诉讼视野下侦查模式的思考

受诉讼模式的影响,不同的诉讼模式下有着不同的侦查模式。通过对两大法系下不同的侦查模式的特点进行比较和分析,进而对我国的侦查模式的特点进行论述,从而分析我国侦查模式的缺点并提出完善我国侦查模式的构想。     

Forensic Identification of Seal Oils Using Lipid Profiles and Statistical Models

Seal blubber oils are used as a source of omega‐3 polyunsaturated fatty acids in Canada but prohibited in the United States and (FA) European Union. Thus, a reliable method is needed to identify oils originating from seals versus fish. Two lipid profiling methods, fatty acid analysis using gas chromatography and triacylglycerol (TAG) analysis using liquid chromatography and mass spectrometry, were applied with statistical models to discriminate commercial oils and blubber samples harvested from marine fish and seals. Significant differences were observed among FA profiles, and seal samples differed from each of the fish oils (p ≤ 0.001). FA and TAG profiles were used to discriminate sample groups using a random forest classifier; all samples were classified correctly as seals versus fish using both methods. We propose a two‐step method for the accurate identification of seal oils, with preliminary identification based on FA profile analysis and confirmation with TAG profiles.     

CONFLICT AND CO‐PARENTING: THE CONSTRUCTS OF NONRESIDENT FATHERS*

Scots law constructs a co‐parental role for nonresident fathers without clarifying how this should operate in practice. Personal Construct Theory (PCT) offers a useful approach to understanding such fathers’ distinct and changing conceptions of their role. Findings are presented from a study of 17 nonresident Scottish fathers maintaining contact with nonresident children. Idiographic analysis of data from repertory grid interviews administered three times over the course of a year shows that participants perceive family situations in terms of paternal involvement, impact, emotion, or antagonism. Changes in construing following family events support the PCT understanding of hostility; implications for family services are discussed.     

论中国《合同法》的罗马法基础——兼论以罗马法作为未来亚洲模范合同法基础的可能性

中日韩三国同属于德国法族,通过德国的中介继受了罗马合同法的8个规定,分别关涉买卖与互易的区分、定金规则、所有权移转时间与价金交付时间挂钩、无偿保管人承担标的物灭失责任的条件、债权人对诈害行为的撤销权、债的履行中的诚信原则、混同导致债消灭、不可抗力导致免责。它们构成三国法律中共同的罗马法基础。在建立东北亚共同体的框架内,产生了制定《亚洲合同法原则》的动议,上述8个规定可作为此等原则的内容。     

矿产资源立法的私权化进路分析

整体看来，我国的矿产资源法体系是一个包括行政法、民法和刑法规范的复合体，透射出的主要是公法色彩，无法满足市场经济条件下社会经济对矿产资源开发利用的要求。为此，矿产资源立法中的私权化和矿权的市场化进路不失为求解之道。如果能走得更远，则制定系统的《矿权法》亦未尝不可。

Improving Federalism: Drivers of Change,Repair Options and Reform Scenarios

The Academy of Social Sciences in Australia (ASSA) and the Institute of Public Administration Australia (IPAA) hosted a ‘Policy Roundtable on Federalism’ on the 17–18 May 2007 at the University of Canberra. Around 50 attended the roundtable comprising politicians, Commonwealth and state public servants, and academics. The roundtable was provided with a number of background papers including the Hollander‐Patapan article and another produced by staff of the Commonwealth Grants Commission entitled ‘Trends in Commonwealth‐State Financial Relations: a Grants Commission Perspective’. The roundtable focused not only on issues and challenges but, more practically, on options and how to make federalism work better.
