高等院校扩大招生后引起的思考

本文就高等学校扩大招生后在社会上和高校内部引起的反响,进行了深入分析和探讨,指出关键是如何处理好数量增加与质量提高,规模扩大与结构合理等一系列问题,使中国的高等教育早日步入大众化教育阶段。     

A comparison of the Russian 13% flat rate PIT evasion stratified contributions and the US tax schedule

This paper reviews the existing literature on consumer credit reporting, the most extensively used instrument to overcome information asymmetry and adverse selection problems in credit markets. Despite the copious literature in economics and some research in regulatory policy, the legal community has paid almost no attention to the legal framework of consumer credit information systems, specially within the context of the European Union. Studies on the topic, however, seem particularly relevant in view of the establishment of a single market for consumer credit. This article ultimately calls for further legal research to address consumer protection concerns and inform future legislation.      

欧洲银行监管委员会《外包标准》(建议稿)介评 ——兼论我国金融外包监管法之完善

金融外包给金融风险监管提出了新的要求.有鉴于此,欧洲银行监管委员会先后出台了两份建议稿试图为银行业务外包风险监管在欧盟的框架内提供统一的指导原则.名为<外包标准>的建议稿是在<外包高级原则>(建议稿)的基础上于2006年4月出台的,二者在名称及具体内容上都有较大的不同.<外包标准>建议稿在保留第1份建议稿特色的基础上,强调了对客户金融隐私的保护,修正了金融监管部门对外包的监管权,使外包业务的分类更加明确.但是,现行建议稿在监管标准的制订上未充分考虑不同种类的外包商可能对外包风险造成的影响,要求所有的外包都必须有服务水平协议也较为绝对化.参考欧洲银行监管委员会在金融外包监管方面的立法经验,考虑我国金融外包的实践,我国应当制定普遍的金融外包监管法,同时对<电子银行业务管理办法>中电子银行业务外包部分进行完善.     

Flipping burgers or flipping pages? Student employment and academic attainment in post-Soviet Latvia

Latvian higher education has undergone a dramatic transition since 1991. This study employs a survey of nearly 1000 social science students studying in 13 different institutions in Latvia to consider the impact of the increase in the number of students who are working while studying. Evidence indicates employment has a strong and significant negative impact on school performance, and the negative impact increases as weekly hours worked increase. This manifests itself through reduced class attendance and reduced time spent in independent study. Finally, we find that the probability of student employment is most significantly affected by the availability of financial aid, gender, ethnicity, and age.     

法经济学视野下的金融监管法正义性分析

正义历来是法律所追求的价值目标之一,但其从来都不是空洞和抽象的,需要用具体的方法和标准对其进行诠释和分析。在金融全球化趋势日益加深的今天,从法经济学的视角,对金融监管法的正义性价值目标进行分析和诠释,对于进一步完善我国金融监管法体系,维护我国金融安全与稳定意义深远。运用法经济学的分析方法,从立法、执法和司法三个方面对我国现行的金融监管法进行分析,以促进我国金融监管法正义价值目标的最终实现。     

金融工程与风险控制

金融工程在本质上是一种金融创新的工具 ,是金融中介为客户解决特定金融难题的一种系统性分析方法。它的核心是为客户设计开发出新的金融产品以满足其特定的要求 ,并在新的金融产品开发过程中有效地实现金融风险控制与管理。在实际运作中 ,金融风险的管理与控制离不开金融工程的整合与发展。     

国际金融监管不完善性之探析

本文立于事实的基础上 ,论述了现行国际金融监管中所存在的不足 ,这主要表现在 :金融监管理论基础的欠成熟性、国际金融监管组织的先天发育不足、国际金融监管所体现意志与利益的单一性、国际金融监管的事后性等几个方面。同时 ,在此基础上 ,针对现行的监管缺陷 ,作者从信息分享、国际金融监管主体的重塑与矫正、国际金融监管的理念及国际金融监管法立法主体等方面提出了一些完善的对策。     

创设船舶预告登记制度之探讨

结合民法物权预告登记的基本原理,针对海商法领域尚未制定船舶预告登记制度的欠缺,本文从理论和实践两个方面探讨了我国确立船舶预告登记制度之必要性,并对该制度的适用范围做了初步性的探讨,提出了笔者自己的观点。     

¡Que se Vayan Todos! Popular Insurrection and the Asambleas Barriales in Argentina

In December 2001, Argentina experienced a decisive crisis. A financial collapse accelerated by the massive flight of capital and the IMF denial of a new loan was followed by a popular insurrection which, by putting forward the slogan ¡ que se vayan todos, que no quede ni uno solo ! forced the resignation of national authorities. Whilst Duhalde's provisional government is negotiating the conditions for international financial support, faced with inflation and the rise of the dollar exchange rate, social mobilisation is expanding in new forms. This paper argues that the popular insurrection of December 2001 opened a space for the reinvention of the political as negative politics, the asambleas barriales constituting one example of this.
