ABSTRACT

This paper looks at the intervening role that local political elites play to translate government transfers into effective public spending. We want to know whether mayors spend IGTs to provide basic public services or infrastructure works, and whether such investments are instrumental to secure their advantage as incumbents. To test these arguments, we use a combined dataset of local public finances between 2001 and 2015 and electoral results for the 2009 and 2014 municipal elections in Ecuador. We find that mayors do respond to political incentives and make strategic spending decisions to invest on public services and visible infrastructure projects. However, we find selective spending was insufficient to secure incumbency advantage in the 2014 election. We argue that the executive intervened to block or limit the impact of spending decisions at the local level, thus creating an incumbency disadvantage for mayors. Further research is needed to explain this.  相似文献

Abstract

From 2000 to 2010, the federal criminal caseload increased roughly 50% with a large portion of this increase attributed to the rise in immigration prosecutions. These changes coupled with recent Supreme Court decisions rendering the guidelines advisory have renewed calls for research examining prosecutorial discretion, particularly with respect to the influence of legal and extralegal factors on charging and bargaining decisions. This study utilizes data (2002–2010) from the Federal Justice Statistics Program database housed within the National Archive of Criminal Justice Data (NACJD). More specifically, the current research examines prosecutorial decisions to decline to charge federal arrestees and to make any changes to the charge from the arresting offense. Results from the multilevel, multivariate models reveal that both extra-legal and legal factors were influential of these decisions. Disaggregated models also revealed considerable variation across different offense types. Finally, districts with higher caseloads had lower odds of a prosecutorial declination and charge change.  相似文献

In May 2014, and for the second time in her political history, regional, federal and European elections were organized simultaneously in Belgium. In the direct follow-up of the sixth state reform, which increased the powers and autonomy of the Belgian Regions and Communities, these elections were crucial for the future of the country and for the multi-level coalition formation at the regional and federal levels. The political campaign was dominated by socioeconomic issues and demands for further autonomy, particularly in the Flemish region. Regional electoral results confirmed the success of the regionalist parties in Flanders, but also in Brussels and in the German-speaking Community. These successes allowed regionalist parties to enter all regional and federal governments—often as the dominant party—with the exception of the Walloon and the French-speaking Community cabinets.  相似文献

Abstract

Punishment scholars acknowledge the fundamental importance of both prosecutorial discretion and jurisdictional variation in punishment; yet, little is known about the extent to which charging practices vary across court contexts. This is especially true in the federal criminal justice system. This research investigates this issue by linking four years of charging data from the Administrative Office of the U.S. Courts (AOUSC) to corresponding data from the U.S. Sentencing Commission (USSC). It incorporates unique information on district court contexts from a variety of sources to investigate jurisdictional variation in charge reductions. Findings provide evidence that federal charging practices vary across district courts. In particular, several structural court characteristics are significantly related to the likelihood of charge reduction for similarly-situated defendants. Results from this study are interpreted through the lens of contemporary legal perspectives on court communities and suggest several fruitful directions for additional research on the social contexts of criminal prosecution.  相似文献

Recent scholarship on criminal punishments increasingly highlights the importance of courtroom social contexts. Combining recent data from the U.S. Sentencing Commission (FY1997–2000) with aggregate data on federal districts, the current study examines interdistrict variations in the application of downward departures from the federal sentencing guidelines. Findings indicate that substantial variation exists in the probability of both prosecutor‐initiated substantial assistance departures and judge‐initiated downward departures. This variation is accounted for, in part, by organizational court contexts, such as caseload pressures, and by environmental considerations, such as the racial composition of the district. Additional evidence suggests that individual trial penalties and race disparities are conditioned by aggregate court contexts. Drawing on interviews with federal justice personnel, this article concludes with a discussion of future directions for research on federal guidelines departures. As democracies worldwide have reverted to competitive authoritarian regimes or full dictatorships, some autocrats have used clientelist policies to strengthen their positions of power. We contend that autocrats can weaponise conditional cash transfers (CCTs) to shore up electoral support under democratic backsliding. In this vein, we analyse the impact of Honduras's Bono 10,000, a discretionary CCT, on the electoral support for the incumbent National Party and opposition blocs between 2013 and 2017, an era marked by the erosion of democracy. Using two survey waves from the AmericasBarometer by the Latin American Public Opinion Project (LAPOP), we show how the CCT boosted the electoral support for the National Party as democracy unravelled. Our findings contribute to the growing literature on how autocrats rely on carrots – not just sticks – to consolidate power.  相似文献
