民营企业财产继承法律问题研究

为保障民营企业的整体和可持续发展,处理好财产继承问题至关重要,否则会引发风险和带来危机.民营企业目前主要存在产权不清晰、不完备、缺乏创新,不同类型的民营企业与实现财产继承权及其他权利存在不衔接、不配套等问题,现行继承法及相关制度不健全、不完善等诸多法律难题.对此,研究并提出改革与完善产权制度,建构与完善现行继承法律制度与企业法律制度及其相互衔接的构想和建议,则具有现实性、重要性和紧迫性.     

我国警察治安调解存在的问题

治安调解是公安机关依法对因民间纠纷违反治安管理行为的非处罚性解决纠纷的方式。在中国具有深远历史的调解文化的影响下,治安调解作为秉承传统调解制度精华和借鉴国外ADR方式基础上形成的办案方式,发挥着治安处罚所无法替代的作用。但在目前的实践中,公安机关对适用治安调解的案件范围、调解的效力等问题存在不同认识,因此应进一步研究其存在的问题并加以解决。     

Decision rules,membership and political centralization in the European Union

The decision to enter the European Union is based on a comparison of the costs of staying out and going it alone, and the costs membership. The latter depend on the degree of preference heterogeneity between prospective members and the Union as well as the decision rules employed for “constitutional” decisions. The same calculus guides the decision, by member states, to shift policies up to the Union level, only now the decision rules refer to centrally assigned policies. Preference heterogeneity makes more inclusive rules optimal in either case while at the same time reducing the attractiveness of membership or the centralization of policies to the EU level, respectively. The analysis complements and extends both traditional fiscal federalism literature as well as the more recent political economics literature on federalism.

论未成年人问题实质上是成年人的问题

未成年人问题作为普遍的社会性问题,其核心是他们的思想道德教育问题。要解决未成年人问题,特别是要解决好他们的思想道德教育问题,必须把未成年人问题与成年人问题放在相互联系的框架中进行。从未成年人问题是成年人的观念认识问题、道德教育问题和生态环境问题等方面来看,在某种程度土未成年人问题实质上是成年人的问题。     

试论当前政府采购工作中存在的问题与对策

政府采购作为财政支出改革的重要内容之一,对于规范预算单位的采购行为,提高财政资金使用效益,从源头上遏制腐败现象的发生都具有重要意义。但是,由于我国政府采购工作还处于起步阶段,在预算编制、运行管理、规模数量、人员素质等方面仍存在一些亟待解决的问题。导致这些问题的原因主要有思想认识存在误区,法律法规不够完善,监督机制尚未健全,信息系统建设滞后。现阶段应采取相应对策,解决问题,进一步完善我国政府采购工作。     

Paradoxes of internationalisation of the Anglophone problem in Cameroon

Historically it is not strange that the Anglophone elites in Cameroon took their case to the international community, since this was a strategy that they employed during the British colonial period. A number of petitions and constant visits were made to the United Nations (UN) by Anglophone elites concerning British neglect of their territory. These petitions were made in the form of presentations before the United Nations in New York or whenever there was a visiting UN mission to the trust territory. Nonetheless, since the early 1990s, the pattern of petitions has changed drastically. Petitions against the new state are different from those earlier petitions against colonialism. The aim of the petitions against the new state has been to draw the attention of the UN and the international community to the injustices inflicted upon minority English-speaking Cameroonians by the ruling government. The Anglophone elites believe that, by making their plight known to the international community, the latter might intervene to restore the statehood of Southern Cameroons.

重构中国行政司法制度

行政司法是行政机关按照准司法程序裁处有关争议的行政法律制度,它缘起于西方国家行政权的扩张和对传统分权制衡理念的反思.我国行政司法在发展过程中存在基础理论匮乏、形式滞后、主体授权不明、程序设计缺位、效力不足等理论和现实问题.应当针对上述问题,立足国情并借鉴域外经验,重构中国特色的行政司法制度.

北京市海淀区人民检察院2001年至2005年办理的生产、销售伪劣产品犯罪以及侵犯知识产权案件,反映了近五年来此类犯罪的基本情况、案件特点,案件办理中也呈现出法律适用以及司法程序的若干问题,如犯罪构成要件尚不明确、司法鉴定问题突出等.     

论执法为民中的警察意识

执法为民是构建和谐社会的重要途径,公安机关践行“三个代表”重要思想的根本体现就是“立警为公,执法为民”。新世纪新阶段,公安机关人民警察执法为民,就是要做到增强公正意识,权为民所用;增强人权意识,情为民所系;增强法律责任意识,利为民所谋。
