杀人碎尸案件研究

杀人碎尸案件,是指在非法剥夺他人生命之后,又行分尸灭迹的特大案件。杀人碎尸案件犯罪嫌疑人在主观方面认为有分尸转移案发现场的必要性;在客观上存在分尸转移案发现场的可能性;在心理层面有分尸转移案发现场的不得已性。杀人碎尸案件侦查,大体有两种模式:从尸块——尸体——被害人身份认定——因果关系调查及临死前行踪调查——犯罪嫌疑人的模式;从抛尸现场——杀人碎尸案发现场——犯罪嫌疑人的模式。     

村干部职务行为及其廉政风险防控机制建设研究

坚决惩治和有效预防腐败,是新时期执政党治理腐败的主要思路。在广大农村,鉴于实践中已经出现的因村干部腐败行为而引发的各类问题和矛盾,如何规范村干部职务行为,防范廉政风险已是当下农村基层党风廉政建设的突出课题。从农村工作实际来看,村干部的职务行为主要围绕“政党代言人”、“政府代理人”和“村民当家人”三个角色而展开,其廉政风险点主要集中在思想道德、岗位职责、制度机制三个方面,相应的风险防控也要围绕这三个方面展开。     

Alcohol dependence and criminal behavior: preliminary results of an association study of environmental and genetic factors in an italian male population

The aim of this study is to propose an innovative approach evaluating the connection between alcohol use disorders and criminal behavior. The research, structured as a case–control study, was based on the analysis of environmental (social variables) and genetic factors (single nucleotide polymorphisms of glutamic acid decarboxylase) in a population (N = 173) of Italian alcohol‐dependent men. Group 1 (N = 47, convicted subjects) was compared with Group 2 (N = 126, no previous criminal conduct). Grade repetition, work problems, and drug problems were statistically associated with criminal behavior. Having daily family meals together and having children were inversely related to convictions. The genotype distribution of the two groups was similar. The association between environmental factors and antisocial behavior confirms previous findings in the literature. The lack of genetic association does not exclude the role of the gamma‐aminobutyric acid (GABA) system in determining antisocial behavior; further studies with larger samples are needed, together with investigation of other components of the GABA pathway.     

前构成要件行为概念之提倡——兼评可罚违法性理论和我国《刑法》第13条但书规定

前构成要件行为是指尚未进入刑法评价的行为,是刑法评价的对象。前构成要件行为具有行为性和法益侵害性两大特征,由行为人、行为、行为对象以及法益四个要素予以体现。前构成要件行为的功能在于将法益侵害轻微的行为排除在刑法评价对象之外,并且区分了刑法评价对象和刑法评价本身。因此,前构成要件行为实质上发挥了三阶层理论中可罚违法性的机能,并且暗合了我国《刑法》第13条但书的规定,避免了其在犯罪论体系上的弊病,因而具有重要的理论和现实意义。     

规范行政行为 深化依法行政理念

依法行政是依法治国的重要组成部分和核心内容。在准确把握依法行政基本内涵的基础上,深化依法行政所应遵循的基本理念,规范行政行为,对于推进和加强当前我国的依法行政工作具有重大意义,也是对实现全面建成小康社会和全面深化改革开放目标提出的新要求。     

论群体矛盾和群体行为

当前我国的群体矛盾具有利益性、群体性 ,矛盾的主要方面是管理层。众多人聚合在一起的社会行为可分为乌合行为、群体行为、组织行为三种类型 ,有其各自的行为特征和发展过程。群体行为具有正负两方面的社会功能。为预防大规模的群体行为要建立宣泄机制 ,建立社会预防体系。对危及社会稳定的群体行为应尽量采用软控制方式 ,万不得已方可动用硬控制手段     

Predictors of Child Behavior Problems among Children of Female Vietnam Veterans

This study examined the impacts of intimate partner aggression by female Vietnam veterans and their male partners on their children’s behavior problems (N = 100 children). Veteran and partner psychological distress were also examined as potential mediators of these relationships. Results indicated that physical and psychological aggression perpetration by both the female veteran and the male partner was associated with child behavior problems. Contrary to expectations, psychological distress in the veteran and partner was not associated with child behavior problems and did not mediate the effects of physical and psychological aggression on this outcome.     

危害行为理论及其体系地位的反思与重构

危害行为理论是我国刑法学理论的根基,在我国刑法学理论中有着重要的地位。但目前危害行为在刑法理论中的体系地位不当,导致了犯罪构成理论的混乱和司法实践的困惑,与我国刑法理论的发展完善、刑事法治的实现尚有抵牾之处。鉴此,从危害行为理论的反思、危害行为体系性地位的辩驳以及司法实践的困惑等方面对我国的危害行为理论进行系统批判,同时把危害行为置于犯罪构成之前作为刑法中的行为进行评价,无疑会有助于我国犯罪构成理论体系的不断完善。     

廉洁文化：从理念到行为的转化机理和过程研究

廉洁文化建设要“内化于心、固化于制、外化于行”，真正发挥“文化而润其内，养德以固其本”的作用。培育廉洁文化的基础是提炼廉洁文化理念，包括廉洁目标、使命、价值观、风气、伦理道德和精神等。廉洁文化从理念到行为的转化，首先是廉洁文化理念要得到全体员工的认同，其次是廉洁从业要成为员工的日常习惯和日常行为．再次是要塑造全体员工廉洁从业形象。
