论公司社会责任的性质与理论基础

对公司社会责任的争议以及对公司社会责任性质的争议很多,但主要集中在其为法律责任还是社会责任这一问题上。对某一事物性质的界定,必须在特定的框架内来讨论才有意义。公司的社会责任是一个超出了法律规定范围的广义的综合概念,同时也是一个随着企业与社会相互关系的动态发展而不断发展变化的范畴,其产生和发展均有一定的理论基础。

国际投资仲裁中的精神损害赔偿——以ICSID“沙漠道路工程公司诉也门”仲裁案为分析对象

解决投资争端国际中心在沙漠道路工程公司诉也门案中,首次明确肯定了东道国因违反双边投资协定,应当向投资者承担精神损害的赔偿责任。根据案件的实际情况,该裁决具有一定的合理性。但是,在仲裁庭的管辖权、精神损害赔偿责任的构成要件,以及东道国赔偿责任的法理基础这些关键问题上,ICSID仲裁庭的分析和说理存在较大缺陷,从而削弱了该案裁决的正当性和影响力。

城市化是当代人的遭遇,也是道德教育的遭遇.城市是一个陌生的世界,城市里充满着陌生人.陌生的都市人有两副面孔,一副是自由与理性,一副是冷漠与孤独.在一个城市主导人类生活的时代,教育不能没有城市精神,又不能迁就城市伦理.在适应城市生活的同时,超越陌生人伦理,是道德教育的当代使命之一.     

Deliberative citizenship: a critical reappraisal

ABSTRACT

The study of citizenship as a political or moral ideal involves identifying core commitments and capabilities, the cultivation and exercise of which is often presented as a condition of being a ‘good’ citizen. Deliberative democracy was, at least until recently, associated with a conception of citizenship that endorses those qualities that equip us for a certain kind of respectful and reflective dialogue. This article reappraises this conception in light of the so-called ‘systemic turn’ within deliberative theory. It shows how systems thinking has displaced the traditional conception of deliberative citizenship, but that theorists have so far not elaborated a satisfactory replacement. A pluralist model is thus proposed, which casts light on the diverse qualities that a range of actors in a deliberative system might require. The resulting argument is not merely of interest to deliberative theorists, but to all who are concerned with the ethics of citizenship. The main reason is that it displaces the entrenched notion of a ‘good citizen’, in favour of the more heterogenous ideal of a ‘good citizenry’.     

An Examination of Bullying Roles and Moral Disengagement Using Latent Analysis

ABSTRACT

Bullying persists as a concern in schools, including the question of why some children bully. One idea differentiating bullying roles (e.g., bully, victim, bully-victim) is that some individuals are morally disengaged, or able to disconnect their moral understanding and behavior. The present study examined types of bullying involvement and moral disengagement. To address the methodological debate within the bullying literature, the present study used latent analysis. The findings revealed that bullying and victimization behaviors vary by degree of involvement. The present study found that moral disengagement was related to students’ degree of participation in bullying; students in the bully-victim class had the highest levels of moral disengagement, followed by students in the victim class, social victim class, and outsider class. Further research should explore moral engagement as a strategy to enhance anti-bullying efforts.     

认知心理学视野中的道德灌输反思

道德灌输在当今中国道德教育中几乎成为众矢之的,不少人利用西方的＂反灌输论＂来批判我国的道德灌输。而认知心理学恰恰为重申道德灌输的必要性提供了一个全新的视角：从皮亚杰认知发展理论的角度看,道德灌输是道德认知与学习过程的基础与动力,同时儿童认知阶段的发展也决定了道德灌输的必要性;从信息加工理论的角度看,知识类型的递进关系以及记忆的结构都说明了道德灌输的重要性。
