媒体对司法的监督

大众传媒是当今社会公众了解公共信息并表达意见的主要渠道。媒体的监督具有促进司法独立、司法公开和司法公正的价值,但媒体与司法之间同时存在着冲突。冲突的解决应当从各国的实际情况出发,找到两者之间的平衡,以达到保障人权和司法公正的实现。从我国的司法现状看,更应强调对媒体作为公众舆论渠道的保护。     

H3亚型猪流感病毒血凝素基因在昆虫细胞中的表达及其间接ELISA检测方法的建立

根据GenBank上登录的H3亚型猪流感病毒HA基因序列设计了1对引物,经PCR扩增出HA基因目的片段,并将其克隆到pFastBacGP67C杆状病毒载体上,筛选阳性重组转座载体pFastBacGP67C-H3,转化至含有杆状病毒穿梭载体(bacmid)的DH10Bac感受态细胞,构建杆状病毒表达载体,获得重组转座子rBacmid-H3,在脂质体介导下转染处于对数生长期的sf9昆虫细胞,获得重组杆状病毒rBv-H3,将其感染sf9昆虫细胞,收获目的蛋白。经血凝试验、SDS-PAGE、Western-blot、免疫组织化学分析,结果表明,HA蛋白得到表达,且具有良好的免疫学活性。用表达的HA蛋白作为包被抗原,初步建立了H3亚型猪流感病毒的间接ELISA检测方法,通过对93份送检的疑似猪流感血清进行检测,结果显示,检出阳性率为46.24%。上述结果为建立快速、准确、简便的H3亚型猪流感鉴别诊断试剂盒奠定了基础。     

长角血蜱4D8基因的克隆与原核表达

根据GenBank上登录的蜱4D8基因序列设计引物,用PCR技术从长角血蜱雌蜱研磨组织cDNA中扩增出4D8基因,将其连入pGEM-T Easy载体,构建重组克隆载体pGEM-T-4D8,并对检测为阳性的克隆进行测序。将该基因重组至原核表达载体pGEX-4T-1,经表达纯化后,进行Western-blot试验鉴定其生物学活性。结果,长角血蜱4D8基因的氨基酸序列与青海血蜱、肩突硬蜱的同源性分别为90%、81%。表达的重组蛋白是分子质量约为41ku的融合蛋白。Western-blot试验证明,该重组蛋白能很好地识别兔抗长角血蜱全蜱阳性血清。结果表明,4D8基因作为一种重要的分子标记基因在蜱的流行病学调查方面有着重要的价值,同时作为潜在的候选抗原基因在疫苗的研究方面也有重要意义。     

旋毛虫Ts43基因真核表达载体的构建及其在Vero E6细胞中的表达

利用RT-PCR技术从黑龙江省猪源旋毛虫获得了Ts43基因,并克隆入pcDNA3.1-CT-GFP真核表达载体中构建重组质粒,用该重组质粒在脂质体介导下转染Vero E6细胞,GFP标签证明质粒DNA成功转染到细胞中并得以表达,通过Western-blot分析,细胞裂解液样品中有1条约66 ku的条带,可被小鼠旋毛虫阳性血清所识别,与预计大小一致,说明,真核表达载体pcDNA3.1-CT-GFP中的Ts43基因在VeroE6细胞中获得了表达,表达产物具有抗原性。     

猪带绦虫TSO18基因真核表达载体的构建及其表达

采用PCR从重组克隆载体pGEMTSO18中扩增出猪带绦虫六钩蚴TSO18基因,与毕赤酵母分泌性表达载体pPIC9k相连接,构建重组表达载体pPIC9kTSO18,转化大肠埃希氏菌JM109,经测序证实,基因序列完全正确。制备重组质粒pPIC9kTSO18,用SalⅠ线性化,并电转化毕赤酵母(Pichiapastoris)GS115,使重组表达载体与酵母染色体发生同源整合。采用G418抗性梯度法筛选得到高拷贝重组菌株,以甲醇进行诱导表达,SDSPAGE和Westernblotting分析结果表明,诱导表达的培养上清中表达出具有反应活性的16ku重组蛋白,目的蛋白约占培养上清液中蛋白总量的80%以上,诱导72h目的蛋白表达量为0.5mg/mL。     

Credibility of the Emotional Witness: A Study of Ratings by Court Judges

Previous studies have shown that the emotional behavior displayed during testimony may affect the perceived credibility of the witness. The present study compares credibility ratings by Norwegian court judges with those made by lay people. The participants viewed one of three video-recorded versions of a rape victim's statement, role played by a professional actress. The statement was given in a free-recall manner with one of three kinds of emotions displayed, termed congruent, neutral, and incongruent emotional expression. The results show that, in contrast to lay people, the credibility ratings of court judges and their votes for a guilty verdict were not influenced by the emotions displayed by the witness. Results are discussed in terms of professional expertise.     

PrP基因在金黄地鼠淋巴和外周组织中表达水平的动态检测

利用实时荧光定量RT-PCR技术,构建了标准重组质粒,制备了标准曲线,对不同年龄金黄地鼠腹股沟浅淋巴结、脾、心、肝、肺和肾提取总RNA,反转录后进行PrP基因的表达定量。结果发现,淋巴组织呈现高的表达量,外周组织的表达量比较低;不同组织在不同年龄出现表达高峰。     

版权与表达自由之协调

版权与表达自由之间存在内在的紧张,传统版权法在两者之间通过合理使用等制度进行了适当的协调,但在数字技术与网络环境下,新近纳入版权法的技术措施保护对表达自由产生了新的紧张关系,这需要重申利益平衡的版权法精神。     

Freedom of Expression in South Korea

South Korea is widely considered a consolidated democracy, but there is growing evidence that freedom of expression in South Korea has lagged behind that of comparable Asian countries and that it has deteriorated since 2008. Freedom House downgraded South Korea’s “freedom of the press” status from “free” to “partly free” in 2010 and other international reports also raised concerns on the status of freedom of expression in the country. We identify five problems that have contributed to the deterioration in South Korea’s rankings with respect to civil liberties: abuse of criminal defamation, the rules governing election campaigns, national security limitations on free speech, restrictions related to the internet and partisan use of state power to control the media. We close by considering possible explanations of the phenomenon, ranging from more distant cultural factors and the influence of the Japanese legal systems through the enduring impact of the Cold War. However, the main problems appear political. Governments on both the political right and left have placed limits on freedom of expression in order to contain political opposition, and constitutional, legal and political checks have proven insufficient to stop them.     

政府回应性视域中环境群体性事件成因及对策

政府对民意的回应是民主政治的本质要求。环境问题也是政治问题,近年来环境群体性事件频发,严重影响着社会的稳定与和谐。从政府回应性的视角来分析,因环境污染引发群体性事件的频发和逐年递增,与地方政府未做好职能性回应,政府前瞻性回应欠缺、责任性回应不到位等有关。因环境问题引发的群体性事件,不仅无助于生态文明的建设,更不利于社会的和谐与稳定。因此,地方政府应避免被动回应的局限性,负责任地主动回应,通过加强政府不同层面的回应性建设来应对并解决环境群体性事件。
