社会法作为寓于法律社会化过程中的公法与私法相融合的第三法域 ,在其发展到一定阶段 ,出现了作为经济领域法律社会化现象的经济法。因而 ,一方面 ,经济法具有广义社会法的基本属性 ;另一方面 ,经济法与狭义社会法之间 ,各自所对应的国家干预在范围、宗旨和手段上都不尽相同 ,但在经济与社会趋于一体化的现代市场经济体制中 ,需要完善其功能的配合。  相似文献

The effects of process control and decision control on procedural fairness judgements are examined with regard to the procedure used by commercial banks in granting business credits to entrepreneurs. Male and female entrepreneurs with experience in requests for business credits were interviewed about several aspects of the procedure for granting business credit. Respondents had either a positive or a negative experience with credit granting (i.e., the request was or was not rewarded). The outcome-oriented and the procedure-oriented explanations for the effects of process control on procedural fairness judgments are discussed. The results show that, contrary to expectation, process control had no effect on the procedural fairness judgments. On the contrary, perceived seriousness of treatment, as well as the predicted effects of decision control, did influence procedural justice judgments. Moreover, some support was found for the contention that seriousness of treatment functions as precondition for process control effects (Tyler, 1987). Neither the outcome-oriented, nor the procedure-oriented explanation could fully account for the findings. It is assumed that the specific aspects of the situation are responsible for the results, indicating how important the situational context is in research concerning procedural justice.  相似文献

Twelve married couples court-ordered to attend a violence reduction treatment program completed self-report measures of anger, social problem-solving skills, and strategies employed for dealing with high-conflict situations. They were subsequently videotaped while discussing 3 different scenarios. Three raters independently coded the videotapes for the use of effective and ineffective communication strategies used by the participants. Aggregate reliability estimates were acceptable. No gender-based differences were found on the self-report measures or the communication skill ratings. When couples discussed low-conflict situations use of effective skills exceeded use of ineffective skills, and when couples discussed high-conflict problems use of ineffective skills exceeded use of effective skills. Implications for treatment of spousal assault are presented.  相似文献

This article addresses the problems that emerge when students in international studies courses approach the subject matter from the perspective of the first person plural. Whether in terms of "we,""us," or "our," many college students choose to adopt a personal perspective in discussions of international affairs. While it is natural for students to base their analysis of international studies on their personal observations and experiences, this inclination to adopt a collective first person approach detracts from the scholarly neutrality toward which students of global studies should aspire. Furthermore, a first person plural approach to course subject matter creates the false impression among students that they are all in agreement over contentious issues of global interactions and the theories employed to study them. The article concludes with suggestions for remedying the "we" problem, and offers advice for instructors who have encountered it in their own classroom.  相似文献

金融操作风险虽然形式多样,但在我国,却主要表现为金融业高管腐败的日趋严重、金融业违规操作的日益严峻、金融违法犯罪的日益猖獗和操纵证券市场的屡禁不止。而监管体系结构的失衡、监管治理机制的薄弱和监管规则的相对滞后等多种因素的综合影响和交互作用,则是根本的症结所在。总之,我国金融操作风险的有效防范和金融业核心竞争力的提高,不仅需要进行监管制度创新,统一金融监管权威,建立存款保险制度,而且应当健全金融法规体系,发展金融同业公会,以构建政府掌舵——市场约束——社会参与的新型金融监管体系。  相似文献

In this essay I examine the intersection of domestic and international politics in the formation and conduct of foreign policy. 1 develop a three‐actor model that allows us to specify the incentives for power sharing under different assumptions about the distribution of preferences and capabilities between a government, a domestic opposition, and a foreign state. The model generates several interesting hypotheses about the interaction of policy goals and the willingness of actors to share power. In particular, I show that under certain conditions there are important asymmetries whereby doves may be more willing to share power than hawks. Importantly, this willingness is endogenous to the model and comes from the alignment of preferences in the policy space, rather than from an a priori value for the democratization of foreign policy making. The model also suggests several hypotheses about the circumstances under which states have incentives to meddle in the foreign policy processes of other states.  相似文献

Perceptually contemporaneous offenses are crimes that are coupled in people's minds when they express fear. Previous studies have shown that fear of rape predicts women's fears of other crimes. This study examined the differential effects of sexual and nonsexual assault as offenses that may be coupled with specific gang crimes. For both women and men, once physical harm is accounted for by controlling for fear of nonsexual assault, fear of rape explains much less variance than it does when it was included alone. We argue that fear of physical harm, not the sexual intrusion in rape, has the strongest effect on fear for both women and men.  相似文献
