政府信息公开与行政诉讼

《政府信息公开条例》第一次明确规定了公民知情权的行政救济途径。政府信息公开的范围涉及行政诉讼的类型以及法院的受案范围。政府信息公开行政诉讼中的当事人、举证责任和诉讼程序都因不同的行政诉讼类型而有显著区别。政府信息公开行政诉讼最关键的问题是法院对于国家机密的审查,政府信息是否国家秘密必须经过有权机关的确认,不能仅仅以属于国家秘密的空洞理由而不予公开。对于因政府信息公开遭受损失的当事人,应当给予国家赔偿。     

重组改制条件下国有企业职工民主管理工作思考

重组改制条件下,国有企业职工民主管理工作遇到了许多新情况:民主管理制度需要完善、职工主人翁地位程度被削弱、职工代表参政议政的能力有待进一步提高,等等。造成这种状况的原因是多方面的。改善职工民主管理工作的主要措施有:增强职工主体意识;激发基层民主管理活力;完善民主管理制度与机制。     

试析黔东南苗族服饰的文化特征

对于苗族服饰的研究,论著颇丰,但研究者多以服装或饰品分列立足点论之,鲜有总论苗族服饰的文化特征。本文以苗族聚居地——黔东南的苗族服饰作为分析的立足点,对苗族服饰的文化特征进行了阐释,力图勾画出黔东南苗族服饰的文化特征,以丰富苗族服饰的文化研究。     

国家保护责任理论论析

国家保护责任理论以个人的主权观与安全观为核心,提出了国家与国际社会向处在危险中的人民提供生命支持保护及援助的预防责任、做出反应责任以及重建责任。国家保护责任理论是对传统的主权、安全观的重新阐释,同时也对安理会的作用进行了扩张解释。我们必须警惕国家保护责任理论以所谓普世的西方价值观来对另一个国家实施预防、反应以及重建的责任,如果不对相关的干涉行为设定必要的限制,必然会是对他国赤裸裸的干涉。     

A Multi-mediation Model on the Relations of Bullying,Victimization, Identity,and Family with Adolescent Depressive Symptoms

This study investigated a multi-mediation model of the relationship between bullying behavior, peer victimization, personal identity, and family characteristics to adolescent depressive symptoms in 194 high school students, 12–18 years of age. In the first model, peer victimization mediated the relation between bullying behavior and depressive symptoms. In the second model, personal identity mediated the relation between peer victimization and depressive symptoms. In the final model, the two mediation models were combined. The relative influence of family characteristics on all variables in the two mediation models was studied using structural equation modeling. The results supported both mediation models and confirmed the influence of family characteristics on all variables in the mediation models. This study indicates that victimization by one’s peers has consequences for adolescents’ psychological health when their personal identity is affected. In addition, the study was able to model several processes in which family characteristics were related to adolescent depressive symptoms. Moreover, the final combined model (in which the two mediation models and the influence of family characteristics on all variables were confirmed) explained half of the variance in adolescent depressive symptoms.

二战后,迫于国际国内大背景的压力,东南亚大多数华侨不得不自身调整,开始了自身身份认同的激烈变化。这主要体现在民族(当地)认同、文化认同与族群认同等方面。其中,民族(当地)认同是二战后东南亚华侨华人认同的最根本变化。     

论国有控股企业激励监控机制及其改进

国有企业股份制改造后存在的主要问题可归结于在公司治理结构方面存在着重大缺陷。包装式的股份制改革不可能解决存在于公司治理结构间的根本问题。公司治理的核心是建立并完善激励监控机制。由于公司各相关利益主体的制约,造成国有企业股份制改造后公司治理中存在不少问题,要结合国有企业实际,完善股份制企业治理结构。     

The Attlee government and welfare state reforms in post-war Italian Socialism (1945–51): Between universalism and class policies

The purpose of this article is to analyse how the Italian socialist movement viewed the social reforms of the Attlee Labour government introduced just after the Second World War. The intention is to study the extent and limits of the labour influence on Italian socialism. The Labour Party made the re-founding of a new interclass social pact, a universal matter intending to meet the needs of both the working and middle classes. The Italian socialist movement monitored the Labour government’s changes with interest, assessing them from two different perspectives. The reformist wing had a better grasp of the political–ideological implications of Labour’s approach to the welfare state. Vice versa, the majority of the Italian socialists pursued a class socialism and a strong alliance with the Communist Party, rejecting the Labour social policy model. After the split of 1947, however, the two views of Italian socialism failed to develop and implement a political programme for a welfare state based on the British universalistic tendency model. The political weaknesses of Italian socialist organizations in the field of social policy contributed to the characterization of the Italian welfare state in the post-war period and fundamentally delayed its universalistic implementation, at least until the 1960s.     

Jewish joke telling in Muttersprache Mameloschn: performing queer intervention on the German stage

This essay explores the central role of Jewish joke telling in Sasha Marianna Salzmann’s play Muttersprache Mameloschn (first performed in 2012). Subversively revealing the problematic of essentializing cultural, national, and even sexual identity, Jewish joke telling figures as a performance of social and political resistance and disidentification in this play. Engaging with Jack Halberstam’s queer epistemology of failure and José Esteban Muñoz’s theory of queer disidentification, I propose that the act of Jewish joke telling by a young lesbian plays out as a new queer project of intervention in this play that confronts both antisemitism and culturally positioned sexual hegemony.     

Drag queens and gender identity

Heteronormativity within our society has a significant impact on how we come to view and understand gender identity. Drag queens allow a break in the heteronormative gender guideline while also reinforcing the social image of what it means to look like a woman. Although drag queens merely reflect the preexisting image of a woman, they still present an image of both gender bending and the ways that gender is socially taught. This ethnographic research explores how gender and sex identity is socially taught in the public and private space. Ultimately, gender identity is socially influenced when determining our social identities based on social influence. My personal experience in deconstructing my own gender identity has allowed me to explore my social self-identity and how powerful our social heteronromative gender guidelines are. By dressing in male clothing for the first time in a public space, I challenged the daily heteronormative idea of gender while shattering my own self-identity. The gender constructions and guidelines that were socially taught to me throughout my life were broken when I put on a fake beard.
