医事法(又称卫生法)究竟是属于民法的调整范畴还是属于行政法的范畴,对此,国内学术界争议民大.本文从医学科学与医疗行为的本质特征入手,揭示了医患关系拜不具备民事法律关系所必须具备的主体平等、双方自愿及等价有偿互惠互利三大特征中的任何一个特征,同时也不存在行政主体与行政相对人的关系.为此,文章首次提出了医事法既不调整横向的民事法律关系,也不调整纵向的行政法律关系、而是调整斜向的医事法律关系的一门独立的法律体系的理论.并根据医患关系的特征,得出了处理医患纠纷案件的特有原则与规则,为指导医患纠纷的公正处理,提供了理论依据. 相似文献

Recently, several new pieces of water legislation have been promulgated in both Zimbabwe and the Republic of South Africa. The new acts are an attempt to correct injustices of a colonial past and to trigger development towards effective, equitable and efficient integrated water resources management influenced by the policy decisions in Agenda 21 and the need to respect economic and social human rights. This article aims at identifying and describing factors of prime importance in the process of legal and institutional reform. Major factors are earmarked and derived from the proceedings in Zimbabwe and are compared with the situation in South Africa. Thorough analysis by the author of proceedings, preambles, memoranda, legislation and addenda has induced roughly 5 major reform issues: The call for equitable water distribution based on a widely consented water resources management strategy; The need for effective and efficient integrated water resources management conducive to stakeholder participation through decentralisation processes; The redressing of legal shortcomings in former water legislation with the emphasis on the introduction of integrated approaches; The introduction of instruments of cost recovery for water resources management; The need to develop human resources capacity and institutional strength within the implementing agencies.For both Southern African states, these issues appear to be of comparable importance as major triggers for legal and institutional reform, although not always in the same sense.The resulting most important legal and institutional changes are presented, discussed and compared. Finally, prospects for and constraints on implementation of the new water legislation in these countries are compared. 相似文献

Over the last two decades the public sector has embraced new modes of service delivery, with a shift away from traditional face-to-face provision towards Internet and telephone based advice and information. While telephone provision has played an increasingly significant role in overall provision of legal advice in recent years, there has been limited empirical research which compares telephone to face-to-face services. Utilising administrative data from the Legal Services Commission (LSC) on legal aid services for housing problems, this paper explores the similarities and differences between the two delivery modes. We examine the client groups and matter types which tend toward particular channels of advice, the relationship between mode of advice and the outcome of cases for clients and the relationship between mode of advice and advice time. We find that there are significant differences in mode of advice among clients with particular demographic characteristics, with clients under the age of 18 and clients living with an illness or disability more likely to use face-to-face services. Our findings also suggest differences among the types of problems being addressed by telephone based services. On the surface there are small differences between modes of advice and the proportion of cases which lead to a substantive benefit outcome. However, once we disaggregate the data and investigate specific outcomes, there are pronounced differences in the outcomes achieved. Having controlled for key variables such as client demographics, case type and particularly stage reached, we find that telephone advice takes, on average, 14 minutes longer than face-to-face advice (compared to an hour less when examining the raw data). The implications of these findings for the future development of telephone based services in light of current policy in legal services are discussed. 相似文献

Abstract The government's current review of child representation suggests the administrative amalgamation of the court welfare and guardian ad litem services, and seeks consultation on the extension of children's rights under section 64 of the Family Law Act 1996. It also aims, overall, for ‘efficiency savings', the implication being that work is currently being done and roles performed unnecessarily. In the light of these questions, this article constructs the current systems for implementing children's rights in family proceedings, in both the public and private law contexts, to analyse the overall mechanisms by which the legal process ensures the child's potentially conflicting rights both to representation as an individual with personal views and also to welfare, which is an all-pervading but not necessarily easily discoverable end. The interaction between personal rights to representation and the overall right to welfare has not been resolved at the level of theory or in practice and the project of children's rights risks abdication. Given that there is considerable overlap between the public and private law processes at the factual level, the forms of the process should be considered together to construct a system which functions overall; all the more so, as the government proposes to amalgamate the very different services which currently operate in each process. The search for the most satisfactory mechanisms requires clear statements of both the aims of the process and of the difficulties of practice, whether they be cultural resistance to legal rights within the private family or a lack of resources to implement ideals of justice for the family. 相似文献
