预防性行政协调的法治建构

相较于现有的行政诉讼调解、协调的理论与实践,预防性行政协调在合法性与正当性方面有所突破,强调在行政争议尚未诉至法院之前,通过司法权的主导,积极探索新的途径,提前介入到行政决策或者协商过程中,针对行政过程的预期侵害作出风险评估,及时发出预警,或者针对行政过程的合理性问题提出协调方案,有效预防社会矛盾的激化,并为不断完善社会管理模式提供新的视角与进路。     

家政女工的身份与团结权政治——一个家政工会女工群体的个案研究

本文试图通过对西安市家政工会项目的考察与分析,凸显在企业改革和重组中下岗、继而走进家政行业的女工在社会转型中经历的一个去工业化、边缘化、性别职业隔离化及去权利化过程,并讨论和观察项目如何利用国际与本土资源,对家政工群体进行组织动员和干预,为这个群体进行赋权,并帮助这些散在地分布于家庭私领域的家政女工实现了团结权的过程和影响。     

水资源管制立法内涵解读

Water resources have the functions as domestic water, resource water and environmental water, on the basis of which the legislative framework of water resource regulations shall be studied. Firstly, domestic water shall be deemed as property right and the legislation shall protect the realization of the fundamental human rights for use of domestic water. Secondly, with respect to resource water, an independent water resource regulatory agency shall be established; and meanwhile, the legislation shall promote the construction of water right market based on property rights and improve the utility of water resources. Thirdly, since environmental water is one of the public goods, the legislation shall create a path of privatization in implementing mechanism for realizing the use of environmental water and the franchising system provides a practical solution to privatization of environmental water. Xu Jinhai, Ph.D in Law, is a vice director of the Public Utilities Law Institute of Hohai University. Since 2001, he has released nearly twenty articles in Nanjing University Law Review and Jiangsu Social Science Journal and other academic journals.     

国际法律秩序演变下国内法院的角色转换

国内法院在国际法律秩序中扮演了一种独特的角色。随着国际法从国家间的自助体制走向国际社会的规则体制的演变,国内法院成为了国内与国际法律秩序之间的“守门员”。国内法院阐明和适用国际法律规范,并通过司法审查职权监督其他国家机关遵守国际法;国家法律秩序的最新演变进一步使国内法院在一定意义上成了“国际的法院”,特别是,随着普遍管辖原则、国际人权法与国际司法体制的新发展,国内法院在某种程度上成了国际法律秩序的“代理机构”甚至“基层法院”。国内法院毕竟是国内机构,但它在国际法律秩序发展中的潜能值得关注。     

家务劳动的女权主义批判考察

家务劳动是人类社会的基本劳动方式之一.但在现代社会,这种劳动的无酬性使之日益被社会所轻视.同时,家务劳动承担上的社会性别失衡性使得女性的发展被进一步阻碍.20世纪以来,女权主义对家务劳动进行了深入的探讨与批判.对这些批判性理论的考察将有助于我们吸取其合理价值,促进我国的法制建设.     

“河长制”：一个中国政府流域治理跨部门协同的样本研究

流域治理的跨域特征所带来的问题超过了涉水部门单个主体的能力,从而带来了流域治理的协同失灵和碎片化问题。对“河长制”的观察表明,“河长制”跨部门协同可以较好地解决协同机制中责任机制的“权威缺漏”问题,短期内成效明显。通过横向层面和纵向层面的协调机制,大大提高了协同效率。这是一种新型的混合型权威依托的等级制协同模式。但是,以权威为依托的等级制纵向协同的基本特征没有改变,将会面临着“能力困境”、“组织逻辑困境”和“责任困境”的挑战。最后采用菲利普斯分析框架分析了影响“河长制”跨部门协同效率的因素。     

基于锦赤铁路的区域经济战略合作问题研究

区域经济一体化是指一些地理相近的国家或地区间通过加强经济合作,为谋求风险成本和机会成本的最小化和利益的最大化。在国家加快推进东北亚区域经济一体化背景下,以锦赤铁路为依托的区域经济合作,成为东北三省和蒙东加强合作的重要支撑点之一。从"港腹联动"与"蒙煤入海"双向需求为出发点,以锦赤铁路为辽蒙的纽带和桥梁,从战略和系统的角度,多层次构建和优化铁路沿线经济带的区域分工,拓宽合作渠道,以促进辽蒙经济实现可持续发展和区域一体化。     

家政工人劳动权益保护之监察

家政工人劳动权益保护之劳动法调整范式的缺位,折射出现代劳动法历史使命再续和逻辑延伸之客观需求。家政工人在现代社会语境中所内射出来的诸多"人像"特征,有别于传统私法视域下的"人像"。固守形式平等的私法理念不能回应和规范家政工人这一特殊群体的内在利益诉求。践行实质平等之社会法理念下的家政工人劳动权益监察制度,是国家基于社会本位的思想,对弱势家政工人劳动权益给予倾斜性保护的重要利益干预和调控机制。家政工人劳动权益监察制度是在家政工人劳动权益受劳动法保护模式下的必设性制度。家政工人劳动权益保护监察制度与劳动监察制度在制度接轨时必须考量二者之一般性和特殊性。     

TRAINING,SKILLS, AND PRACTICES OF PARENTING COORDINATORS: FLORIDA STATEWIDE STUDY

This report details findings from the nation's first statewide study on parenting coordination. A survey was presented to all known practicing parenting coordinators (PCs) in Florida (N = 207), with 67 (32%) responding. Data concerning PC demographics, how PCs do their work, and how they perceive their clients at different stages of the parenting coordination process suggest substantial similarity between mental health and family law professionals in almost every realm of questioning. Study limitations, implications for further research, and practice considerations are discussed.     

The Impact of the USSR on Lithuania's Domestic Policy and Its International Orientation in the Third Decade of the Twentieth Century

This article investigates links between domestic and foreign policy, topics which are usually discussed rather than analyzed in any detail. The case of the USSR and Lithuania is taken as an historical example of the impact of the external factor on domestic policy, and an attempt is made to elucidate how the Soviets tried to influence and correct Lithuania's policy in the inter-war period by providing financial assistance to parties and their press. In this way they sought to set Lithuania against Poland and fuel the conflict between them, so that they would not become reconciled, would not create the so-called Baltic Union with Latvia, Estonia and Finland and would not orient themselves to the West. Using financial and other levers of secret policy, the Soviets contributed significantly to pushing the pro-Western Christian Democratic Party away from power in Lithuania so that the Nationalists, who sought to establish closer relations with the USSR, came to be established. The overseas financing of parties which remained unknown to the public distorted the political process of Lithuania and hindered the maturing of social awareness.
