宗族势力举兴起的原因及农村稳定作用之思考

农村宗族势力目前呈膨胀之势,其原因一是能补社会救助功能之不足,二是能满足农民“本体性”需求,三是国内外环境的影响,四是厚重宗族文化积淀之折射。宗族群体的兴起给农村社会治安带来了某些负面效应,但如果有关部门不视其为“异端”,努力使其与社会主义事业整合,定期对族房长培训学习,责成其管好族人,则不仅可大大减轻政府工作量,改善形象,还将有利于农村的综合治理。     

我国行政强制法对司法的影响初探

法律保留、比例、程序正当是行政强制法的基本原则,正确认识和掌握这些基本原则是有效实施这部法律和探讨对我国司法影响的前提和基础。行政强制法的制定和执行将对规范我国的行政审判工作、完善司法赔偿工作及强制执行产生重大的影响。     

Corporate power in Australian policy making: The case of unfair contract laws

There is increasing concern about the impact of corporate power on Australian policy making. This article examines the dynamics of corporate influence by examining the battle between big business and small business over “unfair contract” laws. It explores whether big business exerted disproportionate power, and if it did whether it was structural, ideational, or instrumental power. It finds that while recent scholarship has been focused on structural and ideational sources of power, there is strong evidence of a narrowly conceived instrumental power exerting considerable influence within both of the major parties. Further, it concludes this form of instrumental power presents the most serious threat to democratic policy making.     

Republican democracy and compulsory voting

In this article, I focus on Chapters 4 and 5 of On the People’s Terms, chapters that deal with democratic influence and control. I take an applied political science approach to how Pettit’s republic might be practically achieved by exploring the under-appreciated capacity of elections to mobilise the resistance-prone, contestatory public upon which his republicanism depends. Whereas Pettit tends to focus on public contestation between elections and only demands that the public has the opportunity to vote when elections are held, I argue that they should be given a more prominent role within his republic and further, that access to voting is not enough: rather, citizens should actually vote. In order to ensure that participation is socially inclusive and that the public’s attempts at influence are ‘individualised’, ‘unconditioned’ and ‘efficacious’ in the manner Pettit desires, I suggest that compulsory voting should be a major pillar of his republicanism.     

印度对南海争端的介入及其影响评估

冷战后,随着国际格局的调整,印度在对外战略上实行了＂东进＂政策,试图通过发展与东南亚国家的经济、军事安全等方面的合作,为其大国理想的实现奠定基础。在＂东进＂政策下,印度逐渐以联合军演、出售武器等方式介入到南海争端中,给本来就复杂的南海争端增添了变数。本文对印度介入南海争端的原因、手段做探索研究,并对其影响做出评估,以期为我国的南海争端对策提供参考。

NEIGHBORHOOD CONTEXT AND NONLINEAR PEER EFFECTS ON ADOLESCENT VIOLENT CRIME*

Although evidence of the strong correlation between deviant behavior and exposure to deviant peers is overwhelming, researchers have yet to investigate whether a nonlinear functional form better captures this relationship than does a linear form. Researchers also have yet to examine the extent to which peer effects vary as a function of the neighborhood context. To address these issues, we use data from the Project on Human Development in Chicago Neighborhoods (PHDCN) to examine 1) the functional form of the relationship between peer violence exposure and self‐reported violent crime and 2) the extent to which the effect of exposure to violent peers on violence is ecologically structured. Estimates from logistic hierarchical models indicate that the effect of peer violence exposure on violent crime decreases at higher values of peer violence, as reflected in a nonlinear relationship (expressed in terms of log‐odds). Furthermore, exposure to violent peers increases along with neighborhood disadvantage, and the effect of peer violence exposure on violent crime is attenuated as neighborhood disadvantage increases, which is reflected in a cross‐level peer violence/disadvantage interaction.     

道家抵制科技的根源及其积极影响

道家对科技的态度是抵制的,这种抵制根源于科技"有为"与道家"无为"的冲突及科技"有欲"与道家"寡欲"的冲突。透过道家抵制科技的表象,可以看到道家对科技的积极影响,即其在理论实质上对客观规律的肯定,在技术上对"技进于道"的升华,在科学技术应用上对"人与自然和谐"意识的推动。     

论网络舆情对政府制定公共政策的影响

当前我国处于网络信息新时代,网络舆情是政府了解民意的重要渠道和方法,对于民意的征求也应适当地采取网络投票、提问等方式。网络传播方式已成为我国公众表达利益诉求、维护自身权益的重要公共平台。因此,网络舆情对政府制定决策有着重要的影响,同时伴随着很大的压力,并且网络舆情的积极作用与消极作用并存,所以网络舆情状态下政府如何制定好公共政策成为考验政府能力的一个挑战。

以保险法和海商法理论为指导,借鉴国外立法和司法实践,从确定告知义务的角度、广度、深度以及维度,对投保人或者被保险人的告知义务进行了全方位的研讨,力求对告知义务进行一个立体化的解析,以达到准确使用法律之目的。
