自然人身份能力的区际法律冲突及属人法的确定--兼谈《民法典(草案)》第九编的属人法制度

“一国两制”的伟大构想促使我国形成“三法系、四法域”的独特法律体制。自然人作为民事法律关系最重要的主体 ,其民事行为能力的确定关系到其所从事民事行为的有效性。四法域有关这一制度的规定存在一定的法律冲突 ,并且在属人法的确定上亦有所不同 ,本文通过对四法域法律制度的比较 ,以及对属人法理论的换位思考 ,试探讨解决这一区际法律冲突的途径 ,并结合《民法典 (草案 )》第九编的有关规定提出一点建议。     

作为话语仪式的忏悔——何其芳延安时期的诗歌话语分析

在延安时期的诗歌话语实践中,何其芳主要运用了一种双重性的忏悔话语策略,以此来认同并超越当时正日趋成型的革命文艺话语秩序。其中隐含了主流权力话语重塑或改造诗人主体的运作机制,即通过排除程序和提纯程序来制约主体的话语空间和话语方式。何其芳的话语困境植根于他的心理困境,也折射了当时面临创作转换的革命作家的普遍文化困境。     

治理视野中的城市商务区政府管理与服务模式分析——以北京市东城区东二环交通商务区建设管理办公室为个案

商务区经济的发展有赖于政府发挥其宏观调控、监管和有效服务的功能,而商务区政府功能的发挥离不开合理的管理与服务模式的构建。本文认为,通过理顺商务区政府与相关职能部门、企业的关系,发展各种企业协会组织,搭建政府、企业、社会合作的有效平台,有助于建设和谐商务区,为商务区经济的发展营造良好的软环境。     

著作权正当性的危机与出路

在著作权利益集团主导的著作权体制下,著作权成为直接控制消费者的工具以及创作自由与网络技术发展的障碍,从而造成著作权侵权成为一种常态社会现象的危机。只有坚持每一种新生的著作权客体与权利都经过充分的正当性论证、构建以维护创作自由与网络技术发展以及不以消费者为直接控制对象的权利与权利限制制度,才能使已经发生或正在发生的对著作权正当性的偏离得到回归。     

关于我市开展劳动竞赛的调研报告

目前我市劳动竞赛呈现的主要特点是:普遍重视了找准劳动竞赛的切入点;与企事业单位中心工作的融入不断深化;竞赛体制进一步得到健全与完善。今后应注重推动劳动竞赛向系统化、专业化、精细化方向发展,进一步突出竞赛过程的科学管理,并将其与全面提高职工整体素质作紧密的结合。     

Why Nations Fail: The Origins of Power,Prosperity and Poverty

This study addresses compliance and business practices at the local level subsequent to the international adoption of the Kimberley Process Certification Scheme by states and the adoption of the voluntary System of Warranties by the diamond industry. This paper also explores the distance between norm creation, norm sustainability and norm expansion. Interests of various stakeholders led to the creation of international norms, and evidence supports widespread compliance at the state level. Data gathered at the local level of retailer suggests, however, that the regulatory system is not leading to the education of consumers that potentially transforms beliefs. Central to understanding the challenge of deepening and broadening new global norms is exploring the distance between compliance within the regulatory regime and the awareness or change of beliefs of stakeholders. Recommendations include steps to make the process of bringing diamonds to market transparent and available to public scrutiny.     

Cultural Policies and Local Planning Strategies: What Is the Role of Culture in Local Sustainable Development?

The authors draw a strategic framework for cultural planning at the local level. The concepts of industrial district and cluster have strengthened the role of space—in terms of external economies of localization and agglomeration—in economic development. The recent debate concerning contemporary development processes has underlined the increasing role of the cultural dimension for local development and has focused on different paths of clustering around cultural investment. The authors review the latest literature on cultural districts and illustrate some key cases around the postindustrialized world in which culture played a critical role by acting as a catalyst for major economic and social renewal. The authors present a strategic model of a progressive cultural district based on an asset-action matrix that intersects cultural policy drivers with capital resources. The authors define a new model of cultural district—the system-wide cultural district—as an emergent, self-organized model of cultural supply that displays significant strategic complementaries with other production chains with a typical, postindustrial characterization.

Monitoring School Violence

Abstract

National monitoring of school violence is essential for needs assessments, policymaking, and evaluation at the national level. As informative and important as national monitoring is, the data generated at the national level is often not useful at the district or school site levels. There is therefore a need for a feasible method of monitoring school violence on the district and school level; furthermore, we need to find ways to effectively apply national-level information to schools and school districts. over time should be the foundation for the design, implementation, and evaluation of interventions in this area. In this article, we propose an expanded concept of monitoring that links comparable data on school violence at the grade, school site, district, and national levels. The paper presents our conceptual framework and methodology and illustrates its implementation in a district in Israel. We present examples of reports generated to monitor school violence for the district as a whole and for each of the school sites. Finally, we conclude that this is a feasible and useful model that social services could adopt to monitor practice in many other areas.     

Heightening Leadership Effectiveness in Local Governments of Uganda: ‘Challenge the Process’ for Organisational Support

ABSTRACT

Leadership effectiveness is an enviable characteristic in public as well as in private organisations. This article presents a discussion of the leadership practice known as ‘Challenge the Process’; within the context of Bushenyi district local government administration in Uganda. The discussion reveals that the leadership practice of ‘challenge the process’ influences the organisational climate and can be influential in generating change within an organisation. The study also demonstrates that Bushenyi district employees associate the behaviour patterns of their leaders and supervisors with the organisation. Based on data collected, the argument is that the leadership practice of ‘challenge the process’ positively influences employees’ perceived organisational support in Bushenyi local government of Uganda. The conclusions are in agreement with Kouzes and Posner (2002) that leaders who ‘challenge the process’ can achieve extraordinary results and improve employees’ perceived organisational support.

The article recommends that in the current environment of local government administration in Uganda be characterised by a democratic political dispensation and private-public sector initiatives; leaders should consider not merely being mindful of the rules and standing instructions in public administration; must be innovative, willing to take risks, and challenge assumptions about the way things have always been done in order to increase employees’ perceived organisational support. As stressed by Kouzes and Posner (2002), leaders in local governments can promote the resourcefulness of employees at work through the practice of ‘challenge the process’.
