论我国投资机会均等的法律保障

所谓投资机会均等,是指在同等条件下,投资主体享有相同的投资权利和待遇。投资机会均等直接涉及到对外国投资的待遇标准。在双边投资条约中,采用的标准主要有国民待遇及最惠国待遇两种。欲使投资者享有均等的投资机会,必须加强并不断完善涉外投资立法,给投资者以法律上的支持和保障。而我国投资机会均等的法律规定明显不足,应加以完善。     

入世后我国金融业发展的机遇与挑战

根据入世承诺我国将逐步对外开放金融业,金融市场将呈现出竞争加剧的格局。入世带来的既有发展机遇也有挑战,一方面,入世将为我国金融业提高金融服务水平、促进金融创新与国际化发展等提供历史性机遇;另一方面,同国际上的先进国家或地区相比,我国的金融监管、金融创新、金融机构设置、金融风险控制等方面还存在一定的差距。     

Women's views on affirmative action: A new look at preferential treatment

The first part of this paper sketches a profile of women who endorse affirmative action, showing that women who approve of affirmative action identify with a nontraditional image of women and experience discontent when perceiving discrimination on the basis of sex. We also examine the impact of the implementing procedure. Studies conducted with French-Canadian women show that those who fit the above profile readily endorse equal opportunity policies. What about policies that advocate preferential treatment? Early studies indicated that women did not endorse these policies. Recent studies, however, revealed a dramatic change in the pattern of responses. Women who were dissatisfied with their collective situation and identified with a nontraditional image of their group predominantly approved of preferential treatment. What factors triggered this change in attitudes? Are the merit principle and preferential treatment policies truly incompatible? We address these questions in the second part of this paper as well as the implications of this shift in attitudes.     

Participatory effects of regional authority: decentralisation and political participation in comparative perspective

This article studies political participation in the context of decentralisation in Europe. Recent secession attempts demonstrate how the demand for decentralisation energises citizens. Yet the fact that decentralised institutions, initially, were endorsed to increase citizens’ participation is often neglected. In order to test this contention empirically, three theoretically informed arguments are developed, making use of the most recent data on regional authority for 282 regions in 20 European countries. Results of three-level hierarchical models lend support to the arguments. Regional self-rule increases probabilities to engage only in more demanding and less common forms of participation. It also acts as a political opportunity structure, moderating the influence of individual driving forces of participation. Participatory effects on protest activity, however, turn out to be endogenous, as the instrumental variable analysis indicates that decentralisation does not increase protest, but rather the reverse. These findings seem relevant to the current heated debates both on secession attempts and waning political involvement.     

Searching for Affordability and Opportunity: A Framework for the Housing Choice Voucher Program

Abstract

Affordability, a key factor in the housing search process, becomes critical when locating rental housing in opportunity-rich areas. The Housing Choice Voucher (HCV) program accommodates low-income households searching for housing and encourages recipients to reside in low-poverty areas. Affordable neighborhoods that are accessible to public transportation are often found in distressed areas, and not all HCV recipients succeed in locating qualified housing. To address these challenges, a housing search framework is developed to assist HCV households in the housing search process. This framework builds on the methodology of the U.S. Department of Housing and Urban Development (HUD) for the Location Affordability Index and Affirmatively Furthering Fair Housing assessment tool by creating multivariate indices that incorporate housing supply, accessibility to opportunity, and neighborhood conditions. The framework serves as a foundation for an online housing search application for public housing authorities to further fair housing goals, HCV recipients to locate qualified housing units, and local governments to assess affordability and opportunity.     

Types of organised crime in Italy. The multifaceted spectrum of Italian criminal associations and their different attitudes in the financial crisis and in the use of Internet technologies

This paper discusses the opportunity to differentiate four different criminological types of organised crime in Italy by drawing on a subset of case studies and interviews to law enforcement officers and experts collected for two on-going research projects. We hypothesise that, since these types exploit different social opportunity structures for their criminal activities, they have different capacities of adaptation and react differently when confronted with different kinds of innovations and changes. We test these four types against two significant phenomena that have been deeply impacting Italian society, among others, recently: the commercialization of the Internet and the economic and financial crisis that has hit Europe since late 2008. We conclude that these types offer a valid help to guide our understanding of what organised crime is today in Italy, as well as to assess the capacity of the existing legal framework to properly face all them. These criminological types could also serve as lenses to filter the different experiences of organised crime in other European countries, thus facilitating comparative research.
