具体人格权的法定化要求一般人格权的承认。与具体人格权相比,一般人格权具有极大的抽象性与可扩展性。德国民法理论与司法实践对一般人格权适用与运行机制的把握,既保证了一般人格权制度适用上的广适性,也保证了其适用上的妥帖性。此种做法应由我国民法典立法予以借鉴。  相似文献

以表征人身危险性的犯罪人格阐释累犯从重处罚的根据,不仅更切合实际,而且能使刑事政策合理化,有效预防累犯再犯罪。矫正犯罪人格预防累犯再犯罪的途径有:实行行刑个别化,改善累犯犯罪人格;设立更生保护制度,巩固改善犯罪人格的成果;营造良好的社会环境,控制累犯犯罪心理的生成;提高累犯自身素质,增强其免疫犯罪的能力。  相似文献

迁徙是动物趋利避害的一种本能,迁徙自由是人类维持生存与发展的一项基本人权。迁徙与"流动"、"迁移"等概念既有联系,也有区别,不应混同使用。迁徙自由可从两个层面去理解:一方面,迁徙自由是一种主观意志自由,其主体不受其他外力左右或主导;另一方面,迁徙自由本质上要求权利的同等对待。迁徙自由的特性,既说明了迁徙自由不同于人身自由,需要得到宪法的独立确认,又充分彰显了迁徙自由的价值与宗旨。  相似文献

This article compares three different forms of volunteering: formal volunteering which is typically carried out in formalized organizations; informal practical help which is most often provided in a face-to-face context and requires the giving of time; and economic assistance which requires neither the co-presence of actors nor the giving of time. The different nature and structuring of these formal and informal ways of contributing to society suggest that they require different resources. Grounded in sociological theory we argue that three sets of factors are particularly relevant for explaining volunteering: personal or ‘human capital’ factors, social network resources, and civic values. We test in a multivariate analysis how various indicators of these personal and social resources relate to the different forms of volunteering. The study relies on a comprehensive survey of the Danish adult population. The findings, therefore, are interpreted in the light of this particular institutional environment which forms the backdrop for individual choices about volunteering. We find that the different forms of formal and informal volunteering seem to form a continuum of civic engagement going from the most public to the most private. Furthermore, compared to informal ways of volunteering, formal volunteering seems to be more contingent upon access to and supply of different forms of personal and social resources.  相似文献

Richard Quinney ranks among the noted criminologists of the twentieth century, especially among progressives. He is also a photographer of note, drawing on scenes from his native Wisconsin to reflect his deep inner life. Things once seen, published in 2009 by Borderland Books, is a 40‐year retrospective of his photographic work. It is a deeply religious work that celebrates the requirements of life lived by a “radical realism”. Abstract

Fixed-role therapy, a dramaturgical approach to psychotherapy developed by Kelly in 1955, has been used in a variety of situations over the years with various client groups, including criminal offenders. Some of the benefits and limitations of fixed-role therapy with sexual abusers will be discussed. It is suggested that the strengths of some offenders, such as the social skills necessary to succeed at confidence games, be recognized and directed in fixed-role sessions. Illustrations of a number of issues will be drawn from two clinical case examples.  相似文献

随着科学技术的发展和疾病知识的普及,潜伏性人身损害的赔偿问题日益引起重视。既有立法基本不对损害进行界定,潜伏性人身损害更不会在立法文本中得到体现,但是既有损害概念的学理解释可以为潜伏性人身损害的赔偿提供认识基础。对潜伏性人身损害予以赔偿有其必要性,但是也会对传统侵权法带来挑战。虽然如此,既有司法实践还是积极回应受害人的赔偿诉求,从概念扩张和利益平衡等角度进行了大胆探索。为了有效解决潜伏性人身损害的赔偿问题,既需要从损害概念的更新方面做出努力,又需要从诉讼中的证明责任、证明能力等角度进行变革。  相似文献

Cross-border data flows not only involve cross-border trade issues, but also severely challenge personal information protection, national data security, and the jurisdiction of justice and enforcement. As the current digital trade negotiations could not accommodate these challenges, China has initiated the concept of secure cross-border data flow and has launched a dual-track multi-level regulatory system, including control system for overseas transfer of important data, system of crossborder provision of personal information, and system of cross-border data request for justice and enforcement. To explore a global regulatory framework for cross-border data flows, legitimate and controllable cross-border data flows should be promoted, supervision should be categorized based on risk concerned, and the rule of law should be coordinated at home and abroad to promote system compatibility. To this end, the key is to build a compatible regulatory framework, which includes clarifying the scope of important data to define the “Negative List” for preventing national security risks, improving the cross-border accountability for protecting personal information rights and interests to ease pre-supervision pressure, and focusing on data access rights instead of data localization for upholding the jurisdiction of justice and enforcement.  相似文献
