Rhodes and Wanna (2007) have criticised Moore's argument for ‘public value’ as an organising construct for public managers, claiming that it is confused, ill‐informed, ignores the central dynamic of political life, and demands that public managers become ‘Platonic guardians’, making it totally inappropriate for use in Australia. This article examines Moore's analysis and Rhodes and Wanna's critique, and explores the relevance for the argument of the complex nature of authority in Australian government, recent developments in the social science understanding of governing, and the experiential knowledge of practitioners. It cites the governing of the Murray‐Darling Basin as an example, and discusses the different discourses that academics and practitioners use in making sense of complexity in governing.  相似文献

Legal context: When Congress enacted the Federal Trademark Dilution Act in1996, it intended to create a uniform federal cause of actionfor trade mark dilution. Unfortunately, the statutory languageselected by Congress created certain ambiguities, includinghow famous a trade mark had to be to merit dilution protectionunder the statute. Confusion developed as to whether a markmerely needed renown in a limited geographic area or industry—aconcept that became known as ‘niche fame’—orwhether it needed national renown to qualify as a ‘famousmark’. Key points: In 2006, Congress enacted the Trademark Dilution Revision Actand therein provided a concrete definition for a famous markthat ostensibly removed the ability to qualify for dilutionrelief where the mark was famous only within a particular niche.It was uncertain how courts that had previously favoured theniche fame theory would apply Congress's new definition. However,a district court in the Ninth Circuit, one of the strongestproponents of niche fame, recently held that niche fame is nolonger a viable theory under the Lanham Act or California statelaw as a result of the 2006 amendment. Practical significance: This decision portends that courts will fall in line with Congress'samendment and will deny dilution relief under federal law toparties whose marks are famous only in a particular geographicarea or industry. Additionally, the decision provides some guidanceand predictability as to how states may interpret the viabilityof niche fame under their respective dilution statutes in lightof Congress's 2006 amendment.  相似文献

The field of public administration is often seen as a late adopter of cutting-edge research methods. Related disciplines like political science use more advanced research methods for single or small-n case studies including techniques like process tracing. Many elements of process tracing are analogous to investigations. To inform process tracing practices, political scientists looked at Sherlock Holmes novels. We draw on the experiences of a police inspector and a former soldier who worked with intelligence to offer insights on the implementation of process tracing, bridge the academic–practitioner gap, and increase the methodological rigor in public administration research.  相似文献

近年来,新业态从业者的人数不断增加,如何有效保障新业态从业者的合法权益成为社会热议 的话题。新业态从业者的个人信息权益是其个人合法权益的重要组成部分,而个人信息保护中的知情同意规则却 未能有效保护新业态从业者的个人信息,甚至异化为算法自动化决策压榨新业态从业者的“阀门”。“同意”不能(完 全)被《个人信息保护法》第 13 条第一款第 2 项所替代,其仍是平台经营者处理新业态从业者个人信息的主要合 法性来源。为保护新业态从业者的个人信息权益,应当基于个人信息的分类对“同意”作出修正。新业态从业者 基于一般个人信息作出的“同意”应属于准法律行为,其法律后果是平台经营者处理个人信息的行为具有合法性。 新业态从业者基于敏感个人信息作出的“单独同意”应属于法律行为,适用法律行为的规则。  相似文献

执业医师制度改革是我国医疗卫生体制改革的重要组成部分。如何对执业医师进行科学划分并配置符合其特点的制度安排,将对我国目前正在积极探索的执业医师的签约首诊制度、转诊分级医疗制度和多点执业制度产生积极影响。美、英、德等国的全科医生制度各具特色,其中符合市场经济发展规律的规则值得我国效仿。我国全科医生制度主要依靠国家政策推进,上海和深圳全科医生试点也暴露出一些问题。全科医生制度"政策推进型"模式应当逐渐被"法制推进型"模式取代,完善《执业医师法》是我国全科医生制度法制化的理想选择。  相似文献

文件鉴定作为一项重要的司法鉴定活动,其鉴定意见作为证据被广泛地应用在诉讼阶段,同时,文件鉴定意见作为证据使用的风险也不容忽视。为了提供高质量的鉴定意见,文件鉴定专业的质量控制就显得尤为重要。特别是其学科较大地依赖于文件鉴定人的技术、经验、能力等背景,质量控制更应该侧重于对从业人员的质量管理。本文在调研国内外关于文件鉴定质量控制相关标准规范的基础上,在从业人员的资格审查、培训制度、考核制度等方面进行对比分析,从中发掘有益的启示,旨在为我国文件鉴定从业人员质量控制的建设和发展提供借鉴。  相似文献
