为了更加有效地预防打击公务员队伍中的腐败行为,保持公务员队伍的廉洁性,我国刑法在1988年规定了巨额财产来源不明罪,作为贪污罪和受贿罪的截堵性罪名。随着司法实践的深入,这一罪名显现出很多实体和程序上的漏洞,配套制度的建设也不能及时完善,使其在司法适用上出现很多困难。在从立法技术上对该罪名加以完善的同时,加强建设和完善相关的配套制度,才能有效地预防和打击腐败、惩治贪污受贿,为社会主义的经济建设提供坚实的法律保障。 相似文献

Despite the widespread use of mediation to resolve public policy disputes, there is little written on the mediation of judicial rule disputes. A successful mediation of a dispute over proposed court rules to govern mediation of certain family law cases involving domestic violence concerns is reviewed. The authors conclude that the mediation provided (a) a confidential venue for disputing judges to respectfully disagree with one another, (b) an opportunity for collaborative problem solving, (c) an opportunity to reduce conflict among judicial colleagues. (d) a format for dialogue with other stakeholders, and (e) greater degree of influence with regard to the outcome of the dispute. The place of women's agency in the fertility transition of the late nineteenth/early twentieth century is a contested one. Some argue that the transition was achieved mainly through male methods of contraception. Others, including many arguing from an Australian perspective, contend that women's agency in fertility decline was significant. In this article, the authors revisit the issue of women's agency in Australia. Drawing on a range of archival sources and scholarship, they seek to demonstrate that women in Australia in the last quarter of the nineteenth century had access to contraception, albeit limited, and, where that failed, to abortion. The authors argue that the changing political and educational climate, which saw women gaining the vote in 1894 in South Australia and admission to secondary and higher education and paid work, provided the setting for women's changing status. Their increasing agency – an agency many women worked to secure – encouraged women to challenge many traditional practices. 相似文献

This conclusion summarizes the evidence explaining the divergent trajectories taken by post Arab uprising states in terms of multiple variables, each illustrated by an iconic case, namely: State Failure and Competitive governance (Syria), Regime Restoration and Hybrid Governance (Egypt) and Polyarchic Governance (Tunisia). Factors include the starting point: levels of opposition mobilization and regimes' resilience – a function of their patrimonial-bureaucratic balance; whether or not a transition coalition forms is crucial for democratization prospects. Context also matters for democratization, particularly political economic factors, such as a balance of class power and a productive economy; political culture (level of societal identity cleavages) and a minimum of international intervention. Finally, the balance of agency between democracy movements, Islamists, the military and workers shapes democratization prospects. 相似文献

行业协会有一定的行政管理和服务职能,也有经费来源,故有腐败的条件。行业协会腐败形式多样,对行业协会腐败的治理措施主要是政社分开、加强监管以及对腐败活动追究行政和刑事责任。其中,《刑法》对以个人名义进行的腐败活动有相应的罪名惩处,而很多腐败活动以协会名义进行,《刑法》缺乏对这类腐败的罪名规定。要提高对行业协会腐败治理的效果,应在《刑法》中增设相应的行业协会单位犯罪的罪名。 相似文献

Literature on private regulation recognizes the proliferation of competing regulatory organizations and approaches in various industries. Studies analyzing why fragmentation arises so far focus on single‐case studies, the exploration of single variables, or variation in types of fragmentation. This article analyzes why in certain industries and for certain issues regulatory organizations proliferate, while in others a single regulatory organization emerges which covers the entire industry. Through a comparative case study of private regulation of sustainability standards in the forestry, clothing, IT‐electronics, and chemicals industries, we show how a combination of low industrial concentration, civil society involvement in governance, and stringent standards of a first‐moving regulator offer the strongest explanation for a fragmented private regulatory field, while high industrial concentration, business‐driven governance, and lenient standards of a first‐moving regulator lead to cohesive regulation. 相似文献
