以刑制罪:刑法教义学与刑事政策学相互贯通的路径选择

刑法教义学与刑事政策之间不仅是宏观的关系构造,还有微观的勾连论证,尤其是后者,在风险社会背景下具有更加重要的理论价值和实践意义。刑法刑事政策化是我国刑法教义学的发展方向,为了推动刑法教义学与刑事政策从相互隔离到相互融通,就需要在刑法理论上为政策要素进入刑事教义学构建合适路径。在消弭刑法教义学与刑事政策学李斯特鸿沟的过程中,以刑制罪司法逻辑具有特殊的价值和意义。     

邓小平效率公平思想的当下解读

"效率优先,兼顾公平"没有全面准确地体现邓小平同志的思想和党在分配问题上的指导原则。"效率优先,兼顾公平"尽管促进了社会财富增长,但也导致了居民收入差距扩大,使社会公平问题日益凸显。只有倡导"兼顾效率与公平"的理念,加强正确的政策引导,坚持高尚的价值导向,强化对非正常因素的调控,才能真正实现效率与公平的辩证统一,真正实现社会的进步与发展。     

"战略时间差"与中国的战略安全

国际关系中的时间包括时间点、时间段和时间过程。从国际博弈的时间长度来看,既有宏观时间的博弈,也有微观时间的博弈,二者都有可能产生战略性的影响。纵观古今中外历史,把握“战略时间差”虽然不一定能做到“不战而屈人之兵”,但能够做到以更小的代价获得博弈的优势地位。中国的战略安全是与战略机遇期联系在一起的,过去四十多年中国发展和大国成长战略机遇的获得主要由于技术革命、权力转移和西方的战略失误三个因素,但中国在新时代需要主动通过把握和运用“战略时间差”来塑造战略机遇。从总体战略来看,中国仍然需要争取和平的国际环境,以彰显中国在走向世界舞台中央时的世界担当;要尽力争取所有的国际博弈尤其中美博弈为正和博弈,以化解既有主导国对正在崛起的中国的担心和不信任;关键还要着力中国的内部发展,这是获得战略机遇期的实质性内容。把握所有“战略时间差”的最终目标是实现中华民族的伟大复兴,在世界舞台上和平崛起。     

Sickle cell trait-associated deaths: a case series with a review of the literature

This study presents a series of 16 carriers of hemoglobin S (HbS) who died during various circumstances. Many of the cases were associated with mild to moderate exertion. The onset and/or duration of symptoms varied from a few minutes to several hours with many displaying a prolonged lucid interval with stable vital signs. Despite seeking medical treatment, sickle cell trait-related micro-occlusive crisis was never considered in the differential diagnosis. Several cases were associated with sudden death. In those deaths which were delayed, high anion gap and uncompensated metabolic acidosis were typical and were not heat related. Also characteristic were large increases in creatine kinase, alanine aminotransferase, and aspartate aminotransferase along with myoglobinemia. Although the antemortem diagnosis of rhabdomyolysis was made, the underlying cause was never deduced by the clinicians. The sickling found at autopsy is not always a postmortem artifact, and in the right circumstances can be diagnostic.

面对当今社会贫富分化严重的现实,适时推进收入分配制度改革,已经成为全社会的共识。本文认为,收入分配制度改革应在个人所得税、启动财权事权重新配置的财税体制、打破行业垄断、解决社会保障和公共服务分配不均问题方面有所突破。     

新时期居民收入差距刍议

尽管我国GDP的总量连年快速增长,但居民之间的收入差距却越来越大,如果不很好地解决这个问题,将严重影响改革开放的成果甚至影响社会稳定。因此,缩小地区、行业、城乡之间的差距,走共同富裕的道路,是当前各级政府亟待解决的问题。     

Electoral losers revisited – How citizens react to defeat at the ballot box

The paper seeks to reconcile insights from winner-loser gap research with mainstream understanding of election legitimacy. The paper acknowledges that winning and losing elections creates differential incentives for citizens to remain supportive of their political system, but it argues that losers nevertheless have enough reasons to remain supportive in absolute terms. Drawing on democratic theory, the paper develops a rationale for why citizens are willing to accept electoral defeat voluntarily, and suggest a new way to conceptualize citizen reactions to election outcomes. It presents findings from a sample of election studies in established democracies to show that winners typically become more supportive whereas losers at minimum retain their level of support from before the election. It concludes that elections, when reasonably well executed, as they most often are in established democracies, build system support rather than undermine it.     

Assessment of the Service Quality Provided by the Kuwaiti Cultural Office in Cairo: An Empirical Investigation

This study is an extension of the research on the service quality of public organizations. It is concerned with evaluating the quality of the service provided by the Kuwaiti Cultural Office in Egypt as perceived by both students and staff. The gap analysis model is adopted in this study to identify the key dimensions and related components of the quality of service delivered by the Office. Additionally, the study offers evidence of a quality gap between the perceptions of the public service providers and the end beneficiaries. The findings reveal that there are obvious differences between the staff's and students' perceptions of the quality of the service provided by the Office in terms of tangibles, reliability, and responsiveness. The students indicate that the service provided has many shortcomings, related mainly to the tangible aspects of the service reliability and responsiveness. However, they feel secure in dealing with the Office, and feel the administration and employees consider their interests a top priority to the Office.     

A Miserable Little Compromise? Exploring Liberal Democrat Fortunes in the UK Coalition

At the half way point of the UK coalition government attention is turning towards the general election, with both parties beginning to contemplate their electoral strategies. This article explores the predicament faced by the Liberal Democrats who, unlike their coalition partners the Conservatives, saw a dramatic decline in support soon after entering government. By exploring a collapse in trust, an apparent identity crisis, and the party's questionable influence, this article seeks to explain the Liberal Democrats' current polling situation and highlight the serious barriers to retaining, yet alone extending their constituency of voters at the 2015 general election.     

A New Look at the Gender Gap in Offending

Studies of public support for capital punishment have consistently observed a strong and enduring gender gap in the level of death penalty support, with males consistently more inclined than females to support capital punishment. This unexplained relationship has endured over time and space as well as across a myriad of research designs. The present study uses attribution theory in a factorial survey design to account for this relationship. Analyses of data obtained from jurors provide mixed support for attribution theory yet fails to bridge the gender gap in death penalty support. The implications of these findings as they relate to gender, socialization, and attributions are discussed.
