自由心证制度所面临的两大挑战

在现代大陆法系诉讼中 ,自由心证是事实认定的基石。虽然学界也提出了这种“自由”并非是绝对的 ,但是 ,主要是从“自由心证”在客观上必然受到“可接受性”标准限制 ,来讨论其“自由”的相对性。这似显不足。本文拟从程序运作的角度来探讨自由心证在实践层面上所面临的两大挑战 :一个来自科技证据的广泛应用 ;另一个是排除规则的实施。注意到这两个挑战 ,对中国的司法改革中证据制度的设计有一定的启示。     

美国《网络空间国际战略》评析

在信息化时代,网络空间承载着国家政治、经济、文化和军事发展与安全的重荷。网络空间存在的黑客攻击、网络犯罪和网络恐怖主义事件层出不穷,因此网络空间安全已上升到国家安全战略的层面,美国政府于2011年5月16日发布的《网络空间国际战略》引起世界各国瞩目。美国《网络空间国际战略》以"共同创造繁荣、安全、开放的网络世界"为基本宗旨,以"基本自由、隐私和信息流动自由"为核心原则,从经济、网络安全、司法、军事、网络管理、国际发展、网络自由等诸方面为美国未来网络安全战略的发展指明了方向。《网络空间国际战略》的出台表明美国政府已将网络安全提升到国际战略的新高度,它隐含着美国谋求网络空间霸权的战略目标,具有引领国际战略新变革和引发网络空间价值观冲突的现实战略效能,它对中美关系的影响和中国的应对之策也是值得认真分析和思考的。     

Studying process in a Title IV-E waiver evaluation project: Interviews with regional and executive managers

A Midwestern state’s child welfare agency contracted with a university to evaluate a 5-year Title IV-E Waiver Demonstration Project. As part of the process study, evaluators employed case study analysis to investigate Waiver knowledge and effects as reported by Regional and Executive Managers across 4 years of the demonstration period. Data from 78 interviews reveal enhanced levels of manager–evaluator rapport and integrated Waiver knowledge across years of data collection. This study highlights the value of middle managers as rich data sources, studying process through qualitative methods in child welfare evaluation, and how consistent relationships can support partnerships over time.     

Parental attitudes following exposure to child abuse prevention campaign materials: a randomized trial

The purpose of this study was to evaluate child abuse prevention campaign materials. Using a randomized posttest design, 600 parents from an online research panel were recruited and surveyed. Multiple regression results indicate that exposure to the campaign materials had a significant relationship with four of the five domains (effects of child maltreatment, the appropriateness of harsh parenting, the physical dangers and needs unique to childhood, and the power to prevent child maltreatment). These results have implications for the child abuse prevention practitioners who seek to design and distribute effective campaign materials.

Ambivalence in Intergroup Evaluation: The Role of Fairness Norm

We conducted two studies to examine the role of the social norm of fairness on cognitive (beliefs and judgments) and affective (emotions and feelings) ambivalence in an intergroup context of evaluation. As predicted, we found that ambivalence toward the ingroup is constantly higher in the cognitive dimension than in the affective dimension. Instead, cognitive and affective ambivalence toward the outgroup are generally similar but when the outgroup is highly protected by the fairness norm (i.e., the elderly), cognitive ambivalence is considerably lower than affective ambivalence. These findings provide evidence that (1) cognitive ambivalence is more controlled by the fairness norm than affective ambivalence, and that (2) it holds an adaptive function, changing in accordance with the demands of the normative context.

德国刑法对隐私权的保护及其评析

隐私权是现代社会最为重要的新兴基本人权之一,而德国是欧陆法系中对隐私权立法保护较为先进的国家,并且拥有细致完善的隐私权刑法保护规范体系。对德国隐私权刑法保护进行研究,关注其刑事立法发展动向,将会为中国隐私权刑法保护立法提供可资借鉴的理论经验。     

基于预算管理的高校资金使用绩效评价

预算管理无论对企业、事业单位都具有重要作用。西方发达国家在高校资金的预算管理及绩效评价方面有一套较完善的体系。我国高校的资金管理中尚存在较多问题,在较多方面有改进的需要。本文立足我国高校预算管理的发展现状,以预算管理为主线,在此基础上论述构建资金使用绩效评价体系。     

中国农村金融体制三十年改革的回顾与评价

“三农”问题始终是影响中国经济发展和社会稳定的重大问题,而“三农”问题的解决直接或间接依赖于农村金融的支持。改革开放以来,我国农村金融体制发生了深刻的变革,农村金融在服务“三农”方面发挥了重要作用。但农村金融体制改革始终没有突破旧体制的框架,已成为制约我国农村经济发展和社会主义新农村建设的重要因素。文章在回顾三十年农村金融体制改革历史的基础上,分析了当前我国农村金融体系存在的问题,并就如何进一步深化农村金融体制改革,建立现代农村金融制度提出了相应的建议。     

新型模糊综合评价法在油库安全评价中的应用

油库是储存油料的基地,油料因易燃、易爆、易挥发等特点具有危险性。客观、正确的评价油库安全的首要任务是精确地确定影响油库安全的各个因素（如员工、设备、环境和管理）的权重。本文中探讨了模糊综合评价法的重要性并提出了一种权重矩阵计算新方法。该模糊综合评价法的实例研究结果表明：员工的身体状况和业务素质是影响油库安全的主要因素,因此,油库管理必须以人为本,同时加强员工业务技能培训,从而确保油库安全。该评价方法更容易操作,使评价结果更客观准确。
