“Ceaseless Poverty”?

Abstract

Looking at Dickinson and Hölderlin, this essay begins by exploring the idea of the poetic dimension of existence and its relation to the image, or more precisely, to the capability to disclose into images. For Dickinson the relentless “poverty” of a non-poetic existence indicates that what is missing from such existence are not just images but the capacity for their “disclosing” - the poetic gift or aptitude. With the help of Heidegger’s essays on poetry and poverty, I invert this relation between image and poverty to show that, even though the inceptive character of the poetic word and the element of poetic dwelling it allows to emerge appear poor in comparison to images or concepts, it is the poetic word that for the very first time lets humans dwell. Although it can neither boast the richness of “pictures” nor the strength and precision of conceptual comprehension, the poetic is what opens up the world for humans and simultaneously opens their being to its characteristic manner of inhabiting this world.

The culture of risk regulation: Responses to environmental disasters

Disasters challenge the equilibrium of regulatory regimes and make policy shifts more likely. Using an institutional theory of cultural biases and the concept of cultural “surprise”, this article analyses the direction and intensity of media argumentation in respect of policy shifts. Instead of assuming a demand for greater State intervention after dramatic focusing events, as suggested by other theoretical frames, cultural theory opens a variety of options that range from embracing regulatory responses from different cultural biases to the radicalization of current, but failing, instruments. The analysis of media reaction to the environmental disasters caused by the oil spills of Exxon Valdez (United States), Erika (France) and Prestige (Spain) shows that the demand for more hierarchy does not monopolize the overall argumentation. The change demanded often implies a radicalization of a particular prevalent view where the associated institutional setting is failing its supporters.

我国法学界对明星模仿涉及的法律问题给与了很多讨论,讨论的主题涉及明星模仿的方式、侵权构成要件、法律规制等方面。目前来看,理论界对于明星模仿侵犯了权利人的合法权益并无异议,但对于认定侵权的标准和侵犯了权利人何种权益等问题仍有待进一步讨论。本文试图引进形象权的概念和形象权理论中＂附带使用＂规则对明星模仿侵权相关理论进行分析。     

警察人性化执法的合理定位及其有效保障——以袭警事件为视角

近几年来,我国各地发生了一系列暴力袭警事件,不仅严重危害了警察的人身安全,而且也是对警察执法权威和执法尊严的挑战,更是对国家法律尊严的藐视和挑衅。随着袭警事件的凸显．有关部门和学者在分析原因时认为。袭警事件频发与公安机关推出的“人性化”执法有关,应当叫停人性化执法。其实．正当的警察人性化执法非但不是袭警案件发生的原因,反而是消减该类案件发生的一项有效举措。当前,警察人性化执法之所以引起争议．并非其本身的问题,而是制度设计存在漏洞。因此,应当走出人性化执法的误区,完善警察人性化执法的保障机制．     

群体性事件处置中“慎用警力”原则研究

在处置群体性事件中,必须讲究政策、讲究策略、讲究方法,坚持“三个慎用”原则。其中,“慎用警力”原则主要适用于非警务活动。非警务活动是公安部的通知通告中出现的非正式用语。当前,我国一些地方公安机关非警务活动所占时间比例已经超越了正常的警务工作时间。应当严禁公安机关违反规定从事非警务活动。进一步规范各类非警务活动。非警务活动的形成渊源有两个：服务型警务和地方政府利益。“镇用警力”原则的具体表现为合理用警、规范用警。

Bulging biceps and tender kisses: the sexualisation of fatherhood

This article explores recent developments in masculinity, focusing on the sexualisation of fatherhood in Anglophone media. As it becomes socially acceptable for men to engage with “hands-on” fatherhood roles that had previously been primarily associated with motherhood, the appeal lies not just in this shift in gendered performance, but the representation of this as an opportunity for men to reveal a desirably body image. Where previously the hands-on fatherhood role had been glossed as “nappy changing duties,” this more recent development focuses on men’s bodies and in particular the act of carrying a young child which affords the chance for biceps to be flexed in juxtaposition with the gentle act of holding a child. Colloquially, this has led to the emergence of the “DILF,” particularly on social media where sites are devoted to photos of such men.     

Semiotising the student perception of learning outcomes in British higher education

This article presents a semiotic analysis of the student perception of learning outcomes in British higher education. It centres on three annotated images in Frank Furedi’s article “The Unhappiness Principles”, published in Times Higher Education in 2012. Drawing upon Peircean semiosis and iconicity, it provides a rhetoric-infused interpretation of the word–image complementarity exhibited in student participants’ written commentaries on the three images. This leads to a dialectical view of formative and summative assessment, in which process and product create each other through the same continuum of learning and teaching. In highlighting intellectualism as central to the ethnography of university life, this article argues that learner autonomy and the potential for transformation is deemed essential to the student experience in higher education.
