警察权力行使中的隐私权保护研究

2011年发生的“高速不雅照”事件,引起了舆论关于“电子眼”与个体隐私保护的争论。对于公安机关来说,诸如非法窥视、监听、披露私人活动,非法收集、使用、公开私人信息,非法搜查、监视、监控私人空间等现象非常普遍,但人们更多关注人身自由权、生命健康权、财产所有权等基本权利。随着社会的发展,个人自主意识的增强和国家公权力的扩张,制约和防范国家公权力以保障公民的隐私权具有突出的现实意义和法治价值。我国的《个人信息保护法》已于2005年启动了立法程序,这种通过从政府掌握的私人信息的保护入手是一种重点突破的做法,立法内容的重点应该放在对政府机关的规制上。

我国西部民族地区战略地位重要,它的发展对整个国家的经济和社会发展有着举足轻重的作用。从2000年开始的西部大开发战略实施以来,整个西部地区发生了翻天覆地的变化,城市化进程加快,工业化迅速发展,生产总值在全国经济的占比越来越重。经济的发展带来日益严峻的环境问题,尤其是在西部民族地区,由于其特殊的自然地理条件和社会历史原因,环境问题的处理成为其在追赶经济的过程中不可忽视的一环。     

民间法话语在中国的命运与知识引进运动

民间法话语在中国的命运与西方知识引进运动是紧密地勾连在一起的。虽然“圜道”秩序生成模式和政治主导型秩序生成模式构成原理不同,但都不存在国家法与民间法对立问题,民间法话语被构建、衰落和兴趣都与西方知识／理论在中国、中国开展的民族国家构建和现代化建设紧密地联系在一起。对民间法话语在中国命运的研究,反映出来的是中国现代化建设、社会变迁与话语力量的发展的内在逻辑和规律。     

The Challenges to Promoting Collaboration Between Child Protection Services Workers and Court Professionals

Abstract

In juvenile dependency proceedings, the protection of children depends upon the collaboration between professionals in the child welfare and court systems. Since there is little empirical research on such collaborations, this exploratory study sought to identify factors associated with the difficulties encountered in these professional relationships through an analysis of case records. The data were extracted from 111 cases in seven Northern California counties. Using a logistic regression it was found that the short tenure of court professionals is significantly associated with the difficulties of fostering inter-professional collaboration. The implications for future practice and research are identified.     

乡村社会的民间法与纠纷解决--来自河北保定冀北村“招墓角”家庭纠纷的调查

河北省保定市冀北村至今还保留着"招墓角"这一民间婚姻风俗。笔者通过对该村"招墓角"家庭纠纷的调查发现,从表象上看,人民调解成为了该村解决民间纠纷的主要方式,国家法似乎有了某种"失灵"的迹象。因此,必须客观认识民间法在乡村纠纷解决中的特殊地位及其与国家法之间的关系,二者虽然存在着结构性断裂,但也有着共同的逻辑基础。在当今文化多元化、纠纷多样化的乡村社会,应当构建适合乡村社会自身特点的以人民调解为基础的多元化纠纷解决机制。     

Child Welfare and the Courts

ABSTRACT

This exploratory study focuses on the relationships between professionals working in the juvenile dependency system, including judicial officers, attorneys, social workers, and court-appointed special advocates. It includes an examination of the quality of professional relationships, factors contributing to tensions, the consequences of difficult relationships, and strategies for improving relationships. It utilizes interviews and focus groups with professionals and focus groups with clients involved in the juvenile dependency system. The major findings address: (a) the nature and quality of professional relationships, (b) the structural and operational factors contributing to tension in those relationships, (c) client perceptions of professional relationships, and (d) respondent recommendations for improving professional relationships. This study is a contribution to the small but growing literature on the complexity of the interface between public child welfare services and the court system.     

Strategies for Empowering the Child Welfare Administrator Facing Class Action Litigation

ABSTRACT

Class action litigation is a current, or imminent, reality in many public child welfare agencies. Over the past three decades, advocates have increasingly used lawsuits to leverage reform in systems they viewed as ineffective in protecting and promoting the welfare of children. Too little guidance has been offered to administrators confronted with litigation. This paper proposes a set of strategies for administrators as they respond to actual or potential lawsuits. An overview of the litigation process is included, as well as a series of issues to be considered by the administrator and the consulting legal team when an agency or jurisdiction is anticipating or facing a suit.     

The factory and the welfare state: redundancy,benefits and workers’ organization at Alfa Romeo Arese, 1963-1986

ABSTRACT

The article tracks the relationship between the Italian welfare state and the social relations of production at a Fordist factory, showing how social policy influenced the pattern of workers’ contention on the industrial shop floor. Welfare state analysis has concentrated on the institutional aspect of social policy but neglected the role that state benefits played in industrial organization and workplace relations. The article ‘nests’ the analysis of social policy in a micro-history of the factory, using the case study of Arese – a plant owned by the carmaker Alfa Romeo – Milan, Italy. Tracking the history of Arese, the article shows how the Italian system of short-time work subsidies, the Cassa Integrazione Guadagni (CIG), served to quell industrial unrest and target unions’ organizational resources. From the late 1960s, the CIG was used by managers to suspend workers during strikes and acted as a deterrent against their mobilization. As redundancies increased during the 1980s, workers were put on short-time for prolonged periods and prevented from entering the factory. This degraded their professional identity and eroded their political ties with the workplace, curtailing the basis of unions’ organizational strength within the factory.
