我国公用企业滥用市场支配地位的法律规制

我国的公用企业长期具有市场经营与行业管理的双重特征,既具有自然垄断的性质又具有行政主体的性质。公用企业服务质量差、收费透明度低、限制竞争等行为已严重损害了消费者的利益,也成为妨害市场公平竞争的主要原因。因此,需要对公用企业滥用优势地位进行必要的法律规制。     

未成年人犯罪公诉工作的思考

未成年人刑事犯罪给家庭、学校、社会带来隐忧和不安,成为社会各界关注的焦点和迫切需要解决的问题。未成年人犯罪对其如何处罚,不仅关系到未成年犯的前途,而且会产生巨大的社会影响,意义重大深远,检察机关的公诉部门承担着对未成年犯罪诉讼工作,笔者结合多年从事公诉工作的实践,就基层检察院在公诉工作中如何对未成年人犯罪开展公诉工作进行思考、探讨。     

论法律监督与控、辩、审的关系

The purpose to set up public prosecution power is to restrict the investigation and judicial power. Public prosecution power is an organic combination of prosecution and trial supervision. The procurator’s supervision in the court does not infringe on the defendants’ procedural right. The procuratorial organ’s supervision on the matters of the court at the same level is only a power to start the correction procedure, however, the substantive power to make the final decision of whether to admit the mistake and how to make remedies belongs to the court. Therefore, the public prosecution’s status is much higher than that of the defense and the interferences with independent judicial power of courts by legal supervision do not exist in China. Gao Jingfeng is a senior procurator of the Supreme Procuratorate of China, National Research Specialist in procuratorial theory. His over ten major works include The Report on Judicial Reform—the procuratorate and courts in China, Chinese Procuratorial Practice, Outline of Chinese procuratorial system, Research on Office Crimes. His over thirty academic articles were released by the journals, such as Jurists, Legal Procedure and Judicial Systems, Procuratorial Daily, People’s Procuratorial, Legal Daily.     

政府公共服务效能提升的对策研究

在全球化的城市体系下,世界国与国之间、城市与城市之间的竞争变得异常激烈,政府公共服务效能和质量的高低将成为影响国家和城市竞争力的重要因素,因此提升政府的公共服务效能是提升城市竞争力和政府形象的有效途径。虽然我国政府公共服务效能提升已取得一定的成效,但是与发达国家和政府的公共服务效能相比还存在不小的差距,因此应通过政府公共服务均等化、加大政府公共服务投入、建立政府公共服务绩效排行制度等措施提升政府的公共服务效能,建设真正的"服务型政府"。

通过对汶川地震恢复重建规划的分析可以发现，行政规划的确定将对众多社会群体的法律利益和事实利益产生重大影响。为此，有必要构建行政规划中的公众参与程序，作为公有制前提下公共利益与个体利益的平衡器，并以主体性公众参与作为目标模式。在行政规划的公众参与过程中，容易因公众参与的无限扩张导致政府决策效率低下甚至无法决策，或因公众利益的分化和参与不平衡导致社会公正受损，或者发生公众意见对法律和政策目标的偏离，对此均应竭力避免和纠正。

SEX EDUCATION LEFT AT THE THRESHOLD OF THE SCHOOL DOOR: STRICTER REQUIREMENTS FOR PARENTAL OPT‐OUT PROVISIONS

Current state law creates the risk that, if sex education is not provided to a child in public school, no similar instruction will be given to the child. Legislatively enacted opt‐out provisions give parents broad control over their child's education by granting them the option to have their child excused from any sex education requirements within a public school's curriculum. Through public school sex education, professionals provide youth information aimed at protecting them from the dangers of pregnancy and sexually transmitted diseases (STDs). A stricter statutory opt‐out provision should be enacted by state legislatures that only allows parents to excuse their child from sex education after a parent attends a 90‐minute STD prevention course and receives the instructional material used in the school's sex education curriculum. Parents should be provided up‐to‐date information and a structural framework designed by the school to encourage them to discuss with their child the many sexual issues addressed within a school's sex education curriculum.
