从“议行合一”走向“议行分立”

议行合一制作为我国国家政权的组织原则之一,有其学理上的合逻辑之处。中国的国家政权的组织原则基本符合马克思针对巴黎公社所论述的议行合一制。这一制度固有的弊端以及其在实际运行过程中所暴露出来的问题昭示我们:从“议行合一”走向“议行分立”,已是大势所趋。     

Politics of on-demand food delivery: Policy design and the power of algorithms

In this article, we examine the politics of on-demand food delivery using insights from the theory of social construction and policy design. On-demand food delivery is a service built on algorithm-based technology known for its precarity and physical risks for couriers. We compare how the on-demand food delivery sector is regulated and its observable effects in two Asia-Pacific cities with contrasting food courier profiles: Melbourne, Australia (international students), and Singapore (citizens, permanent residents). We show how the social construction of food couriers in other policy subsystems (migration, higher education, citizenship) affects debates of their fair treatment in the on-demand food delivery sector. By interrogating the politics of digitally enabled versions of reality, we argue for embracing a design perspective to identify how reforms could be introduced in change-resistant sectors.     

Early epidermal changes in heat- and electrically injured pig skin. II. An electron microscopic study

In order to find methods applicable for disclosing electrical torture, pig skin was exposed to heat and electricity under controlled circumstances. Biopsies for electron microscopy were obtained immediately after exposure. In heat lesions the nuclei were slightly distorted, sometimes with broken nuclear membranes. The tonofilaments were clumped, intracellular oedema was present and cell membranes were ruptured between desmosomes. In electrical lesions the nuclei were usually enlarged with strongly condensed chromatin. Some nuclei were composed of fine, evenly dispersed granular material. The cytoplasm appeared homogeneous, in large magnification finely granular. Cell borders could sometimes be identified located in situ. In the stratum corneum, which appeared normal in heat lesions, single or several cells or large areas had an electron-dense appearance. The difference in ultrastructure of heat and electrical lesions makes it probable that electricity has a specific action on epidermal cells.     

东亚安全结构中的日本及其战略选择

随着冷战的结束和中国的和平崛起,日本在东亚地区的战略选择正处于至关重要的十字路口。进入21世纪以来,日本国内精英层对东亚安全中日本的定位基本上可分为三个派别:"现实主义派""东亚共同体派"和"脱离对美从属派"。日本国内精英界有关东亚战略选择的讨论也呈多元化的趋势。在官方层面,自2012年上台的安倍政权的战略选择徘徊于"对美从属"和"自主独立"之间。值得注意的是,日本国家战略的具体落实往往受到其国内政治、美国的态度和其自身文化思维——身份认同和非理性因素的制约未来日本的战略走向,将取决于美国在东亚地区的实力消长、日本国内政治的变化以及日本自身对其身份认同的调整。     

马克思的"世界历史"理论与全球化

100多年前,马克思主义经典作家就对全球化作出过科学的预见。他们所揭示的人类社会生活“世界性”和“国际化”,与当今的“全球化”有着内在的、必然的联系。只有将马克思主义的基本原理与当今全球化的具体实际相结合,才能确立全球化的科学理论和应对之策。     

FDI in small states and unattractive markets: the case of São Tomé and Príncipe

ABSTRACT

Studies on Small States, ‘unattractive’ markets, namely those from Africa, are very scarce. São Tomé and Príncipe (STP), a Small State, insular economy, has had considerable momentum in attracting FDI in the last decade albeit its geographical and demographic constraints and relative weak economic growth. The current study uncovers the potential determinants of FDI in unattractive markets using STP as a case study. Based on (robust) logistic estimations on a sample of 56 Portuguese companies that have trade relations with African countries, we show that in the case of Small States economies and unattractive markets, the relevance of institutional factors and resource seeking strategies surpass internalisation and location factors related to market size and dynamics. We further uncovered that foreign companies’ characteristics, namely size and (general) human capital, are critical in explaining companies’ likelihood to invest in an ‘unattractive’ market.     

DNA human identification for the family rights: One year of agreement between UNESP/Laboratory of Paternity and Public Defender Service in São Paulo State

The universities have realized the importance of extending their knowledge to the population through the provision of services. Thus, this paper presents the data obtained in an agreement between UNESP/Laboratory of Paternity and Public Defender Service in São Paulo State to make DNA paternity tests.     

一部宪法与一个时代——《美国宪法》在清末民初的传入及对民初中国立宪的影响

在世界法制史上,法律移植和法律融合是非常普遍的现象,也是各国法律建设中的一个重要内容。《美国宪法》输入中国,并对中国发生影响的过程,就是中国移植《美国宪法》及其制度,并以之为蓝本改造本土法,使两者并存融合的过程。探究这一问题,对于正确认识我国近代法制,以及在转型时期如何吸收外国法都有重要的意义,可以从中发现一些值得借鉴之处。
