以立法与司法的良性互动促进司法公信力的提升

提升司法公信力需要立法与司法的良性互动，这要求加强三方面的工作：一是努力提高立法的科学性，为提升司法公信力奠定基础；二是努力降低立法滞后性给提升司法公信力带来的不良影响；三是努力应对法律变动给提升司法公信力带来的挑战。     

转型期中国的大众文化与传媒角色

把问题摆在全球化语境下探讨,是因为“全球化”和“信息化”的发展促进了中西方的全面交流,其裹挟而来的文化冲击也进一步促使传统中国社会发生着深刻的转型。传统文化的历史底蕴及其内含的惰性因子、商业文化的蔓生和多元价值取向共同塑造了复杂的社会文化现象。作为一个社会影响力很强的“文化装置”,媒体具有极强的“聚合力”和“辐射性”,成为文化传播的强大推动力。当下传媒的文化表现与走向在很大程度上影响着大众文化转型的未来走向。应确立一种适应现代社会发展需要的,成熟、健康的文化形态,大众媒体应当对自己所扮演的角色进行重新定位,并努力寻找出一条展现自身使命之路。     

异与同:翻译的困惑

如何对待异与同是文化视域中的翻译无法回避的难题。对于翻译实践来说,译者要有这样的文化态度,即认识到由于文化的互动发展,文化比较应该是一个客观动态的过程,从而采取适时的翻译策略。对于翻译研究来讲,论者应正确对待传统翻译理论跟西方翻译理论,着眼于理论的互动发展,避免民族性的过分张扬。     

Linkages between the Montreal and Kyoto Protocols – Enhancing Synergies between Protecting the Ozone Layer and the Global Climate

The international treaties for the protection of the ozone layer and the global climate are closely related. Not only has the Montreal Protocol for the protection of the ozone layer served as a useful example in developing the international climate regime, but policies pursued in both issue areas influence each other. This paper gives an overview of the many ways in which both treaty systems are linked functionally and politically. It investigates, in particular, the tension that has arisen with respect to the use of fluorinated greenhouse gases and the potential for drawing on the experience under the Montreal Protocol regarding data reporting and policy design on fluorinated greenhouse gases under the Kyoto Protocol to the United Nations Framework Convention on Climate Change. The potentials for enhancing synergy in these areas are explored, and related options discussed. Some initiatives for exploiting these potentials are already underway, aiming in particular at enhancing learning and exchanging of information. However, political choices concerning some of the issues willeventually need to be made, if action at the international level is to contribute to their solution.     

论熟人社会的人情

人情是农村社会的普遍现象,具有重要功能。随着现代性的侵蚀,农村人情普遍出现了异化。人情异化的程度与方式与村庄社会结构有密切关系——原子化程度高的中部农村,人情异化最为迅速。人情异化表现出来的是人情的繁荣,但当人情被榨取性利用之后,剩下的只是名实分离的人情空壳,人情循环中断,村民之间基本的人际互动难以维系,农村熟人社会失去了润滑剂,农村熟人社会甚至会因此解体。这是目前中国农村和农民难以承受之重。     

民意与法意的碰撞与耦合——以检察机关和舆论媒体的互动与应对为视角

在渐成气候的媒体时代,检察机关和舆论媒体形成了既相互影响又相互制约的共同体,因为舆论媒体有其独有特点以及检察机关与检察权的特有运行方式,导致舆论的道德法庭与检察权的独立运行之间存在一定的冲突与失范。为了寻求解决之道,应从双方互动存在可行性,舆论媒体应尊重和监督检察机关,检察机关应回馈与引领舆论,舆论媒体监督与检察权运行的辩证统一的关系等方面加以考虑,最终使检察权独立性得以维护,司法公正得以彰显,司法责任得以落实。     

谣言可信度的影响因素及其功能

谣言是一种据称是真实但没有确切证据证明的说法。影响谣言可信度的因素通常有个体所持的态度与谣言是否一致、谣言的来源是否可信、谣言传播的次数以及针对谣言举出的反例。从个体层次来说，谣言有吸引人们注意事件、还原最初的解释、激活知识结构以解决问题、增加人们探索世界动机的功能。从群体层次来讲，谣言的功能在于对模糊情境做出有意义的解释、应对威胁等。未来的研究除进一步探讨谣言及其可信度之间的关系外，需要从不同角度探究谣言在群体性事件中的发动机制及如何平息有害的谣言。     

以实战需求为原则,加强刑事技术课程的改革

课程教学改革是提高整个学科质量的基础,是培养适应社会发展需要人才的根本,为此,我们应该加大力度,全面开展课程教学改革,通过课程的教学改革来推动整个刑事技术学科的提高,这既是我们的认识,也是我们的行动,更会是我们所期待的效果。     

Robots in the cloud with privacy: A new threat to data protection?

The focus of this paper is on the class of robots for personal or domestic use, which are connected to a networked repository on the internet that allows such machines to share the information required for object recognition, navigation and task completion in the real world. The aim is to shed light on how these robots will challenge current rules on data protection and privacy. On one hand, a new generation of network-centric applications could in fact collect data incessantly and in ways that are “out of control,” because such machines are increasingly “autonomous.” On the other hand, it is likely that individual interaction with personal machines, domestic robots, and so forth, will also affect what U.S. common lawyers sum up with the Katz's test as a reasonable “expectation of privacy.” Whilst lawyers continue to liken people's responsibility for the behaviour of robots to the traditional liability for harm provoked by animals, children, or employees, attention should be drawn to the different ways in which humans will treat, train, or manage their robots-in-the-cloud, and how the human–robot interaction may affect the multiple types of information that are appropriate to reveal, share, or transfer, in a given context.     

论互动式教学方法的基本形式和特点

在我国的干部培训中,若仅采取单一的讲授式的培训方法,是难以达到培训效果的。文章结合干部学习的特点,认为选择互动式教学方法,会更有效地提高干部培训的效能;文章还对互动式培训方法的基本形式和特点进行了扼要的论述与介绍;并分析了在教学实践中使用互动式教学方法应注意的问题。
