社区矫芷十周年“回顾与展望”研讨会综述

社区矫正十周年“回顾与展望”研讨会，围绕“中国社区矫正特色与改革创新”、“社区矫正的性质任务、机构设置和队伍建设”、“社区矫正中的其他重要问题探讨”三个方面，进行了观点争鸣、思辨分析和定性定量的实证研究。全国人大法工委的代表从国家法治建设的高度介绍了社区矫正立法涉及的主要问题。     

社区矫正的中国传统元素——和合文化在轻刑执行中的缺失与补正

任何制度都是民族历史传统的自然言说，法律制度也不例外。当今世界三种模式的社区矫正都与各自民族特色紧密相连，而我国社区矫正制度则较多地体现了共性而忽略了民族特性。作为中华民族最．-j-~贵的精神财富之一，和合文化理应且能够在我国社区矫正的制度构建中被浓墨重彩。     

基于无缝隙政府的社区警务战略研究

无缝隙政府理论是以满足顾客无缝隙的需要为目标,以顾客、竞争和结果为导向,是一种为顾客提供无缝隙的公共产品和公共服务的方式。社区警务战略正是无缝隙政府理论在我国的有效实现形式之一。该战略以预防及合作为其基本内涵,要求警力深入社区,以社区为导向开展工作;强调以社区民警为主的各警种与社会化力量之间的互动。但在执行中,社区警务战略还存在种种问题。应按照无缝隙政府理论的要求,对社区警务战略作进一步的完善。     

对公安院校警务化管理的几点思考

警务化管理是公安院校区别于普通院校进行管理的一种方式,在公安院校的进程中起到了重要作用,但其发展至今也存在着重管理、轻教育,重共性、轻个性以及部分学生管理干部素质不高等问题。该文首先论述了警务化管理的必要性,并针对其存在的一些问题提出了统一警务化管理的指导思想、处理好警务化管理中共性与学生个性发展的关系以及切实加强学生管理干部队伍建设的对策建议,以期对公安院校警务化管理有所裨益。     

The Good Companions and Community Building

Although Ina Habermann, a Swiss scholar, has drawn attention to the fact that The Good Companions preserves the tradition of condition of England, she has failed to point out the inner relationship between the tradition and the symbolic forms of the novel. It is “The Good Companions” the troupe, together with the way it operates (including its theatrical performance), rather than “music hall entertainment” as argued by Ina, that is the crucial symbol of community life in The Good Companions. It is true that Ina’s “music hall entertainment” symbolizes community life but the image of “The Good Companions” not only reveals the breadth of community life indicating a way of life beyond the category of theatrical performances, but also sheds light on the depth of community life by suggesting the spirit of community and the ways of work in which community is rooted.     

非传统安全背景下反恐警务的构建

随着经济社会的迅猛发展,新情况、新问题层出不穷,非传统安全也应运而生。恐怖主义作为非传统安全中的重要内容,从产生之初就成为危害世界安全的一个毒瘤。传统的安全警务模式相对滞后,容易造成警务活动的被动,难以有效地控制、处置恐怖主义犯罪。为此,要努力建立新型的反恐警务,以适应非传统安全下的安全需求。     

Where are all the victims?

Research Summary The passage of new laws that criminalize the trafficking of persons for labor and sexual services has raised public awareness about the problem of human trafficking. In response, police must understand the problem, identify human trafficking victims, and make arrests. The numbers of victims identified to date, however, has paled in comparison with official estimates, which leads some to question the existence of a human trafficking problem. Missing from this debate is information about how frequently police encounter human trafficking and how well prepared officers are to handle these cases. Analyzing survey responses from a national sample of police agencies in the United States, we found that less than 10% of police agencies identified human trafficking cases from 2000 to 2006. Larger agencies were more likely to identify cases of human trafficking but the agency leader perception about the problem in their local communities as well as taking steps to prepare officers to identify and respond were the most important factors to increasing human trafficking identification by police. Policy Implications This study provides much needed information about why U.S. officials have identified so few human trafficking victims. By understanding how often and under what conditions police find, investigate, and prosecute cases of human trafficking we will be in a better position to identify and overcome barriers to police responses to trafficking and understand the limitations of official statistics about human trafficking. Data from a national survey also provide a baseline measure of police identification of human trafficking against which we can gauge the progress of future anti-trafficking efforts.     

北京城市社区媒体的发展现状及居民期待调查

针对北京城市社区媒体的状况,课题组从居民和居委会两个层面,对六个典型社区进行了调查。发现居民普遍对社区媒体概念陌生,缺乏热情和关注,但社区居民的群体结构及角色认同,居民之间缺乏日常交流的现状,以及获取新闻信息主渠道的变化等,都在客观上要求社区媒体的存在和发展。社区媒体的优势是服务性强,需要关注的主要问题是教育问题、养老问题和健康问题。多数居民仍期待街道社区成为媒体的主办方,但目前居委会工作人员的能力结构难以适应媒体建设的需要。     

Institutionalization of a Human Community with a Shared Future and Principles of International Law

The doctrine of building “a human community with a shared future” (HCSF) is a Chinese diplomatic strategy in the new era moving closer to the center of global affairs. It includes enriched ideas about international law and the essential elements of institutionalization. The emergence and development of modern international law have revealed the critical importance of the ideas about international law as guidance for institutions. It is necessary and possible to institutionalize the HCSF by setting its ideas as principles of international law. The principles of international law for the HCSF are those of durable peace, universal security, common prosperity, coexistence of different civilizations, and sustainable development. The new five principles of the HCSF are integrated with the existing general principles of international law and Chinese proposals for the new era, which is not only the development of Chinese-initiated Five Principles of Peaceful Coexistence but also a new contribution to the contemporary international law. It will be the new guidance to advance the profound changes of international relations unseen in a century for the common interest of mankind.
