Vertretung einer oö Gemeinde bei Klage vor den Zivilgerichten

Im Hinblick auf § 6 ZPO ist das Fehlen der Prozessvoraussetzung der gesetzlichen Vertretung in jeder Lage des Verfahrens von Amts wegen wahrzunehmen. Gesetzlich nicht geh?rig vertreten ist eine Gemeinde, wenn nach den für sie geltenden Organisationsvorschriften für die Einleitung eines gerichtlichen Verfahrens ein Gemeinderatsbeschluss vorgesehen ist, dieser aber nicht vorliegt. Scheitert ein Sanierungsversuch im Sinne des § 6 Abs 2 ZPO, ist das dennoch von ihr geführte Verfahren für nichtig zu erkl?ren und die Klage zurückzuweisen.     

Genetic population data of 12 STR loci of the PowerPlex Y system in the state of São Paulo population (Southeast of Brazil)

Allele frequency distributions and population data for 12 Y-chromosomal short tandem repeats (STRs) included in the PowerPlex^®Y Systems (Promega) were obtained for a sample of 200 healthy unrelated males living in São Paulo State (Southeast of Brazil). A total of 192 haplotypes were identified, of which 184 were unique and 8 were found in 2 individuals. The average gene diversity of the 12 Y-STR was 0.6746 and the haplotype diversity was 0.9996. Pairwise analysis confirmed that our population is more similar with the Italy, North Portugal and Spain, being more distant of the Japan.     

The Recent Appearance of Favelas in São Paulo City: an Old Problem in a New Setting

Abstract— While favelas have been an important feature of many Brazilian cities over the past 50 years, they were relatively insignificant in São Paulo until the mid- 1970s. Since then, São Paulo's favelas have experienced a dramatic expansion and some estimates now put their total population in the region of two million. This article examines potential explanations for this sudden change, including migration, changes in the housing market, relative prices and state intervention.

This paper analyses the standing in collective actions to enforce undefined and collective interests as well as homogeneous individual interests, according to the Brazilian legal doctrine and legislation. He treats the types of class actions, the standing to bring a suit and the adequate representation in the Latin American countries that have developed these matters: Argentina, Brazil, Chile, Colombia, Mexico and Uruguay. Of Argentinean Law, the author examines the collective amparo contained in article 43 of the National Constitutional, and the environmental and consumer’s procedures. Of Brazilian Law, the author studies the actions to enforce undefined and collective interests and homogeneous individual interests, contained in the 1990 Consumer’s Defense Code. The Brazilian Law guidelines have influenced the Model Code of Collective Procedures for Iberoamerica and the Chilean and Mexican Laws. In Colombia the collective interests are enforced by popular actions, and the equivalent to the homogeneous individual interests are defended through group actions.
