经济法是现代法,极少有现代化与传统冲突的痛苦,其开放性和对新观念、新理论的强劲吸纳能力,便于从现代化的理论和实践中获得支撑。中国经济法学总论30年研究表明,在我国传统、现代与后现代的共时性存在的具体语境下,经济法总论重在探究市场与政府、经济与法律、私法与公法这三对关键词。经济法既是“有关经济的法”,又是“经济法”。认真对待经济法,就必须克服“中国式”市场与政府、经济与法律、国家与社会、科技与财政等种种挑战,介于经济私法与经济公法、经济学与经济政策、经济行政与经济行政政策、传统与现代等横切面之间进行研究。经济法应主要作为法律科学而不是法律部门,经济法理论应由“小经济法”转向“大经济法”。这种“否定之否定”的角色转型,有助于解决“中国经济法学向何处去”的问题,真正面向中国社会的真问题,与西方经济法学前沿理论开展有建设性的对话。  相似文献

In this article, we discuss the experiences of six female secondary-school students participating in a media group that encouraged critical discussion and analysis of gender, particularly with respect to notions of strong women in popular media texts. Throughout the study, the participants viewed various forms of media and critically discussed gender representations. We describe the ways that we encouraged critical discussion that prompted the participants to challenge dominant perspectives and develop personal positions regarding gendered representations in popular media. Many discussions were convoluted and often contradictory. Throughout these debates, however, moments emerged in which participants identified complexities associated with gendered representations of strong women as related to privilege, beauty ideals and autonomy. We identify these moments as messy yet critical, requiring the researchers to challenge participants’ postfeminist notions of strong women. We emphasize the importance of ongoing dialogue and the potential of media for encouraging discussion.  相似文献

What should be the position of democrats in response to the Brexit referendum? Many urge a duty to accept the result. This article argues the contrary. If someone is a UK citizen, has a belief that leaving the European Union will be damaging to the common good of the UK and is a convinced democrat, then that person has a duty to oppose Brexit. Neither of the two principal reasons for accepting the result—a claim of popular sovereignty or of parliamentary sovereignty—imply a duty not to continue to oppose. Arguments from political equality for simple majority rule do not apply when the alternatives are ill defined. More generally, popular sovereignty presupposes and does not replace constitutional democracy, and in a parliamentary democracy there is always a continuing right to oppose.  相似文献

This article introduces an approach to IR that uses popular films to teach students how to critically analyze IR theory. By pairing IR traditions (like Realism) and the slogans that go with them (like "international anarchy is the permissive cause of war") with popular films (like Lord of the Flies ), this approach poses questions not about the truth or falsity of IR theories but about how IR theories appear to be true. This technique works because it draws upon visual analytical skills that students already possess and transfers them to analyses of IR theory and international politics. Overall, it challenges the positioning of IR theory as beyond culture and politics rather than as part and parcel of it, transforms what we think of as doing critical IR theory, and repositions students from passive recipients of IR truths into critically active and engaged analysts of IR theory's commonsense views of the world.  相似文献

大众文化所创造的地缘政治神话直接塑造了特定社群对其他国家形象的想象,深刻影响国家认同、外交政策和国际关系。在后现代的军事—工业—媒体—娱乐网络中,大众文化产品一方面向民众传播政治精英的地缘政治想象,另一方面向决策层反馈流行话语中的大众地缘政治想象。大众文化产品塑造"他者"的方式具有多元性,其"他者"形象的生成机制可以理论化为"非人化"、"奇观化"和"性别化"三种模式。与之相应,西方娱乐工业往往依赖一些固定"模板",批量生产"类型化"的"他者",以维持"自我"身份叙事的稳定性。其传播过程则具有"隐蔽性",往往不会立时得到"地缘政治对手"的回应,遂成为西方文化软实力的重要推手。今天的大众地缘政治在很大程度上仍以西方为中心,西方流行文化的全球传播在取得商业成功的同时,隐蔽地对外传播深藏于其中的地缘政治想象。因而,在国际话语权竞争中,中国必须充分认识大众文化的地缘政治功能,重视大众文化建设,讲好中国故事。  相似文献

Since the late twentieth century, assisted reproductive technologies have brought new challenges to our understanding of the family and gender relations. There are ever-widening gaps between medical practice, legal regulation and everyday understandings and practices. Some recent popular cultural texts in Japan have explored the issues raised by non-commercial surrogate motherhood. The background to these texts is a series of controversies concerning surrogacy and the use of assisted reproductive technologies and wider societal anxieties about family, reproduction and population management. In this article, I will focus on two novels by a medical practitioner and popular novelist who writes under the pseudonym Kaidō Takeru – Gene Waltz (Kaidō 2008) and Madonna Verde (Kaidō 2010) – and the associated film (ōtani 2011) and television series (NHK 2011). The fact that it was the national broadcaster Nippon Hōsō Kyōkai (NHK) that dramatised Madonna Verde suggests that the discussion of these issues was thought to have wide social and cultural resonance. I will place these texts in their social and cultural context with reference to medical, legal and popular discourses on new reproductive technologies in contemporary Japan. These new reproductive technologies have the potential to force a rethinking of masculinity, femininity, parenthood, family and gender relations. The popular texts also, however, draw on pre-existing ways of thinking about masculinity, femininity, marriage, reproduction and the relationships among science, ‘nature’ and society.  相似文献
