Structural,Domestic, and Strategic Interests in the European Union: Negotiation Positions in the Council of Ministers

Preferences are a crucial element for analyzing decision making and negotiations, but knowledge about which factors determine these preferences is sparse. Some quantitative and qualitative studies of European Union (EU) negotiations have assumed that the negotiation conflict dimensions in intergovernmental negotiations reflect market‐versus‐regulation approaches as well as a north–south dimension. In this study, I demonstrate that these findings can be extended to show that the relevant determining factors for negotiation positions are economic structural variables and the degree to which a country benefits from the EU. Furthermore, the domestic interests of EU governments better explain a government's interest in some specific issues, such as consumer protection or fishery policies, than do their partisan preferences. Moreover, I am able to show that in frequent negotiations, such as EU Council of Ministers negotiations, sincere preferences dominate; however, some factors, such as extreme salience, can increase the likelihood that a minister will choose a less sincere strategic position such as an extreme position.

略论美国的辩诉交易制度及其可借鉴性

当前,美国的辩诉交易制度以其操作简单灵活、成本低、效率高的特点,引起了我国法学界和实务界的极大关注。虽然两国的文化传统及价值理念等有所不同,但我国仍有必要对之借鉴和吸收。     

股权强制执行问题探讨

股权的执行与股权的转让紧密相连.具有较强人合性质的公司,其股权的可转让性较弱;相反,公司的资合性质越强,则其股权的可转让性越强.在我国,股权的强制执行经历了一个逐步发展的过程.学界对有限公司股权能否强制执行看法不一,但股权强制执行具有相当的法理依据,在法律上也渐有明确的规定.对于股份公司的股权强制执行,要准确理解最高人民法院<关于冻结、拍卖上市公司国有股和社会法人股若干问题的规定>;对于有限公司的股权强制执行,如何保证原股东对转让股权的优先购买权是其中的难点.在实践中,股权强制执行的操作应当规范化.     

两岸农业贸易和投资协作之研究

过去较长时期台湾岛内民心或政治取向与经贸走向“相悖”。“相悖”是现象,“相符”是实质:由于不能依据市场规律、农业产品和要素比较优势差异建立实现双赢的合作机制,台湾中南部农民从与大陆经贸往来中受益不多。鉴于此,大陆应加强两岸农业贸易和投资协作,让利于台湾小农,扭转岛内关于“大陆农产品是造成台湾农业困境根本因素”的错误认识,彻底打破政经相悖的格局。本文提出:在尊重市场规律和借鉴现代发达经济扶持农业惯例的前提下,放开台湾优势农产品进入大陆市场;创造条件帮助台湾小农西进大陆创业,用其农业要素上的比较优势来抵消产品上的比较劣势。     

Electoral alliance with sworn opponent political party: factors impacting voting intention

Alliance with sworn political opponents is becoming a growing phenomenon within the realm of political alliances. Here, two or more competitive political parties join hands to defeat a particular common opponent. During election, alliance partners face election together and distribute electoral seats mutually to avoid vote share. However, ensuring vote in favour of opponent alliance candidate is only possible when voters prefer to cast vote for the alliance candidate. Thus, this is crucial to know influencing factors that shape voters’ voting intention in favour of opponent alliance candidate. This study is an attempt to empirically investigate factors that have significant influence to shape voters’ voting intention for opponent alliance. The result shows that opponent alliance perceived fit impacts opponent alliance voting intention positively. Opponent alliance brand trust has a positive impact on opponent alliance voting intention. In addition, opponent alliance preference impacts opponent alliance voting intention positively.     

An Analysis of Donald Trump's Political Personality Traits and Policy Orientations

As a political leader,US President Trump's personality traits affect his policy orientations and current US foreign policy.The authors analyze Trump's personality in several categories-uninhibited and capricious,dynamic and capable,profit-orientated and self-centered,competitive and persistent,positive and extraverted.The traits of breaking traditions,skill at strategic deception and negotiation,action-motivated implementation,intuitive decision-making,pursuit of respect and interest exchange,and vengefulness will shape his policy and behavioral orientations.Initial study shows Trump to be a political leader with positive personality traits and double-sided dimensions.The analysis offers insight toward understanding the new US executive and his policy direction.     

Swedish politicians’ preferences regarding the privatisation of elderly care

Since the 1990s, Sweden has embarked on a series of market reforms in public services, aiming for greater efficiency and better service quality. Nevertheless, the political debates do not seem to fade away and local politicians still have to decide on privatisation issues. We argue that attitude studies of local politicians are of importance and present a 2014 survey in this regard, using Swedish elderly care as one example. Our findings show that altitudinal difference between left- and right-wing politicians on private for-profit providers remains distinctive. Moreover, political orientations of individuals, political majority in the municipality, as well as privatisation level already achieved locally are identified as important factors in explaining local politicians’ willingness to privatise further. This case study serves as a good example to examine the market development of public welfare in advanced welfare states and also contributes to the contentious discussion of political roles in welfare reform.     

风险容忍对大学生就业能力影响的实证研究 —— 基于行为偏好的中介效应

基于460份来自广东、江西、安徽和上海等地高校部分2014-2016届大学生的调查问卷数据,以风险容忍度高低为分类标准对大学生的风险容忍、行为偏好及其就业能力之间的关系进行实证检验。结果显示,风险容忍度较低的大学生自我感知就业能力总体较低,风险容忍度高的大学生自我感知就业能力总体较高。个人的行为偏好在风险容忍对大学生就业能力的影响中发挥部分中介效应,但随着风险容忍度的提高,其影响方向会发生改变。必须因势利导,帮助大学生正确认识其风险容忍水平,适时抉择;关注心理健康,帮助大学生保持良好的求职心态,形成合理就业偏好;实施差异指导,帮助大学生确立适宜的职业期望,确保工作搜寻适度。     

集体谈判中工人代表的行为偏好分析与激励机制建构

在劳动关系领域,集体谈判被认为是维护劳工权益的有效制度.但中国的经验表明,集体谈判制度的有效性并未得到工人,特别是基层工人的充分肯定.之所以出现这一问题,是因为工人代表在集体谈判中的行为偏好及其与之耦合的激励机制缺位所致.因此,关注工人代表在集体谈判中的行为偏好并建立与之一致的激励机制,是提升中国集体谈判制度效果的现实选择,也是维护工人权益,促进劳资和谐乃至社会和谐的重要之举.
