and nation building, these are aspects of significance. But what role does writing letters play? And what impact do epistolary novels have on citizenship and gender at the time? With Michel Foucault and Étienne Balibar as theoretical framework, this article discusses three epistolary novels—The Illusions (1836) by Sophie von Knorring in connection to Grannarne (1837) by Fredrika Bremer and Araminta May (1838) by Carl Jonas Love Almqvist—in order to discern how female writing produces the gendered citizen.     

探析深圳新生代农民工市民化过程中的公民意识教育

新生代农民工的公民意识教育既是深圳加快建设公民社会和法治社会的重要推动力,也是新生代农民工实现自身事业发展的需要,其主要内容是主体意识教育、权利义务意识教育、公德意识和规则意识的教育,可由一个以政府为主导、企业为主体、社会力量为补充的上下贯通、配套联动的教育培训体系来实现。     

Conducted Energy Devices (CEDs) and Citizen Injuries: The Shocking Empirical Reality

As one of the contemporary additions to the use of force spectrum, conducted energy devices (CEDs) have been surrounded by controversy. Such concerns have fueled a number of studies, many of which have attempted to examine the relationship between CEDs and citizen injuries. This limited body of research, however, has produced inconsistent results and suffers from a number of documented drawbacks. Drawing on data collected as part of a national multi‐agency use of force project, the current study analyzes nearly 14,000 use‐of‐force incidents across seven agencies, over 2,600 of which involve a CED, to assess the potential impact of CEDs on citizen injuries. In doing so, a series of multivariate statistical models are employed that isolate CED cases and compare them to a number of both hands‐on and weapon‐based tactics. Unlike previous research, which often highlights the beneficial aspects of CEDs in relation to injuries, our findings generally show an increased risk between the use of CEDs and citizen injuries. As such, more research is needed before deriving any conclusions as to the “safeness” of CEDs, especially in relation to the choice between using a CED or an alternative means of dispute resolution (either hands‐on physical force or another weapon).     

Clarifying the Effects of Neighborhood Context on Violence “Behind Closed Doors”

Research on neighborhood-level effects on intimate partner violence (IPV) has expanded significantly in the past two decades. However, to date, studies have been unable to disentangle compositional and contextual effects on IPV and have rarely considered the social mechanisms that might link neighborhood conditions to IPV. Using data from the Project on Human Development in Chicago Neighborhoods, this study considers individual and contextual influences on violence between partners, and examines the effects of disadvantage and collective efficacy on this type of behavior. Results indicate that neighborhood disadvantage significantly increases and collective efficacy significantly decreases IPV after controlling for individual-level correlates. Our findings add to a growing body of evidence suggesting that as with street crime, neighborhood disadvantage also exacerbates rates of IPV. However, unlike street crime, the impact of disadvantage on IPV does not appear to be mediated by collective efficacy. Understanding how collective efficacy affects violence between partners remains an open issue.     

环境犯罪法益之研究

环境犯罪,是在新形势下频发的一种犯罪形式,也是经济社会发展到一定阶段的产物。关于该种犯罪,各国都在其法律中规定了打击方式和杜绝形式,我国也在1997年《刑法》第六章中规定了相关罪名。但是,这还不能完全适应科学发展观大背景下我国环境保护与资源节约的现实,这就需要从理论角度对完善环境刑事法规提供借鉴。目前,学者们对该类犯罪的范围、主体、责任等研究较多,但对其客体,即法益研究较少且成果不一,文章就此展开论述,并提出环境犯罪的法益为国家的生态安全权和公民的生态安全权,为完善环境刑事犯罪体系提供立法思路。
