现代化建设离不开作为生产力第一要素的人 ,离不开市场经济体制 ,而提高人的素质和建立市场经济体制都要以理性为前提。在我国 ,为加快现代化建设的步伐 ,必须实施科教兴国、以德治国、依法治国的战略 ,实施这三个战略同样必须高扬理性。

Examining Factors Co-Existing with Interpersonal Violence in Lesbian Relationships

Interpersonal violence within lesbian relationships is a significant yet understudied problem. Women attending a gay pride festival in Atlanta, GA, were asked to complete a survey concerning same-sex interpersonal violence. Women who reported being in a current or previous same-sex partner relationship were included in the analyses (N = 226). Factors that occurred in the context of interpersonal violence were investigated: substance use, HIV/STI risk behaviors, barriers to reporting abuse, and attitudes inhibiting seeking of social support. In addition, the survey assessed relationship-related power dynamics. Results of multivariate analyses support the hypotheses that power imbalance and inequality when making sex-related decisions within women’s same-sex relationships are associated with interpersonal violence. Further findings suggested that a combination of factors must be considered when dealing with and reducing the risk for violence in same-sex relationships.     

Did Jamie Oliver Really Put School Dinners on the Agenda? An Examination of the Role of the Media in Policy Making

Healthy eating is high on the government's agenda in current times and to all intents and purposes the media appears to have played a crucial role in putting it there. While media focus is no doubt intense and playing a vital role in public education (take Jamie Oliver's 2005 Channel 4 documentary, ‘School dinners’, for example), the question that lies at the heart of this article, is whether the media has led the government agenda on healthy eating and school dinners as appears to be the case. A close examination of the evidence suggests otherwise: government policy was already well set before the media began to show a concerted interest and hence its influence on policy‐making is more limited than might be expected. Rather than setting agendas per se, the media's role has been to refine and energise existing policy areas and to facilitate implementation.     

延安精神及其生成环境与条件的历史考察

延安精神作为中共的一笔宝贵财富，具有革命性、民族性、时代性和群体性特征，是中共在延安时期领导民族独立和人类解放斗争实践中，倡导、培育、形成的把传承中华民族精神与彰显共产党人革命精神有机结合，既体现无产阶级及其政党性质、宗旨，又富有广泛人民性的具有鲜明时代特征的群体精神风貌和道德情操。在各种因素综合作用下，使得延安时期培育生成了伟大的延安精神。     

转型社会的政治决策：期权博弈与公平均衡解释

在转型社会中，政治决策是拥有主要政治权力的行政主体，与反映主要群体利益的社会主体之间的博弈均衡。现实的各种政治后果可以从考虑期权价值的延迟均衡和抢先均衡来说明，也可以表现为考虑心理动机的“公平均衡”。在如同海峡两岸博弈这样复杂的均衡组合中，作者推论存在可以称为“虚妄公平”的均衡概念。转型社会的各个主体因此必须寻求“真实公平”策略选择，才能实现真正公平的政治决策目标。     

论股东劳务出资的可行性及其法律规制——以法经济学为视角

劳务出资是指股东以精神上和身体上的劳务作为出资取得股东身份。我国公司法修订后,劳务出资问题被推到了风口浪尖之上,成为理论界的一个热点问题,众多学者对此各抒己见,形成了不同的观点。文中从一个全新的角度——法经济学的视角出发,从理性人假设、博弈论分析、守法成本等几个方面对劳务出资的合理性、运用法律对劳务出资进行规制的必要性和劳务出资法律规范的选择等问题进行了分析和论证。     

虚开增值税专用发票罪客观行为的共犯论展开

《刑法》第二百零五条第四款对虚开增值税专用发票罪的客观行为方式进行了明文列举。其中，让他人为自己虚开，是立法上对必要共犯中的对向行为进行处罚的特别规定。介绍他人虚开，本属于虚开增值税专用发票的帮助行为，本条的规定是将共犯行为实行行为化，也应认为是一种特别规定。自然人介绍单位之间虚开增值税专用发票的，对自然人不应适用死刑。     

Earth Day and Its Precursors: Continuity and Change in the Evolution of Midtwentieth‐Century U.S. Environmental Policy

Earth Day 1970's legacy overshadows two earlier events resulting in popular misconceptions about U.S. environmental politics: that environmental policy began with Earth Day and that Congress and the president were not concerned with the environment until public opinion and interest groups pressured them. These misconceptions increase public opinion ambivalence and frustrate environmental leaders. This paper describes Earth Day 1970, the congressionally established Outdoor Recreation Resources Review Commission established in 1958, and President Kennedy's Natural Resources Tour of September 1963, arguing the latter two prepared for the convergence of multiple streams of policy change that resulted in the first Earth Day.     

论诱惑侦查的相对合理主义

诱惑侦查作为一种特殊的侦查手段,在我国司法实践中一直被广泛地运用,但在立法上对其并无明确的规定,从而导致实或中的混乱及溢用,并引起极大争议。实际上,对这个问题的讨论不能简单化,应在追求相对合理的前提下,一方面使诱惑侦查这种有效的侦查措施继续存在,另一方面针对其可能带来的弊端进行规范,最大限度地降低其负面影响,以实现诱惑侦查应有的价值。
