就业是中国在长期发展中需要大力解决的问题 ,缓解就业压力的战略性出路就是大力发展中小企业 ,发挥中小企业在吸纳劳动力方面的巨大作用。要从战略上确定中小企业的位置 ,确定发展政策 ,贯彻实施和完善《中小企业促进法》 ,进行创新 ,解决中小企业发展中存在的问题 ,有利就业创造。     

论品牌代言人在产品侵权责任中的法律地位

最近日本SK-Ⅱ化妆品风波不断,并已有消费者就此向法院起诉,要求品牌代言人承担相应法律责任,但目前我国立法对品牌代言人的法律地位并没有明确规定,相关法律责任也难以确认.文章就日本SK-Ⅱ化妆品诉讼一案,主要从四个方面对品牌代言人在产品侵权责任中的法律地位作了分析:一、品牌代言人概念的界定;二、品牌代言人与品牌拥有者之间法律关系的确定;三、品牌代言人法律责任的定位;四、品牌代言人法律地位的确定对我们的启示.

养老保险作为需要长期缴费才能兑付待遇的险种，其稳定性与粤港澳大湾区劳动者跨境就业的 流动性产生了冲突，衍生跨境养老保险缴费年限累计与互认问题，直接关涉跨境劳动者养老保险权益的兑付。 养老保险参保是一个持续性行为，参保过程往往会涉及新旧法规交替，因此需要梳理新旧规定、整理司法判例 中的讼争要点，剖析实现跨境养老保险权益的关键障碍，通过柔性衔接的方式实现粤港澳三地养老保险制度的 协调，以“新法有利溯及”解决因新旧法规变化而导致的养老保险待遇兑付问题。     

More Protection,Still Gendered: The Effects of Non-Standard Employment Protection Acts on South Korean Women Workers

The growth of non-standard work since the Asian financial crisis of 1997 has emerged as the central political concern in South Korea. Important legislative interventions, the Non-standard Employment Protection Acts, were introduced in 2007 to protect workers from insecurity and precarity. This article investigates the effects of the Acts on women workers by comparing the employment characteristics before and after the introduction of the law. The Acts reduced the proportion of non-standard employment to a certain degree, but employers continued discriminatory practices against women workers and aggressively took advantage of more precarious forms of non-standard work. Due to severe sex segregation in the dualistic labour market, more surreptitious forms of discrimination against women workers remained intact. The results of this study point to the fact that social protection for non-standard work and more egalitarian gender relations in the labour market require a new paradigm of social rights.     

Positive engagement and support for single‐parent families: Building bridges across sector boundaries

The high rate of joblessness among single‐parent families in Australia, relative to other organisation for OECD countries has resulted in the development of various government initiatives designed to support single parents to prepare for and gain employment. The ParentsNext pilot program that began in March 2016, in 10 socially and economically deprived areas throughout Australia, is the most recent Federal Government program aimed at connecting parents with young children into local activities that will build their confidence, skills, and networks and ultimately prepare for future employment. The ParentsNext pilot program is delivered through contracted providers in each of the 10 disadvantaged areas. WISE Employment, a national not‐for‐profit organization together with its local partner, Youth Family and Community Connections, delivers the pilot program in Burnie, Tasmania. This article discusses the findings of a study, which examined the implementation of ParentsNext in Burnie and provides insights to inform and improve practice outcomes.     

Youth employment and post-war development in Jaffna,northern Sri Lanka

Jaffna District in northern Sri Lanka has recently emerged from three decades of violence and isolation, leading to a diverse array of political, social and economic issues. This article critically analyses the links between youth employment and the post-war reconstruction and development of this region. Unemployment among youth is regarded as a potential threat to the stability of the country during the post-war period, and it is argued that only through the active engagement of Sri Lanka’s youth population can the threat of a resurgence in violence be fully eliminated. The article, which is based on recent field research, examines the extent of youth unemployment within Jaffna District, and considers how government, non-government and community-based actors are working together to solve related problems.     

大学生就业协议有关法律问题研究

随着高等学校毕业生就业制度的改革,就业协议制度相继发展起来,并在大学生就业中发挥了重要作用,但在实践中也暴露出不少问题,显然与大学生就业协议定位不准有关。为此,有必要对大学生就业协议的法律性质、主体、法律效力等问题进行探讨,以期对预防和解决大学生就业中的纠纷,进而为大学生就业权益提供有效保障起到一定的积极作用。     

顺流而上还是急流勇退:我国事业单位人事关系法律定位的选择

面对事业单位人事制度改革的潮流,我国事业单位人事关系法律定位的选择何去何从,是近年来学者们关注的焦点。聘用制是目前改革中的主要制度类型,但从实际的效用进行分析,现在所推行的聘用制并没有起到预想的目的。更重要的是,统一适用劳动关系有助于改变我国事业单位准政府职能部门的地位,有利于事业单位的健康发展。同时,在法律关系选择的制度设计与适用中,我们应该注重平衡统一适用劳动关系中事业单位工作人员的劳动权益与公共利益、市场机制运营与提供公共产品的利益冲突。
