Many studies reveal strong interrater agreement for Hare's Psychopathy Checklist-Revised (PCL-R) when used by trained raters in research contexts. However, no systematic research has examined agreement between PCL-R scores from independent clinicians who are retained by opposing sides in adversarial legal proceedings. We reviewed all 43 sexual-offender civil-commitment trials in one state and identified 23 cases in which opposing evaluators reported PCL-R total scores for the same individual. Differences between scores from opposing evaluators were usually in a direction that supported the party who retained their services. These score differences were greater in size than would be expected based on the instrument's standard error of measurement or the rater agreement values reported in previous PCL-R research. The intraclass correlation for absolute agreement for the PCL-R Total score from a single rater (ICC 1,A = .39) was well below levels of agreement observed for the PCL-R in research contexts, and below published test-retest values for the PCL-R. Results raise concerns about the potential for a forensic evaluator's "partisan allegiance" to influence PCL-R scores in adversarial proceedings.  相似文献

The Kansas v. Hendricks (1997) decision, in which the Supreme Court authorized post-sentence civil commitment for certain sex offenders, appeared to be constitutionally legitimized by limiting the class of offenders eligible for this special form of civil commitment to those who are "unable to control" their dangerousness. Nowhere in the available record, however, did the Court elucidate what they meant by this notion of volitional impairment. This study sought to examine factors that legal professionals (n=43), psychologists (n=40), and mock jurors (n=76) deem most relevant to a determination of sex offender volitional impairment. Participants, who were randomly assigned to a sexual predator commitment or an insanity hearing context, read a series of 16 vignettes that described a pedophilic offender and included combinations of variables hypothesized to be related to judgments of volitional impairment. Results suggested that participants, who as a group made remarkably high estimates of likelihood of future sexual violence, considered verbalization of control, history of sexual violence, and the context of the hearing as highly relevant to determinations of volitional impairment. Implications for policy and practice are explored.  相似文献

Four identity dimensions (Commitment Making, Identification with Commitment, Exploration in Depth, and Exploration in Breadth) were used to derive identity statuses by means of cluster analysis in a sample of late adolescents. This strategy resulted in both a qualitative refinement and a quantitative extension of Marcia's (1966) model. Five clusters were retained. Four of those (the Achievement, Moratorium, Foreclosure, and Diffused Diffusion Cluster) bore a striking resemblance to Marcia's original identity statuses in terms of their definition and their associations with criterion variables. Adolescents in the fifth cluster, the Carefree Diffusion Cluster (low to moderate on both commitment dimensions and low on both exploration dimensions), scored as high as the 2 high Commitment Making clusters (i.e., the Achievement and Foreclosure Cluster) on several indicators of adjustment. Personality characteristics further differentiated these clusters in accordance with theory. The advantages of expanding the identity status paradigm, through additional distinctions that pertain to both commitment and exploration, are discussed and practical implications are outlined. 行为人产生出卖目的的时间对于收买被拐卖妇女、儿童罪转化犯的认定具有重要作用.刑法对本罪除罪事由的规定具有合理性,同时,基于收买对象是妇女还是儿童的差异,对本罪除罪事由也应作不同理解.被害人承诺在符合一定条件的情况下,可以免除收买人的刑事责任.在罪数形态上,收买者同时实施了教唆、帮助拐卖行为的,构成牵连犯,应从一重处断;在构成本罪转化犯的情况下,行为人又实施了非法拘禁、虐待、强奸等行为的,不能实行数罪并罚,应以拐卖妇女、儿童罪一罪论处.  相似文献

With the widespread and continuing adoption of managerialism in the public sector, ignoring the impact of change on employees could prevent managerialism from achieving its goals. Subsequently, this study investigates the efficacy of an augmented demand-control-support (D-C-S) model in predicting three of the key employee outcomes in the context of organizational change—psychological health, job satisfaction, and organizational commitment. Analyses of a survey of 207 employees in the Australian public sector, a sector that has undergone, and continues to undergo, substantial change toward managerialism, found that the augmented D-C-S model explained a significant proportion of the employee outcomes in the public sector context. The most important variables were work-based social support and job control. Coping style and perceptions of work conditions, such as pay, were also significant. The augmented D-C-S model provides a useful, proven tool for managers operating within the contemporary public sector.  相似文献

Supervisory bodies can intervene in organizational practices that may harm society, but their effectiveness to do so depends on their ability to make decisions reflectively and decisively. Are these tendencies incompatible with each other or can they go together? Can empowering leadership (i.e. participative, coaching, informing behaviors) stimulate reflectiveness and decisiveness? A 10-item Joint Decision-Making Questionnaire was developed and tested among supervisory officers (N = 87) and supervisory board members (N = 158). Reflectiveness and decisiveness were positively correlated, indicating that these tendencies can be reconciled in joint decision-making (Study 1). An examination of 44 supervisory teams further revealed that participative leadership relates to more reflectiveness and decisiveness, via cooperative trust and goal commitment (Study 2). Moreover, teams that experienced this team climate prior to COVID-19 reported that they acted more reflectively and decisively during this crisis (Study 3). Hence, participative leaders can foster reflectiveness and decisiveness, by promoting cooperative trust and goal commitment.  相似文献
