维和行动与国家主权

在尊重国家主权的基础上,维和行动形成了同意、中立、自卫等基本原则.实践中,维和行动在这些基本原则的指导下,为解决国际争端作出了巨大贡献,其本身也不断得到丰富.然而由于国际形势的复杂性,加之维和行动本身的缺陷,使之在发展过程中出现了蜕变现象.为了促进维和行动的健康发展,第一,在处理国家冲突中,仍要强调对国家主权原则的严格遵守;第二,各国共同协商,完善维和行动的法治化;第三,明确维和行动所处的地位,不能对之期望过高;第四,应支持维和行动的合理变革.     

关于缓刑制度运行状况的“全景式”分析——以舟山市普陀区人民法院刑事审判工作为视角

缓刑对实现刑法人文关怀和刑罚人道主义具有重要意义,合理的制度设计是其充分发挥作用的必由之路。笔者借用摄影学"全景"概念,以舟山市普陀区人民法院刑事审判工作为视角,从缓刑的审前社会调查、适用和执行,即法院所参与的缓刑制度运行流程的全部三个阶段,对其进行全景式分析,并针对其运行中出现的问题提出解决的对策和建议。     

安徽监狱创新警务运行模式的实践探索

在传统警务运行模式下,民警警力紧张,身心疲惫,存在指挥权分散、指挥层次多、指挥效率低、智能化程度低等问题,安全工作质量低、效率低。针对这些问题,安徽监狱积极推进警务运行模式创新,通过顶层设计、流程再造、职能重构,把保障监狱场所安全、维持狱内秩序稳定等职能剥离出来,交给指挥中心专职行使,打造流程集约化、信息集成化、结构扁平化、联动一体化的警务指挥体系,建立省局、监狱、监区三级警戒联动,罪犯生产、生活、学习三大现场联控,监狱、武警、公安三方联防,进而实现"监狱长期安全稳定、警务执法科学文明、警力效能充分发挥"的目标。     

The Woman Victim in a Country in Crisis: A Reading of Tagwira's The Uncertainty of Hope

The article is based on my reading of Valerie Tagwira’s The Uncertainty of Hope as a feminist text that portrays female victimhood in the context of a failing postcolonial state. Tagwira writes about the experiences of a woman against the background of Murambatsvina, officially termed ‘‘Operation Clean Up.’’ The Zimbabwean Operation Clean Up of 2005 was condemned worldwide; and in her novel, Tagwira gives an often-ignored dimension of a woman’s experience of it, in the general context of a country facing serious political, economic and social challenges. For Tagwira, the challenges faced by Onai, as well as those around her, do not have links to their racial identities. Thus, Tagwira redefines the enemyvictim trope of the Third Chimurenga by subverting the state’s interpretation of the struggle discourse of the Third Chimurenga. In the state’s discourse, the victim trope is racial, the state enemy is the former colonial master (in support of the opposition political party) and the victim is the previously colonised black. In my analysis, I have used Susan Wendell’s theory on oppression and victimisation as contained in her article Oppression and Victimization: Choice and Responsibility (1990).     

我国资本系相关法学问题初探

资本系是我国资本市场中新出现的现象。它具有五大法律特征。其法学概念可以概括为:在资本市场中以资本为核心或联系纽带形成的,具有关联或潜在关联关系的上市公司群体。资本系对我国资本市场的影响越来越大,而且对现行公法、私法制度产生强烈冲击,因此,资本系问题具有重要的法学研究价值。

环保信托是环保资本运营的新亮点。将环保与信托两者有机地结合起来,环保市场可以得到信托业的大力支持和严格规范,从而保证其良性发展。这主要因为信托具有提高环保资本运营效率的功能。环保信托的创设主要是利用信托的增值功能、保全功能、融资功能和避税功能。     

传承与发展：关于我国经侦运行机制的思考

改革开放30年来经济犯罪形势发生剧变的同时,我国经侦运行机制也随之不断完善。进入21世纪,现行经侦运行机制的不足之处日益显现,主要表现为警令不畅致使国家打击经济犯罪的决策难以彻底落实、执法活动中的地方保护主义异常严重、对经济犯罪的打防难以形成常态化的高压态势。为此,必须通过规范地方各级经侦机构建设、在全国范围内设置垂直领导的中央经侦机构等创新性举措完善现有经侦运行机制,从而以制度创新化解当前经侦部门面对的空前挑战。     

UN Peace Operations and Conflicting Legitimacies

ABSTRACT

Analyses of United Nations (UN) peacekeeping increasingly consider legitimacy a key factor for success, conceiving of it as a resource that operations should seek and use in the pursuit of their goals. However, these analyses rarely break down legitimacy by source. Because the UN is an organization with multiple identities and duties however, different legitimacy sources – in particular output and procedural legitimacy – and the UN’s corresponding legitimation practices come into conflict in the context of peacekeeping. Drawing on a range of examples and the specific case of the United Nations Organization Mission in the Democratic Republic of the Congo (MONUC), this article argues that looking at different legitimacy sources and linking them to the institutional identity of the UN is thus critical, and it shows how the UN’s contradictory legitimation practices can reduce overall legitimacy perceptions.     

Sex,Statistics, Peacekeepers and Power: UN Data on Sexual Exploitation and Abuse and the Quest for Legal Reform

The UN Secretariat provides annual statistics on allegations of sexual exploitation and abuse made against peacekeeping personnel, with reduced numbers of allegations leading to claims of success for the UN's ‘zero tolerance’ policy. This article explores the use of data as ‘technologies’ of global governance, to examine the function that these annual statistics serve for the UN and the impact that they have on calls for legal reform. Thus far, the statistics have attracted little academic appraisal. Yet, they have been used to establish the UN's authority to resolve the ‘problem’ of sexual exploitation and abuse, diminishing the space for critique of UN policy and undermining the quest for improved legal arrangements.     

反劫持行动中心理战运用探析

反劫持行动的关键是对人质的保护和营救,在反劫持行动全部工作的各个方面以及反劫持行动全过程的各个环节,都要自始至终将确保人质安全置于首位。要紧紧围绕着保护和营救人质而谋划、运作,要把坚定与灵活、耐心与果断、勇敢与机警结合起来,反对简单、鲁莽、蛮干。劫持行为本身就是犯罪(恐怖)分子为达成某种意图而实施的一种心理恐怖手段。因此,在反劫持行动过程中与劫匪心理上的较量和博弈始终是影响行动成效的重要因素。研究和把握此类行动心理战的特点规律,对于加快反劫持行动的胜利进程,有效打击暴力恐怖犯罪具有非常现实而重要的意义。
