私法自治原则以及作为其重要表现的法律行为在现代社会已受到诸多限制。规定生效要件是对法律行为进行限制的重要手段。不同生效要件有不同目的导致不同法律后果。形式要件是生效要件之一。违反形式要件不一定导致法律行为无效,可转换成权义结构相似形式要件不同的它种法律行为,也即无效法律行为转换。我国即将制定的民法典民事法律行为一章中应引入无效法律行为转换。 相似文献

互易毒品与贩卖毒品之间是一种交叉关系,将互易毒品行为一律不作为犯罪处理或一律作为犯罪处理,在方法论上存在错误,由此而划定的互易毒品的内涵,也为罪刑法定原则所不容。根据互易毒品的形式与实质,结合现行刑法关于涉毒犯罪的规定,确立"相对说"将成立买卖关系的高纯度与低纯度毒品、硬性毒品与软性毒品以及相同纯度但数量不等毒品间的互易,作为贩卖毒品罪处理,其他情况的互易毒品行为不作为犯罪处理,才是合适的。 相似文献

This article explores the possibilities for new forms of ‘digital citizenship’ currently emerging through digitally supported processes of narrative exchange. Cambridge: Cambridge University Press.) circuit of ‘civic culture’ as a model for exploring the interlinking preconditions for new acts of citizenship, we discuss the contrasting outcomes of research at three fieldwork sites in the North of England – educational (a sixth form college), civil society (a community reporters' network) and social (a local club). Each site provided clear evidence of the elements of Dahlgren's circuit (some depending on the intensive use of digital infrastructure, others predating it), but there were also breaks in the circuit that constrained its effectiveness. A crucial factor in each case for building a lasting circuit of civic culture (and an effective base for new forms of digital citizenship) is the role that digital infrastructure can play in extending the scale of interactions beyond the purely local. 相似文献

What are the determinants of international cooperation in exchange‐rate management? To answer this question, coordination of foreign exchange intervention by the United States and Japan from 1977 to 1990 is analyzed. An examination of the data raises two empirical puzzles: (1) Why do the periods of active intervention and high cooperation coincide?; (2) Why does Japan intervene unilaterally more often than the United States? Some hypotheses drawn from various theories of cooperation are tested, but none of them receive strong support. Instead, intervention volume and learning by U.S. administrations account for the variance in coordination. These findings resolve the two puzzles: (1) The periods of active intervention are the time of high need for cooperation; (2) Japan is obliged to intervene unilaterally while the United States is learning to cooperate. 相似文献

Current global economic trends have rekindled interest in development alternatives. Competing socialist and green proposals for these development alternatives raise important questions about crafting institutional vehicles for the simultaneous realisation of popular empowerment, sustainability and poverty alleviation development goals. Much of the debate is about economic scale and the re-localising of production and consumption sundered by globalisation. Yet socialists and greens are fuzzy on principles of economy necessary to achieve their desired goals. To help sort out these issues this article introduces the concept of “socio-material communication” as a way of differentiating among available economic forms. It then offers a design for socialist development that is progressive, sustainable and realisable under current “really existing” conditions. It is concluded that realisation of socialist and green development goals for future human betterment requires the combining of modes of socio-material communication to meet specific development challenges, rather than seeking to impose one mode, such as economic planning or society-wide market operation, indiscriminately. 相似文献

American politicians and policy makers have blamed China's exchange rate for the large US trade deficits. This paper explains why the USA treats its trade deficits with China as a security issue that have become a source of friction in Sino-US relations. The essay argues that this friction is a useful deflection from the politically difficult policy action needed to remedy the US economy and cannot easily be removed by the Chinese side alone. The structure of global trade and the reality of China's political economy, which forces Chinese leaders to develop policies for a “harmonious society” in the face of growing inequality also makes it difficult for China to respond positively to US pressure on the exchange rate. 相似文献
