《人民法院诉讼收费办法》第十七条规定的内容存在母法废止、违法不究、责任他负的弊端,容易导致滥用上诉权、诉讼费流失,可能违反当事人平等原则,应当在重新制定“诉讼收费(办)法”时予以修改。

The Calculus of Voting in Compulsory Voting Systems

Compulsory voting laws have consistently been demonstrated to boost electoral participation. Despite the widespread presence of compulsory voting and the significant impact these laws appear to have on voting behavior, surprisingly little effort has been devoted to analyzing how mandatory voting alters the decision-making calculus of individual voters in these systems. Moreover, studies that investigate the influence of compulsory voting laws on electoral participation generally treat these policies monolithically, with scant attention to the nuances that differentiate mandatory voting laws across systems and to their consequences for voting rates. Analyses that explicitly and empirically examine the effects of penalties and enforcement are surprisingly rare. This study aims to fill that void by adapting rational choice models of participation in elections for compulsory voting systems. I find that the level of penalties countries impose for non-compliance and the degree of penalty enforcement impact turnout rates. Voters in mandatory voting systems abstain least when both the penalties and the likelihood of enforcement are high, and abstain most when both meaningless.

改革的过程必然是一个利益重新分配的过程,随着中国改革开放的不断深入,不同的利益集团不断分化,并出现了两极分化的趋势。这一趋势应引起我们的高度关注和足够重视。因为,严重的利益失衡将使处于转型期的社会面临高风险,并有可能最终导致改革失败。     

Transaction costs in electoral coordination: How turnout shapes changes in the number of parties*

This article examines the forces shaping changes in the number of parties between consecutive elections. We argue that the transaction costs in electoral coordination depend on the turnout level in the previous election. The greater the number of peripheral voters entering the electorate, the less likely a substantial change in the distribution of partisan support in the subsequent election. The argument is tested using data for 313 parliamentary elections in 63 countries from 1990 to 2011, and two cases studies of countries using compulsory voting (the Netherlands and Australia).     

我国政府采购成本及其控制分析

政府采购是政府部门一项重要的经济活动,不仅与政府自身运作休戚相关,而且对社会经济发展也将产生重大影响。本文所指的政府采购是狭义的政府采购,采购成本包括直接的费用支出及交易成本两个方面。目前,我国的政府采购在直接的费用支出上,规模偏小,结构不尽合理;在交易费用上,由于执行机构、中介机构及供应商行为存在不规范之处,致使其存在偏高隐患。为此,需要健全政府采购法律体系,完善其机构设置,提高采购人员的专业素质及合理地扩大政府采购规模及范围。     

EVOLVING TOWARD NORMALCY AMID ANOMALY: NORTH KOREA’S MIDDLE EAST POLICY SINCE THE DEMISE OF KIM IL-SUNG

North Korea's engagement in the Middle East is a six-decade long narrative. Neither the DPRK nor its Middle Eastern partners have remained still over this time; each region has undergone significant changes. In particular, the leadership of the North Korea is now in the hands of the third generation. No matter how stagnant and monolithic the country may seem at first sight, each generation has had to deal with differing commitments and adapt to changing realities. As such, each generational change of leadership in Pyongyang has arguably had repercussions on the DPRK's relationship Middle Eastern partners, which may at times have been misattributed to a fundamental change of approach. This study attempts, therefore, to probe the twists and turns in the DPRK's interactions with the Middle East since the death of Kim Il-sung, beginning with an appraisal of each leaderships’ priorities in North Korea, and how they could potentially influence Pyongyang's overall orientation toward its different partners in the region.
