针对食品安全案件中食品生产者、销售者的惩罚性赔偿责任,《消费者权益保护法》第四十九条规定为合同责任,《侵权责任法》第四十七条规定为侵权责任,《食品安全法》第九十六条根据具体情况既可附加于合同责任又可附加于侵权责任中。三法所规定惩罚性赔偿责任在构成要件、赔偿范围方面各有不同。在构成竞合的情况下,在合同责任内部,《食品安全法》第九十六条第二款应为特别法;在侵权责任内部,应当允许受害人根据个案选择适用《食品安全法》第九十六条或《侵权责任法》第四十九条。 相似文献

This study explores how local governments and their development partners—that is, donors, non‐governmental organisations and private companies—structure their partnerships as they work together to provide services to communities. Cases of collaboration between four organisations working in the rural water supply sector and six local governments in Malawi are studied. Using a cross‐case qualitative methodology, we illustrate how power and control translate into practices, leading to different levels of local government involvement in service delivery. This study contributes to the literature on cross‐sector partnerships in particular by developing empirically‐based propositions that help explain the dynamic trajectories that partnerships between local governments and their development partners can take. This article reconsiders the role of courts as policy entrepreneurs by presenting a detailed case study of India's Mid‐Day Meals Programme. In 2001, the Indian Supreme Court (SCI) passed a landmark decision, finding for the right to food and forcing the Indian government to implement a sweeping range of policies related to food consumption. Through an analysis of the court case orders for the school feeding program, this article argues that the SCI can be considered a policy entrepreneur as an advocate for the food consumption programs, but, more importantly, because their actions changed the social conditions in India. The article develops an alternative understanding of courts as policy makers that focuses on the interactive and iterative nature of the court process in order to detail how courts can act as policy entrepreneurs. The world's attention has focused on Zimbabwe as the country has moved from the turmoil of the 2008 elections to a tentative democratic transition under the current Inclusive Government. The country's newly elected local authorities and an apparent interest in decentralization have been largely ignored in the process, however. This essay thus provides an extensive, survey‐based examination of local governance in Zimbabwe as of 2009. Four areas are discussed. First, with the growth of the political opposition to the ruling regime, local governance has also suffered from the deep polarization among all the country's institutions. The inexperience of the new local councilors vis‐à‐vis local administration officials also holds significant ramifications. Second, although local officials believe that public participation in decision‐making is strong, citizen involvement is actually quite weak. Third, reeling from the country's 2008 economic crisis, local authorities were operating as best as they could on minimal income and barely functioning in many areas. Financial transfers ended long ago; revenue generation remains poor. Finally, this essay captures the poor state of public services. Achievement of a national democratic consensus, decentralization that actually promotes democratic local governance and strengthening once‐strong local institutional capacity will determine the future progress of local governance. The influence of external organizations and pressures on business risk management practices has hitherto been examined through the influence of state regulatory regimes on businesses. This article concentrates on key socio‐legal concerns about the influence of the law in social and economic life. We know that the sources of regulation and risk management are diversifying beyond the state. What we do not have is much empirically informed research about the range of sources influencing the business world and in particular the weighting of influence exercised by them. In this paper we explore the understandings regulatory actors have of the different external pressures on business risk management through an empirical study of the understandings of those in the food retail sector about the management of food safety and food hygiene risks. A broader objective is to throw some further light onto the debate about regulation within and beyond the state. 相似文献

Europe consists of various different regions with their own local traditions, specialties and peculiarities. There is currently a lack of awareness of local traditional foods, traditional specialties, traditional agricultural practices and traditional ecological knowledge in Europe, because the international debate has focused mostly on traditional knowledge held in developing countries and by indigenous peoples. Consequently, in most European states such knowledge and products have not been fully recognized and documented. Otherwise, within the European Union, at national and at Community level, measures have already been taken to protect traditional knowledge in a defensive and partly in a positive way. Relevant in this sense are the legal protection of ‘Traditional Specialities’, Portugal's legislation for the protection of traditional knowledge associated with genetic resources, designations of origin for agricultural products and foodstuff, and documentation schemes for traditional food specialities, as illustrated by the Austrian and Bavarian systems. 相似文献

As human DNA profiles can be obtained from blow fly artifacts, this study aimed to establish the feeding preferences of Lucilia cuprina (Wiedemann) blow flies when offered human biological fluids and nonhuman food sources. One‐day‐old and 3‐day‐old blow flies of both sexes were simultaneously offered human blood, semen and saliva, pet food, canned tuna and honey, and the number and length of visits documented over 6 h. One‐day‐old flies visited pet food and honey most often, but stayed longest on honey and semen. Three‐day‐old flies visited semen and pet food most often, and stayed longest on these food sources. Blood and saliva were the least preferred options for all flies. Overall, flies preferred dry blood and semen to the wet forms. These findings demonstrate that even when other food sources are available, flies at a crime scene may feed on human biological fluids if present, potentially transferring human DNA. 相似文献
