中国法学受着一种源自西方的"现代化范式"支配,只有充分、坚实地证明当下中国法学已经从根本上无力解释和解决中国法律实践中所存在的基本问题或关键问题,才能断言中国法学存在着总体性危机.邓正来先生并没有有效进行这种证明,无法断言中国法学存在着总体性危机,"中国法学向何处去"就是"无问而问",即便不是一个假问题,在它的提出理路里也很难被认为是一个真问题.邓正来先生并没有给出"中国法律理想图景"或"邓正来的中国法律理想图景",他并没有真正回答"中国法学向何处去"这一问题,但是在他的论述中给出了一个问题解决套路.因种种原因,该问题解决套路的有效性十分可疑.经过邓先生的立论和笔者的驳论,显示出一些对中国法学发展可能有意义的问题.  相似文献

Environmental and social initiatives taken by organizations under corporate social responsibility (CSR) have attracted stakeholder's attention and global resonance in the recent times. Alike Western countries, the concept of corporate social responsibility is not new in India rather it has been imbibed in the tradition of Indian society to donate voluntarily for social causes. As a result, a paradigm shift has been noticed where “voluntarism” in CSR has got replaced with a mandatory obligation. This has been made mandatory through an amendment of new Companies Act, 2013. The current study through empirical observations emphases on examining the impact of CSR related activities on the organizational performance with the moderating effect of organizational ownership. A model is proposed and tested using SEM through AMOS. Data were collected from 265 respondents including senior CSR managers and other working professionals of select organizations. The results show a significant and positive relationship between CSR activities and organizational performance. It is also found that organizational ownership has no moderating effect on the relationship between activities conducted under CSR and the performance of the organizations. The analytical finding of the study has a practical implication for the managers of various organizations in the Sonbhadra district of Uttar Pradesh, India.  相似文献

Starting from the debate on democratic decline, this article introduces the concept of ‘mainstreaming authoritarianism’ in a bid to turn attention to the role and agency of traditional political actors in the process. The article summarises key findings of relevant studies on autocratisation and highlights issues with the many concepts employed to describe the problem. It moves on to define authoritarianism and suggests a turn towards practice-based approaches. This facilitates the analysis of authoritarian discourses and practices of mainstream political actors in established democracies and helps bridge the gap between social psychology-based and political science-based classic conceptualisations of authoritarianism. Testing the hypothesis that authoritarianism has been mainstreamed, the author develops a comparative survey of the actions and practices of key political actors in Europe, concluding with a note on the importance of acknowledging this authoritarian turn, dealing with its consequences and focussing on the role of agency.  相似文献

Why, how, and when does intra-ministerial change take place? Previous answers to these questions suggest that political factors, such as cabinet reshuffling, are the most decisive drivers of inter-ministerial change. By contrast, this article begins with a distinction between the mechanism responsible for intra-ministerial and inter-ministerial change of ministries, the latter discusses which of these has been given more attention in previous research. Data covering the intra-ministerial change of 11 ministries in Germany between 1949 and 2006 can demonstrate that environmental as well as organizational factors are decisive in order to explain the timing and type of intra-ministerial change. The main finding is that a clearly definable threshold of tasks, organizational units, and a horizontal dispersion of jurisdictions – all of which react to the international environment – can explain intra-ministerial change in German ministries.  相似文献

Political theorists like Bickford (1996) and media theorists like Couldry (2006) have introduced the concept of listening as a complement to long-standing discussions about voice in democracies and in the media which serve the democratic project. This enhanced understanding of voice goes beyond just hearing into giving serious attention to, in particular, marginalised voices. This article reports on an investigation into the ways in which mainstream and community media in the Eastern Cape, South Africa, understand listening as an important part of their role as journalists. Interviews probed the attitudes of journalists and editors towards listening, and also interrogated their own understandings of their role in South Africa, particularly in relation to young people who are finding their political “voice”. The research showed that “listening” as a journalistic practice is seldom understood in anything more than common sense ways and is certainly not an organising principle of reporting and disseminating news. This results in journalism that is events focused, often sensationalist and whose agenda is set powerfully by political actions and actors in the environment. The power of being heard is almost solely in the hands of the journalists, who regard themselves as “the voice of the people”, without actively providing a space for listening to the voices of community members. But, within this generalised environment, there are two very interesting projects in which journalists and editors are actively listening to the issues and stories of citizens and letting them set agendas.  相似文献

Rules are dynamic entities whose implementation is shaped by context, resources, and institutions. Variations in this implementation influence the functionality and effectiveness of rules. While the last decade has seen considerable scholarship on the determinants and effects of ineffective and effective rules, less is known about how rule implementation evolves over time. Particularly, what are the factors that influence administrative implementation intent over time? This study uses interview and archival data to examine administrative implementation intent of a single rule over a 25-year period. From qualitative data analysis, propositions are developed to explain why, although the text of the rule remained nearly the same, administrative intent of implement changed drastically.  相似文献
