The threat posed by transnational terrorism has excited debate about how best to calibrate relations between government, the courts and parliament: how can the provision of internal security be facilitated, whilst respecting freedoms and ensuring that policies enjoy broad legitimacy? Attention has focussed primarily on the power of the courts. Sections of the government have mooted a curtailment of judicial competencies; by contrast, a broad range of actors calls for ‐ at the least ‐ the maintenance of current judicial powers as the best means to prevent government from exploiting its already large scope for manoeuvre, as well as to overcome public scepticism. Yet the current debate misses the point that relations between government, courts and parliament have already been altered. Government has gained extra political resources thanks to its participation in forms of international counterterrorist cooperation. This shift of power, and associated problems, were clear during the recent ‘Heathrow bomb plot’.  相似文献

Major disasters represent infrequent events that often require response organizations to vicariously learn from the experiences of others in order to improve their operations. A primary mechanism for such knowledge diffusion is the different practitioner and empirical journals for the organizational fields that comprise disaster response. A review of the literature for the law enforcement field, however, reveals that little attention is given to how these organizations manage actual disasters. In particular, the presentation of organizational experiences, whether through case studies or other methodologies, is very limited in the practitioner and empirical literature of this field. This represents a considerable problem for improvements of disaster response operations given that law enforcement agencies represent a key component in such efforts. The research presented in this article is an effort to fill this knowledge gap and thereby facilitate organizational learning to improve future law enforcement disaster response activities. The authors traveled to Mississippi and Louisiana after Hurricane Katrina to examine the response efforts of state and local law enforcement agencies to the storm. The findings from this research are reported here in a lessons‐learned format to inform law enforcement disaster response policy.  相似文献

This paper asks whether the migration decisions of unauthorized Mexican immigrants to the USA have been influenced by stronger US border enforcement efforts since 1993 that have sharply increased the physical risk and financial cost of illegal immigration. These measures were supposed to have decreased the probability of successful entry, thereby lowering the expected benefits of migration. We carried out a logistic regression analysis of data from a recent survey of 603 returned migrants and potential first‐time migrants in rural Mexico. Our findings indicate that tougher border controls have had remarkably little influence on the propensity to migrate illegally to the USA. Political restrictions on immigration are far outweighed by economic and family‐related incentives to migrate. An alternative, labor‐market approach to immigration control with higher probability of effectiveness is outlined.  相似文献

在警察的日常执法活动中,警察机关和警察个体拥有较大的自由裁量权.其产生的原因是由执法过程本身的特殊规律所形成的;由警察执法的优先选择性所带来的;由警察面对的大量"违法"事件的性质所决定的.自由裁量权的使用具有如下特点警察行使自由裁量权已对公正执法产生了一定的影响;警察自由裁量权的使用因面临的局势不同而各异;警察处理治安案件比刑事案件更倾向于使用自由裁量权.对警察的自由裁量权实施管理的有效措施强化警察的思想道德教育,切实提高正确使用自由裁量权的能力;树立新的执法观念;促进自由裁量权的合理使用;特别重视警察自由裁量权的控制问题,尽量减小其滥用的可能性.  相似文献

This paper examines bilateral cooperation between developed countries (home country) and developing countries (host country) to reduce greenhouse gas emissions and to enhance carbon dioxide sinks. With the home-host country pair as the unit of analysis, our logistic regression model examines 158 Activities Implemented Jointly (AIJ) investment projects from 1993 until 2002 across 2541 country-pairs. Because the marginal costs of reducing emissions may be lower in developing countries, the AIJ projects served as a policy laboratory to assess whether such investments might be advantageous to both countries in the event future regimes allowed emission credits from such bilateral projects. Instead of investing in home countries where maximum pollution reductions (or carbon sequestration) might be possible, home countries invest in locations where they can conduct their policy experiments at low transaction costs. Prior trade and aid relationships were used as a proxy. Regarding energy projects, location decisions are driven by home countries’ desire to reduce air pollution that they receive from abroad. Geography – proximity of a host country to a home country – in interaction with host country's coal production, is a very important driver of location decision in AIJ energy sector projects. Location of sequestration projects is impacted by the host country's potential for avoiding deforestation as well as by previous aid and trade patterns between a home and a host country.
