This paper takes a recently published text and, in examining it closely, argues that it exemplifies trends within feminist scholarship in law, which might be characterised asestablishing a form of orthodoxy. The paper explores some of the ways in which thiso rthodoxy is constructed and presented, and argues that it is characterised by a commitment both to `grand theory' and Hegelian dialectics. The adoption of this model of work seems to offer a chance to hold together the triangular figure of women/theory/law reform. The paper will argue that, whilst this model is clearly a valid choice, and attractive to feminist scholars in the promise it seems to hold, the model is not to be presumed but rather should be examined and considered in terms of its potential for feminist scholarship. Both within its own terms, and as part of the construction of an orthodoxy, the paper will argue that it is in fact problematic and that feminist scholarship would be better served by seeking an alternative theoretical model. An alternative is suggested, using the work of Deleuze, but it is acknowledged that this will require the acceptance of a very different theoretical configuration from that suggested by the triangular model of women/theory/lawreform.  相似文献

This article examines the appeal of Carr's theory of international relations, which has enjoyed a longevity matched by few other bodies of work in a discipline characterised by faddism. I attribute Carr's success as an international theorist to his subtle use of philosophy, history, and political theory. Carr's holistic and interdisciplinary approach achieves its best expression in his employment of a critical dialectics of international theory in The Twenty Years' Crisis. The article does not confine itself to this element of Carr's writings as I also examine several works, such as The Future of Nations. Independence or Interdependence?, Conditions of Peace, and Nationalism and After,that consider the transformation of the international society. The latter works also employ a dialectic of power and morality in order to envision a world very different from the international system that Carr observed, an international order that approximates the emerging relations among states at the beginning of the twenty-first century. The article concludes with an examination of the role relativism played in Carr's theory scheme and the extent to which his dialectics of utopianism and realism is an important precursor of critical and postmodern theories of international relations.  相似文献

‘Postcolonial studies’ is the term given to the study of diaspora and the ideology of colonialism. Since the 1970s, when postcolonial studies was termed ‘Third World’ literature, and the 1980s, when it became ‘Commonwealth’ literature, the persistence of the framework of centre and margin, coloniser and colonised, has endured as a lens with which to view human identity and cultural expression. However, the relationship of postcolonial studies to international development is less well explored. Much of postcolonial studies is concerned with articulating patterns of gain, loss, inclusion, exclusion, identity formation and change, cultural evolution and human geographical dispersal in the wake of the after-effects of colonial rule. Postcolonial critics examine texts and images in order to make inferences about the significance of cultural identity and expression under these conditions. Often this is with a diachronic view of history. International development studies offers postcolonial critics a synchronic perspective on both the policy and materiality of political ideologies affecting cultural identity and expression. This paper looks at how the relationship between postcolonial and international development studies might be furthered in a dialectical exchange. Postcolonial critics such as Said and Pollard et al offer a critical understanding that informs policy making in international development contexts.  相似文献
