Around half a million cycle rickshaws are currently active in Dhaka, Bangladesh. With only 86,000 official licenses available, different types of organizations supply licenses to most rickshaw drivers. These non-official licenses mimic the language of the state. This article argues that while these licenses appear as part of non-state, hybrid, or twilight institutions, they in fact constitute a state practice. Based on approximately 200 semi-structured interviews at six locations in Dhaka and offering a conceptualization of the Bangladesh state as a party-state, the article shows that the operation of non-official rickshaw licenses and the mimicry entailed is an inherent part of party-state governance, one which is not morally neutral. While most respondents saw the everyday benefits of non-official licenses in the absence of sufficient official ones, the latter remained the most prized and, if made available, respondents agreed that the former would become redundant. 相似文献

Institutional theory of law (ITL) reflects both continuity and change of Kelsen's legal positivism. The main alteration results from the way ITL extends Hart's linguistic turn towards ordinary language philosophy (OLP). Hart holds – like Kelsen – that law cannot be reduced to brute fact nor morality, but because of its attempt to reconstruct social practices his theory is more inclusive. By introducing the notion of law as an extra-linguistic institution ITL takes a next step in legal positivism and accounts for the relationship between action and validity within the legal system. There are, however, some problems yet unresolved by ITL. One of them is its theory of meaning. An other is the way it accounts for change and development. Answers may be based on the pragmatic philosophy of Charles Sanders Peirce, who emphasises the intrinsic relation between the meaning of speech acts and the process of habit formation. 相似文献

The 1990s witnessed Supreme Court decisions in both Canada and the United States on issues of competence that went against longstanding case law, psychological research, and common sense. These decisions held that there is to be one standard for all types of criminal competencies. The present research attempts to investigate whether this is an appropriate assumption and thus tests whether there are one or more constructs that underlie different types of competence. Two divergent types of competence were examined, competence to stand trial (both Canadian and American conceptualizations) and competence to consent to treatment, to determine if these different types of competence share a common underlying construct. Confirmatory factor analysis was used to test this question and results indicate that there is a common construct that underlies different types of competence. 相似文献

AbstractThe study of identities struggles to capture the moments and dynamics of identity change. A crisis moment provides a rare insight into such processes. This paper traces the political identities of the inhabitants of a region at war – the Donbas – on the basis of original survey data that cover the four parts of the population that once made up this region: the population of the Kyiv-controlled Donbas, the population of the self-declared “Donetsk People’s Republic” and “Luhansk People’s Republic,” the internally displaced, and those who fled to the Russian Federation. The survey data map the parallel processes of a self-reported polarization of identities and the preservation or strengthening of civic identities. Language categories matter for current self-identification, but they are not cast in narrow ethnolinguistic terms, and feeling “more Ukrainian” and Ukrainian citizenship include mono- and bilingual conceptions of native language (i.e. Ukrainian and Russian). 相似文献
