40 YEARS OF CHINESE REFORM AND OPENING UP ALONGSIDE CHINESE CONSTITUTIONAL STUDY

China has a long history of constitutional jurisprudence, bearing different academic missions in different eras. China’s constitutional jurisprudence, characterized by its academic logic and principled nature, has not only facilitated social development and progress but also actively played academic functions during the Chinese reform and opening up. This paper considers the social changes during the last 40 years of the policy’s implementation as the background and, by employing standardized and literature analysis methods, combs the main progress and evolution of the knowledge system during the 40 years of constitutional jurisprudence study, followed by a look into its future.     

改革开放与中国特色社会主义道路的选择

改革开放的进程就是我国逐步融入全球化的进程。在这一过程中,我们成功开辟了中国特色社会主义发展道路。在新的历史条件下,只有坚定不移地推进改革开放,把坚持四项基本原则同坚持改革开放结合起来,把坚持独立自主同参与经济全球化结合起来,坚持党的领导,才能使中国特色社会主义道路越走越宽广。     

Offenders' lies and truths: an evaluation of the Supreme Court of Sweden's criteria for credibility assessment

Abstract

The criteria used by Swedish courts for assessing credibility of plaintiffs' accounts were for the first time scientifically evaluated. Furthermore, unlike much previous deception detection research, we used offenders as participants instead of college students. False and truthful confessions by 30 offenders were analysed, and few significant effects were obtained. Truthful confessions were rated as having a higher degree of clarity than false confessions. Women's truthful confessions were rated as more credible than their false confessions. The offenders who were most experienced in being interviewed by the police gave a stronger impression of talking about something self-experienced in their false than in their truthful confessions; hence, it seems that offenders with more police interview experience have developed a kind of expertise in telling a convincing lie about crime. Overall, the criteria for credibility assessment used by Swedish courts had very limited usefulness in discriminating truthful and false confessions. A critique of the current status of evaluating statements in Swedish courts is provided.     

Economic opening and society endogamy: migratory and reproduction logic in the Insubric mountains (18th and 19th centuries)

This article illustrates the character of the alpine and prealpine societies of the Insubric area, which is both open and closed. In these mountains, various migratory forms (periodic, temporary, and definitive) could be both exclusion and stability factors. Even if under a lineage model, family reproduction forms were close to a “unilineal” system. Yet, emigration left open pluriestablishement, the intensity of which depended on the openness of the local economy and demographic configuration of the households.     

“南方谈话”在改革开放进程中的作用与启示

邓小平的"南方谈话"发表在中国的改革开放事业不进则退的紧急关头。通过这次谈话,邓小平回应了社会上对改革开放的质疑与否定,使得人们在是否应该继续坚持改革开放的问题上达成了共识,使改革开放迅速走上了不可逆转的轨道。经过20多年的发展,当前的改革事业又走到了一个历史关键点上,回顾这段历史对于如何凝聚改革共识、冲破改革阻力、增强改革的信心,坚定社会主义信念具有重大的启迪意义     

改革开放以来国内毛泽东新民主主义文化思想研究述评

改革开放以来,国内学者对毛泽东的新民主主义文化思想进行了深入的研究,既取得了丰硕的理论成果也诞生了一大批很有影响的学者。对这些研究成果做一个系统梳理,可以归纳概括出学者们研究的角度,以及有待深入研究的领域。从横向的角度概括已取得成果的特点;揭示研究学者们研究毛泽东新民主主义思想所经历的阶段,以及每一个阶段的特点;已有成果研究的重点和热点问题,包括毛泽东新民主主义的形成、理论体系、特征、作用和局限性等仍具有一定学术价值。     

The Practical Way of Communist Party of China to Bring up and Assemble Young Talents in the Early Years of Reform and Opening up （1978-1989）

In 1978, China entered the era of reform and opening up. Faced the great depression, cultivating and assembling young talent became an important power to support rapid development of the country. The leadership of Communist Party led by Deng Xiaoping had a global sight, and began to reform higher education system, gradually cultivated and assembled the generation of young talents. This paper reviews the theoretical ideas and practical measures of Communist Party of China （CPC） to train and assemble young talents at the beginning of reform and opening up, analyzes and displays the particular and scientific method of young talents and the great achievements of young talents in this period. The paper consists of three parts, the practice of bringing up young talents, young cadres, young professional and technical personnel, and the modernization construction from young talents. These methods cultivate so many young talents as the pillars of state development, and the quality of youth increased rapidly. So many practical ways also have been used and influenced in China today, and these are not only the wealth for China, but also the important experience for the whole world.     

我国妇女参政议政的历史变迁刍议

妇女解放是人类社会进步的重要尺度,而妇女参政议政则是妇女解放的高级形式。改革开放给妇女参政议政提供机遇和挑战的同时也为妇女参政议政开创了崭新局面,取得了令人瞩目的成就。新时期科学发展观的提出,进一步强调了妇女参政议政的时代诉求,我们必须按照科学发展观的要求进一步提升妇女参政议政的水平,让妇女真正起到"半边天"的作用。     

改革没有穷尽 社会主义仍在路上——再论中国改革和发展关键时期的“主义”选择

近年来,中国社会和学界围绕改革开放问题的争论,实质是中国应该搞什么“主义”、走什么道路的问题。党的十七大对争论正面又旗帜鲜明地作了回答。中国社会主义的发展已经站在一个新的历史起点上,我们对中国社会的进步、社会主义事业的发展充满了信心,但我们面临的问题是严重的,中国社会主义的发展处在历史的关键时期。     

民法典应确立二元民事主体结构--以"非法人团体"问题为中心

“非法人团体”主要是立法政策导致的“法人”概念未能涵盖所有团体主体所致 ,并非因为存在自然人、法人之外另有民事主体的观念。“法人”概念应指代所有作为法律主体之团体 ,我国由于特定立法目的限缩了“法人”概念的指代范围 ,导致了我国“非法人团体”问题的特殊性。民法典应采用“大法人”概念 ,将非法人团体归入“法人”之中 ,建立自然人、法人的二元民事主体结构。
