应用现代教学媒体 提高课堂教学质量

文章结合当前课堂教学应用现代教学媒体的情况，对现代教学媒体的种类、作用和使用进行了分析，指出了现代教学媒体运用过程中存在的问题，并从教学媒体选择和运用方面提出了建议，旨在提高课堂教学质量，优化课堂教学效果。     

Internet gambling: Community flop or the Texas Hold'em poker rules1

Transformed by technology, the virtualisation of gambling has prompted administrations around the world to respond swiftly to the challenges posed by the new way of carrying out an age-old practice. However, approaches to regulation differ. Within the USA online gambling is prohibited by the Unlawful Internet Gambling Enforcement Act 31 U.S.C. 5361-5367 (enacted in the USA in October 2006). This has been played out by the threats of extradition and arrests of senior executives in Texas and ultimately imprisonment for criminal infringements in among other places Las Vegas. By contrast the UK has implemented a regulatory regime through the Gambling Act 2005. The European Community has provided a regime somewhere between the two following recent European Court of Justice decisions (Plancanica 2 CMLR 25) finding against Member States operating state monopolies preventing the establishment of private providers in this specific sphere of commercial activity, contrary to Article 43TEC (right of establishment) and Article 49TEC (the right to provide services, this will of course also have the corollary of the right to receive services). The appropriateness of these responses leads the commentators back towards embryonic Internet governance discussions on cyber-paternalism and cyber-liberalism with online gambling as the case study.

An analysis of news sources used in reports on slavery in the Sudan in the New York Times and Washington Post between 1986 and 2001

Abstract

For over 25 years the Sudan and the United States have had a contentious relationship. In 1986 several international human rights organisations pointed to the re-emergence of the practice of slavery in the Sudan. Past research by American media has shown that journalists tend to use routine channels and American government officials, especially those from the ‘golden triangle’ (the White House, Pentagon and State Department) when covering stories related to foreign countries. However, in the case of the Sudan there was no clear American foreign policy for an extended period of time. Consequently, there was a stark absence of reporting on the slavery issue in the two elite American newspapers (the New York Times and the Washington Post) examined in this study. Furthermore, even when the topic was covered the sources used defined the issue through an American perspective, rather than within an historical and geopolitical context.     

中国传媒公共领域探究——基于学界的争论

关于中国传媒公共领域是否存在的问题争论十分激烈。肯定说与否定说虽各执一词,但两者在方法论上有共同之处,即刻板地理解哈贝马斯的公共领域理论,按图索骥寻找中国的传媒公共领域。本文认为,公共领域理论有其丰富的内涵,以公共领域理论为僵硬模型衡量传媒公共领域存在与否的思路是不可取的。从历史性、具体性和动态性角度理解公共领域,分析网络传媒作为新型公共领域的基本特征,对处于成长发育中的中国网络传媒公共领域的成熟完善具有启发意义。     

论网络购物中消费者纠纷在线仲裁解决机制的构建

目前网络购物具有虚拟、即时、小额的特点。针对于网络的这一特点有必要建立与网络购物相适应的专门的网上购物消费者纠纷在线仲裁制度,这对促进网络购物的进一步发展有着极其重要的价值。在这一制度的构建过程中,注意把握好其与传统仲裁制度的不同,积极探索网上仲裁方便、快捷的途径,加快我国仲裁制度的创新与改革。     

药品网上销售存在的风险及法律对策思考

目前国内网上购物呈现欣欣向荣景象,网上购物无论是种类还是数量都呈不断增长的趋势,药品通过网络销售也是大势所趋,然而药品由于其具有的特殊属性,使药品在网络上销售就存在着一定的风险,而这种风险直接关乎消费者的生命健康。文章根据药品在网络上销售可能存在的主要风险进行分析,并提出一些解决的思路。

近年来,新媒体的迅速发展为民众表达话语权提供了广阔的渠道,致使个别案件的审判被演变为“媒体审判”、“民意审判”,判决往往成为不同话语权博弈后的结果.其实,无论是媒体监督的无序失范、司法独立性价值的消弱还是民意与判决的冲突,都可归结为媒体所代表的民意话语权与相关利益主体所代表的话语权、法律阶层所代表的话语权之间的冲突.面对该困境,文章通过典型、热点案例,从话语权选择主体、话语权表达主体两方面为困境中的理性判决提供了合理性建议.     

互联网媒体对政府公信力的挑战与应对

中共十八大报告提出,创新行政管理方式,提高政府公信力和执行力。当前,随着互联网媒体的快速发展,传统媒体所构建的权力权威逐渐被瓦解,政府公信力面临着极大的竞争危机。本文先分析政府公信力的重要性与互联网媒体的传播特点,在此基础上探讨互联网媒体影响政府公信力的原因,进而提出相应的应对措施。     

域名纠纷在线解决机制研究

域名纠纷是网络民事纠纷的一种,使用诉讼和ADR来解决域名纠纷将面临“纠纷解决的会面成本较高”等缺陷,同时域名纠纷的责任要件的认定有时借助网络就可以完成而无需当事人双方会面.为此域名管理机构创立了专门解决域名纠纷的域名ODR机制,以便快捷、廉价的解决域名纠纷.为鼓励当事人选用域名ODR来解决域名纠纷,域名管理机构把域名ODR设置为附条件的诉讼前置程序以保证域名ODR有充足的案源,另外裁决结果易于执行性、专家裁判、裁判快捷高效、费用低廉等优势成就了域名ODR,但是域名ODR也面临着困境.
