我国反垄断法实施制度问题思考

本文对《反垄断法》实施制度的选择及其利弊进行了分析,认为需要在既有规则之下调整有关部门职权,使反垄断权力相对集中于综合性执法机关;同时,也探讨了反垄断执法机构与行业主管部门或监管机构的关系问题,认为两者在反垄断方面既应有分工,又应有合作;此外,作者还强调发挥反垄断执法机构在制止滥用行政权力排除、限制竞争中的作用。     

论公诉案卷移送制度

公诉是连接侦查和审判程序的枢纽,对侦查权和审判权的行使起着重要的作用。案卷移送是我国公诉案件中的一个环节,涉及庭审的实质化、审判中心主义、审判权与检察权的关系等多个方面,是一个复杂的问题。审判方式改革决定了移送案件材料的数量和时间,反过来移送材料的数量和时间又会直接影响到审判方式改革的力度甚至成败。因此,案卷移送制度的研究具有重大的现实意义。     

女子院校女性学学科建设回顾

高校的女性学学科建设尚处于起步阶段,女子院校的女性学建设担负着重要的使命,在学科建制与学科内在规范的建立方面均有了一定的发展,学术合法化日益受到重视,从国家政策及教育机构的支持角度看,其社会合法化正逐步提高,系所、专业及学科的设立使得其行政合法化也有了实质的推进,但在政策投入力度、学理探讨、机制深化、学科课程设置以及跨校合作等方面亟待解决的问题还很多。     

Embedding the Notion of Child- and Family-Centered Care into Organizational Practice: Learning from Organizational Visioning

Child- and family-centered care has permeated the practices of child welfare as a means to address fragmentation. Case management appears promising, but the approach is still in its infancy. This article aims to provides an understanding of the emergent organizational vision of a new approach to case management at multiple organizational levels. The authors conducted a case study on the implementation of Intensive Family Case Management in a Dutch organization that provides child and youth protection services. The focus is on the continuous and bottom-up process of visioning, which has helped to define the shared organizational vision. The key finding was an emerging, widely shared vision that is congruent at many organizational levels and that contrasts starkly with the old work approach. The conclusion is that innovative child- and family-centered approaches to case management are inherent to a multi-level organizational system that is consistent with the approaches it advocates, being embedded in organizational structures and embodied in practitioners’ mindsets.     

Case study: From embedded system analysis to embedded system based investigator tools

Since mid-2012, France and Germany have had to deal with a new form of payment card skimming. This fraud consists of adding a wireless embedded system into a point-of-sale payment terminal with the fraudulent goal of collecting payment card data and personal identification numbers (PIN).This case study details the strategy adopted to conduct the digital forensic examination of these skimmers. Advanced technologies and analyses were necessary to reveal the skimmed data and provide useful information to investigators for their cross-case analysis.To go further than a typical digital forensic examination, developments based on embedded systems were made to help investigators find compromised payment terminals and identify criminals.Finally, this case study provides possible reactive and proactive new roles for forensic experts in combating payment card fraud.     

关于反腐倡廉体制机制建设若干问题的新思考

反腐倡廉建设必须建立健全一套有效的制约和监督权力的体制机制,这是破解腐败高发、多发的基本途径。只有组建一个由预防腐败署、纪检监察机关、司法机关构成的预防与惩治腐败完整体系,才能充分发挥结构科学、运行规范、监督有效的功能,形成一个能够保证各职能机关各负其责、相对独立、依法治理的运行方式。完善干部重大事项报告制度、巡视制度和"一案双查"等制度,逐步形成不敢腐的惩戒机制、不能腐的防范机制、不易腐的保障机制,才能有效遏制腐败。同时把构建决策科学、执行坚决、监督有力的权力运行体系,作为关住权力的制度笼子。这是我们党实现依法治国的国家战略和顶层设计的新思考,是跳出历史周期律支配的新路径。     

国外可再生能源发展政策与法律制度考察及经验教训

面对气候变化和能源安全的压力,可再生能源是世界各国最具现实性的选择。特别是在能源市场全球化背景下,可再生能源发展政策与法律制度的趋同化为我国学习和借鉴国外成功经验奠定了现实基础。考察欧盟、英国和澳大利亚可再生能源发展的政策与法律制度,提炼出值得我国借鉴的有价值经验,并且总结出我国应当避免的相关教训,对于今后我国可再生能源发展政策与法律制度的构建与完善都具有参考价值。     

Mental Health Treatment Experiences and Expectations in Foster Care: A Qualitative Investigation

This study explores perspectives on mental health treatment experiences and expectations for youth in foster care and their foster parents. In-depth interviews were conducted and identified for major themes: (1) the dual stigma of foster care and mental health care; (2) the lack of engagement in mental health therapy; (3) trust issues with the therapist and other individuals; and (4) the desire to integrate mental health services with primary care services. These results have implications for mental health service delivery and suggest opportunities to improve mental health treatment through an integrated care approach.     

Development and Initial Findings of an Implementation Process Measure for Child Welfare System Change

This article describes a new measure designed to examine the process of implementation of child welfare systems change. The measure was developed to document the status of the interventions and strategies that are being implemented and the drivers that are being installed to achieve sustainable changes in systems. The measure was used in a Children's Bureau-supported national effort to assess the ongoing implementation of 24 systems-change projects in child welfare jurisdictions across the country. The article describes the process for measure development, method of administration and data collection, and quantitative and qualitative findings.
