确保俄罗斯经济竞争力的战略思考

在合理配置国家资源条件下,使用指示性计划的国际经验表明,指示性计划必须结各国具体的经济、社会和政治情况。俄罗斯在融入全球化的过程中,需要建立起符合自身条件的市场机制,处理好全球化进程中俄罗斯国民税收体系改革和人力资本问题,从而使俄罗斯摆脱沦为西方发达国家原材料提供者的危险境地。要建成国家投资和创新的发展模式,走上可持续增长的轨道,并将居民的生活质量提高到一个新的水平,从战略的角度考虑,俄罗斯需要提高国家在社会经济发展中的作用,建立起社会取向型国家的劳动和社会福利关系。

Strengthening Green Global Governance in a Disparate World SocietyWould a World Environment Organisation Benefit the South?

The debate on the advantages and disadvantages of upgrading the United Nations Environment Programme to a 'world environment organisation' (WEO) has gained momentum in both academe and politics. This article contends that a WEO would further the interests especially of developing countries, because it would provide them, first, a high-level forum to unite their individual bargaining power against the major industrialised countries. Second, a WEO would assist Southern efforts to garner international support for environmental programmes in regions and sectors that are increasingly bypassed by economic globalisation. Third, a WEO would create a locus to politically institutionalise the influence of non-governmental lobbyists in a way that increases the balance of opinions and perspectives. The article then addresses special challenges and caveats for developing countries in the upcoming negotiation process, in particular whether an upgraded UNEP would address only 'global' issues, thus absolving the international community from assisting developing countries in mitigating the more pressing local environmental issues in the South; whether the new body would have powerful sanctioning mechanisms, which might disproportionally affect developing countries; and what decision-making procedures the new body would have.     

论法典是国际私法形式价值的最佳载体

本文首先从一般意义上界定了法的形式价值,即法本身所应具有的那些值得肯定或"好"的品质.在此基础上利用比较的、历史的研究方法,重点论述了国际私法形式价值的内涵及历史变迁,作者认为法典应是最能体现国际私法形式价值的载体.     

猪源隐孢子虫感染小鼠模型的建立

应用不同醋酸地塞米松剂量和不同猪源隐孢子虫sucp株卵囊剂量建立了昆明系小鼠感染模型。结果表明,用DEX免疫抑制的感染小鼠均排出隐孢子虫卵囊,非免疫抑制感染组和空白对照组小鼠均没有排出卵囊。卵囊排出高峰期平均在感染后第5~12 d,高峰期的OPG值为5.53×105~17.97×105。组织切片和扫描电镜观察结果显示,在十二指肠、空肠和回肠都有隐孢子虫虫体寄生,其中回肠黏膜微绒毛上的虫体数量较多。合适的卵囊和DEX剂量为每只17日龄小白鼠感染10×105个猪源隐孢子虫卵囊和灌胃DEX 0.03 mg/d。     

论贿赂外国公职人员或国际公共组织官员罪

贿赂外国公职人员或国际公共组织官员罪是《联合国反腐败公约》规定的一类新型犯罪。对这一犯罪,可以从贿赂对象、贿赂范围、贿赂对价、贿赂方式和贿赂领域五个方面加以理解。我国刑法在规定这一犯罪时,应注意刑法与《公约》的协调,立法上注意与我国刑法中“国家工作人员”概念之转换,司法上注意与国外贿赂犯罪的规定相协调;刑事管辖权上应当以属地管辖原则为主,辅之以属人管辖;法定刑的设置应以有期徒刑为处罚方式,并可以适用罚金刑。     

反思帕卡的犯罪控制模式与正当程序模式

美国学者帕卡的犯罪控制模式与正当程序模式对我国的理论研究和立法实践都产生了深远的影响。但帕卡的学说还是有不足之处 :忽视了被害人的存在 ,也没有意识到对犯罪除了运用国家的刑罚权外 ,还有大量的私力救济以及官方的非正式惩罚与预防行为 ;在诉讼模式与具体制度的设计上 ,犯罪控制模式与正当程序模式学说过于强调了二者之间的对抗 ,而没有注意其相互统一和兼容之处。帕卡学说对我国的启示体现在 :学界过于强调了职权主义与当事人主义之间的差异 ,对它们在侦查制度上共同之处的研究失之准确 ;刑事诉讼法的再修改应该以职权主义模式为主 ,适当借鉴英美当事人主义中的合理因素 ;对犯罪嫌疑人、被告人与被害人的利益应该同等尊重 ,保障被害人参与诉讼过程并影响判决结果的权利     

对女性就业困境的思考

在体制转轨过程中 ,女性面临的就业形势越来越严峻。她们面临着职业进入、工作升迁和培训以及再就业困难等多方面的不利环境。由此表现出的某种程度的歧视有其产生的历史和现实背景。随着劳动力市场的不断规范 ,未来更加注重人力资本积累而非注重性别的大趋势也许会为陷入就业困境的女性指明了出路     

Zwischen Kultur und Kalkül? Vertrauen und Sozialkapital im Kontext der neoinstitutionalistischen Wende

Trust and social capital work in social networks as informal institutions, favouring cooperation between the participants of such social interaction. However, the increasing use of both terms has been accompanied by vanishing conceptual and theoretical precision. In order to counterbalance this development this article tries to clarify some of the major puzzles connected with both terms. First, we embed trust and social capital within the institutionalist turn in political science. Second however, we demonstrate that trust and social capital have been modelled from at least two perspectives: sociological institutionalism and economic institutionalism. Furthermore, attempts of combining those approaches have lead to decreasing theoretical consistency. Finally, we propose that economic institutionalism is theoretically and empirically more fruitful to explain the creation and destruction of social capital.     

社会资本理论剖析

社会资本理论作为一种新兴的资本理论受到了经济学家和社会学家的高度重视。社会资本理论的分析方法实质上是经济学方法论的回归。这一理论的体系和结构主要可以从社会资本的定义、内容、性质和结构等方面采把握。社会资本对我们的经济发展具有重要的影响,既有积极的一面也有消极的一面。当前这一理论研究的难点和不足主要集中在:社会资本的度量、社会资本的投资和积累、社会资本的结构变迁以及社会资本与产权归属等问题上。
