Global Television News and Foreign Policy: Debating the CNN Effect

This study investigates the origins and development of the cable news network (CNN) effect hypothesis. It reveals an ongoing debate among politicians, officials, and journalists who are involved in the political processes that this hypothesis attempts to explain, and also among scholars who have been studying it. Debates have been conducted both within and among these groups on the meaning and validity of the CNN effect, but none has contributed significantly to resolving the issue. On the contrary, these debates have presented contradicting statements that have only created confusion and misunderstanding. This study presents lessons from the decade-long effort to explore the CNN effect and projects a new agenda for more useful approaches towards different effects of global communication, apart from those covered by the present controversial hypothesis.     

“媒体审判”的防治

从比较法的视角出发,通过对中外相关法例的比较考察,立足于我国的法治实践,分析了媒体审判与树立司法权威的关系,并且指出:对于确保司法公正来说,在法律制度的层面上,新闻自由与司法独立都具有基础性的价值,关键在于如何界定两者的界限使得彼此能够尽可能的和谐共存,并由此对界限之内的新闻自由予以更加有力的保护,对超出界限之外的不当报道和评论加以有效防治。在合理界定媒体自由报道和评论司法的界限时,应当综合考虑以下三种关系的平衡:其一是维系司法权威的成本与收益和保障新闻自由的成本与收益的平衡;其二是新闻自由权利与获得公平审判的权利之间的平衡;其三是国情与公理的平衡。     

事实与价值的统一——对“真实是新闻生命”的思考

本文从价值哲学和逻辑学的角度,对“事实”理论作了全面系统的考查和分析,强调指出“事实”是主体对客体进行价值评价的过程,是主体能动性的表现,从而为“真实是新闻生命”这一基本观点提供了理论基础;本文还联系法新闻实际,指出法新闻工作者要在尊重法律“事实”的基础上,充分发挥新闻舆论监督的作用,做到尊重法律“事实”与发挥主体能动性的统一。     

论舆论监督法治化语境下的新闻自律

新闻自律是舆论监督法治化语境下对新闻工作者提出的基本要求。即正确的角色认知是新闻自律的自觉性前提；合理的道德价值取向是新闻自律的伦理基石；科学的新闻职业精神是新闻自律的内在动力。     

Improving Democratic Discourse in UK General Election and Referendum Campaigns

This article is a short overview of the recently released report entitled Doing Democracy Better published by the Constitution Unit based at University College London. The report makes a series of interesting and useful observations about the health of democratic discourse within the UK and advances a selection of recommendations for its improvement. Whilst noting the value of the report as a piece of substantive research, there are a number of further questions which need to be addressed. As such, this report should be seen as the starting point of a broader discussion that takes a more nuanced approach to improving democratic discourse and a less London‐centric approach to conceptualising the UK's political institutions and language.     

In the Shadow of Brexit: The 2019 European Parliament Elections as First‐Order Polity Elections?

European Parliament (EP) elections have traditionally been described as ‘second‐order national elections' in which campaigns are fought by national parties on national issues. We argue that the 2019 elections should instead be considered ‘first‐order polity' elections. It is not EU‐level party politics or policy issues that are debated, but rather the legitimacy of the EU itself. Firstly, the EP elections have transformed into an EU ‘blame game' in which national governments are punished or rewarded over their stance on European integration. Secondly, the 2019 election was about the EU's fundamental values, not only with respect to multiculturalism, but also gender equality and LGBTQ rights. Finally, these first‐order polity elections are driven in large part by traditional news and social media platforms. While this is a long way from the patterns of the early EP elections, they still fail in fulfilling the function of holding MEPs and European party groupings adequately to account.
